10-18-2021 Minutes- L - 1111 ,.... 1111 "' "' z c.. w "' .£ <ii (/) ~ :!2 ~ c: 0 u CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS October 18, 2021 4:00 p.m. The City Commission convened at 3:00 p.m. in Room 107, City-County Building, for a study session which consisted of a presentation entitled Sidewalk Construction and Repair. Mayor Hodges asked the Clerk for verification that notice had bee n sent for today's City Commission meeting . The Clerk replied yes. The Regular Meeting of the Board of Commissioners was called to order at 4:00 p.m. in Room 107 , City- County Building. A roll call was taken followed by the Pledge of Allegiance and a moment of silence. Those present and comprising a quorum: Mayor Melissa Rose Hodges (presiding), Trent W. Davis, M.D., Michael L. Hoppock, Aaron Peck and Karl Ryan. Also present: Mike Schrage, City Manager (via Zoom), Jacob Wood , Deputy City Manager; Greg Bengtson, City Attorney; and Jo Vonna A. Rutherford , City Clerk. A WARDS AND PROCLAMATIONS None. CITIZENS FORUM Mayor Hodges announced that there had been an individual in attendance last week who had tested positive for COVID and indicated this individual neither had a mask nor practiced social distancing. Mayor Hodges requested any individual who had attended the meeting to keep an eye on symptoms as there was exposure and urged any individual with symptoms to be cautious and use one of the many other means for participation in the meeting . Mr. Wallace was participating by Zoom and wanted to comment but was unable due to technical difficulties. Mayor Hodges stated she hoped Mr. Wallace would reach out via telephone, email, or regular mail to be heard . PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (5.1) Public Hearing-Rural Housing Incentive District (5.la) Conduct Public Hearing. (5.1 b) Approve Ordinance No. 21-11090, establishing a Rural Housing Incentive District (RHID) within the City and adopting a plan for the development of housing and public facilities in such di str ict, and making certain findings in conjunction therewith (South View Estates). (5. lc) Approve Resolution waiving the residential building fees associated with the South View Estates Rural Housing Incentive District (RHID) Mayor Hodges opened the public hearing. Lauren Driscoll , Director of Community & Development Services, explained the request, fiscal impact and action options of Items 5. 1 a and 5 .1 b. A discussion followed related to the amount of property tax returned to the developer, 25-year RHID timeline, property value, project timeline, contents of the development agreement, and cost of housing and housing needs . Ill - L "' "' z 0.. w "' !;; <ii Cf) ~ 21-011 9 c: 8 21-0320 21-0321 Chad Farber, Salina, Kansas , reiterated a prior comment in that this housing, in this price point, is needed and further stated housing in this price point and even a little bit lower would be beneficial to the community. Mitch Robinson , Salina Community Economic Development Organization, Salina, Kansas, indicated it was great to have the opportunity to speak in favor of the RHID and commended everyone on improving the housing situation in Salina. The transcript of the comments received at the public hearing on September 13 , 2021 , were formally entered into the record and Mayor Hodges closed the public hearing. Moved by Commissioner Davis, seconded by Commissioner Ryan , to approve Ordinance No. 21-11090. Aye: (5). Nay (0). Motion carried . Lauren Driscoll, Director of Community & Development Services, stated she had no additional information to present other than what was provided in the agenda packet related to Item 5 .1 c. Mayor Hodges shared that housing plans , developing and benefits packages that can be offered to developers were just reviewed with Marty Shukert and waiver of building fees was not listed. A discussion ensued regarding establishing guidelines for incentive use, policy, precedence, request for and urgency of affordable workforce housing, economic development, waiver of building fees , consultant discussions, ability of Governing Body to waive fees , and development of a tool box for future use . Commissioner Davis provided his thoughts on the issue which included being in favor of the project, the offering of multiple housing types , the completion window, and the group of builders and developers. Commissioner Davis continued by stating the city is deserving of the building permit fees and waiving them is not part of the current housing plan as well as shared, among other items , his thoughts and concerns in setting a precedent, financial viability, incentives, housing infill , and alternative action . A discussion followed related to infill development, greenfield development, neighborhood revitalization , rebates , incentives, postponement of item, development agreement, and advancement of the project. Chad Farber, Salina, Kansas, suggested there was an emergency situation with housing and the project needed to be moved forward as quickly as possible. Further discussion followed regarding precedent for waiving fees, rebate program, policy, development, infill, greenfield , neighborhood revitalization and future study sessions. Moved by Commissioner Hoppock, seconded by Commissioner Peck, to approve Resolution No. 21-7994. Aye: (3). Nay (2 -Davis, Hodges). Motion carried. Motion carried . iADMINISTRA TION (7.1) Second reading, Ordinance No. 21-11079, annexing a 34 acre tract of land on the east side of South Ohio Street between Magnolia Road and Schilling Road into the city limits. Mayor Hodges stated the ordinance was passed on first reading on October 11, 2021, and no comments have been received since that time . (7.2) Second reading, Ordinance No. 21-11085 , changing the zoning district classification of three (3) Central Mall outlets located on the north side of Magnolia Road from PDD C-1 (Restricted Business) to PDD C-3 (Shopping Center District) to allow construction of a hotel on the property. Mayor Hodges stated the ordinance was passed on first reading on October 11 , 2021 , and since that time the ordinance had been modified to add an additional condition of approval adopted by the Governing Body at the October 11 , 2021 , meeting requiring modifications to be made to the Century Plaza Drive and Magnolia Road intersection prior to the issuance of a Certificate of Occupancy for the proposed hotel. Dean Andrew, Director of Planning, called the attention of the Governing Body to page 2 of the ordinance, under Section 3E, which contained the actual language incorporated into the ordinance. A brief discussion followed related to additional study or examination of the intersection to include traffic accident history, turn movements , and roadway improvements as well as signage and traffic design . Moved by Commissioner Davis, seconded by Commissioner Hoppock, to approve Ordinance No . 21-11085 on second reading. A roll call vote was taken. Aye: (5). Nay (0). Motion carried. DEVELOPMENT BUSINESS (8.1) Consider Resolution No. 21-7993 authorizing the City Manager to permit the Salina VFW Post #1432 Auxiliary (VFW) volunteers to solicit within the City 's rights-of-way. Moved by Commissioner Ryan , seconded by Commiss ioner Hoppock, to approve Resolution No . 21-7993 authorizing the city manager to permit the Salina VFW Post #1432 Auxiliary (VFW) to solicit within the City 's rights-of-way. Aye: (5). Nay (0). Motion carried. (8.2) Authorize city staff preparation of a Special Assessment Engineering Feasibility Report for Phase II of Magnolia Hills Estates Addition No. 2. Commissioner Hoppock recused himself. Dean Andrew, Director of Planning, explained the request, fiscal impact and action options. A discussion developed on the topic of street maintenance, corresponding income generators m terms of property tax , rubric for future project analysis as well as asphalt and concrete paving. Stan Byquist, Salina, Kansas, ex pressed hope for approval of the project and touched on concrete versus asphalt paving . Moved by Commissioner Ryan , seconded by Commissioner Davis, to authorize staff to prepare an engineering feasibility report and Resolution of Advisability for Phase II of Magnolia Hills Estates Addition No . 2 for future consideration by the City Commission .
