04-23-1928 Minutes1 COMMISSIONERS PROCEEDINGS, REGULAR MEETING. COMMISSIONERS ROOM, SALINA, KANSAS. APRIL 23rd, 1928. Regular meeting of the Board of Commissioners, April 23rd, 1928. Meeting was called to order by Mayor Helvering, the roll was called and Commissioners Helvering, Campbell and Dodds and City Attorney Norris responded. The minutes of the Regular Meeting of April 16th, 1928, were read and approved as read. An ordinance was introduced for second reading entitled: "An ordinance relating to and prohibiting the emission or dis- charge into the open air of dense smoke within the City of Salina, declaring such emission or discharge to be a public nuisance, providing for the abatement thereof, providing for the construction or reconstruction of furnaces and boilers, and attachments there- to, for the purpose of preventing the emission or discharge of dense smoke therefrom, providing the method for the enforcement of this ordinance and providing a penalty for the violation thereof." On motion of Commissioner Campbell the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Helvering, Campbell and Dodds (3) Nays: (0) The Mayor approved the same and is num- bered 3524. An ordinance was introduced for second reading entitled: "An ordinance amending Section 4 of Ordinance Number 2993, being Section 5-204 of the Revised Ordinances 1925, relating to the if construction of buildings and the issuing of permits therefor. On motion of Commissioner Dodds the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Helvering, Campbell and Dodds (3) Nays: (0) The Mayor Ep proved the same and is numbered 3525. A resolution was introduced for second reading entitled: "A resolution relating to the curbing, guttering, grading and paving of Columbia Avenue from the north line of Johnstown Avenue to the south—line of As treet. On motion of Commissioner Dodds the resolution was adopted as read and on its final adoption the roll was called and the following vote was had; Ayes: Helvering, Campbell and Dodds (3) Nays (0) Mayor approved the same and is numbered 443. The above resolution is recorded in full on Page 86 of Resolution Book Number 2. The resolution which was introduced March 27th 1928, for the curbing, guttering, grading and paving of North Street from the east line of Twelfth Street to the intersect on o orth Street with the west city limits of the City of Salina at the Union Pacific Right-of-way was presented for final adoption. City Clerk produced evidence of the publication in the official City paper of a notice of the introduction of said resolution twenty days before said notice as the time and place for hearing written objections to said public improvement and for the passage said resolution. saidThe resolution or to said announced that no persons appeared toobject to improvement. Commissioner Campbell moved that the resolution be amended by eliminating curb and gutter and that the pavement be of con- crete 30 feet wide, which motion to amend was duly sed onded and carried by unanimous vote of the Commissioners. Thereupon said resolution as amended was duly read as follows: (First published in the Salina Journal RESOLUTION NO. 442. 1928) A Resolution providing for the grading and paving of North Street from the east line of Twelfth Street to the intersection of North Street with the west city limits of the City of Salina at the Union Pacific Railroad right-of-way. 4 4 F WHEREAS, in the judgment of the Board of Commissioners of the City of Salina, Kansas, it has become expedient and a public necessity to grade and pave North Street in said city connecting the existing pavement on Twelfth Street at North Street in said city with a certain county road in the County of Saline, extend- ing west from the city limits of said city at the intersection of said North Street with the right-of-way of the Union Pacific Railroad, and WHEREAS, the Board of commissioners of said city desire to co-operate with Saline County, Kansas, in the improvement of the portion of said street above described in the manner provided for by Sections 13-1032 to 13-1035 inclusive, of the Revised Statutes of Kansas, 1923; NOVI THEREFORE, BE IT RESOLVED by the Board of Commissioners of the City of Salina. Kansas: That it has become expedient and a public necessity to grade and oave North Street in the. City of Salina, from the east line of Twelfth Street to the city limits at the intersection of North Street and the right-of-way of the Union Pacific Railroad, so as to connect the existing pavement on Twelfth Street in said City at North Street, with the County road extending west from said city limits at the intersection of North Street with the right-of-way of the Union Pacific Railroad, such portion of said North Street being less than one half mile in length; and that said street within such limits be graded and paved in the manner provided by the statutes above mentioned. That said paving shall be of concrete 30 feet wide. That the cost of such improvements shall be aid as follows: 30 per cent by the City of Salina, 30 per cent by aline County and 40 per cent by the property liable to special assessment, all of such amounts to be determined, assessed and collected in the manner provided by law. On motion of Commissioner Campbell, duly seconded, said resolution as amended was duly adopted as read and on its final adopt ion the roll ttas called and the fb llowing vote was had; Ayes: Helvering, ampbell and Dodds (3 ) Nays: (0 ) Mayor approved the same and is numbered 442. On motion of Commissioner Dodds, duly seconded and carried the City Clerk was instructed to certify said resolution as adopted to the Board of Commissioners of Saline County for action as provided by law. An ordinance was introduced for first reading entitled: "An ordinance providing for the curbing and guttering, grading and paving of North Street from the west line of Ninth Street to the east line of Twelfth Street, and providing for the cost thereof, how the same shall be assessed and the manner of pay- ment therefor." On motion of Commissioner Campbell same was referred to the Board of Commissioners. An ordinance was introduced for first reading entitled: "An ordinance vacating certain parts of certain alleys located in Blocks 4, 5, 6.911 7, 8 and 9 in Calkin's Addition in the City of Galina, Kansas. — On motion of Commissioner Dodds same was referred to the Board of Commissioners. 447 i i An ordinance was introduced for first reading entitled: "An ordinance confirming and ratifying a contract for the building and construction of a certain storm sewer in the City of Salina, described as Storm Sewer Number 8 and providing for the issuance of temporary notes to pay the cost thereof as the work progresses, pending issuance and sale of bonds for the payment of the cost thereof, as provided by law. On motion, same was referred to the Board of Commissioners. An ordinance was introduced for first reading entitled: "An ordinance confirming and ratifying a contract for the im- provement of certain streets in the City of Salina, Kansas, and providing fot the issuance of temporary notes to pay the cost thereof as the work progresses, pending the issuance and sale It of bonds for the payment of the cost thereof as provided by law. On motion, same was referred to the Board of Commissioners. Concrete construction maintenance bond was received from Pete Ahlstedt, and on motion of Commissioner Campbell same was approved by the Board of Commissioners. Mayor Helvering appointed John Frederick, E. D. Martin and Ralph A. Smith to act as appraisers in ascertaining the valua- tion of certain lots and pieces liable for the cost of curbing, guttering and paving: Lincoln Avenue from Santa Fe venue to Ninth Street; Minneapolis Avenue from Highland Avenue to Ninth Street; Oakdale "venue from Iron Avenue to Gypsum Avenue, for the paving of: Alley between Seventh and Eighth from Ash to Elm Streets; Ninth Street from North Street to Lincoln Avenue; Cedar 6treet from Phillips Street to College Avenue; for the curbing and guttering of Center Jtreet from Fifth Street to entrance to Kenwood Park. A petition was presented asking for the construction of a Sewage Pumping Plant to handle the sanitary sewers in a portion of Highland Court Addition and Southern Heights Addition. On motion, same was referred to the City 7 -Engineer. A petition was presented asking for the curbing and gutter- ing of Second Street from Elm Street to North Street. A resolution was introduced for first reading entitled: "A resolution relating to the curbing and guttering of Second Street from the north line of Elm Street to the south line of North 5'treet." On motion of Commissioner Campbell same was referred to the Board of Commissioners. Bid was received for concession privileges in Oakdale i'ark during the season 1928, from Oren D. Kratzer. On motion, same was referred to the City Manager. City Manager Ragle reported on the remonstrance against the curbing, guttering and paving of Oakdale Avenue from Gypsum Avenue to Oakdale Drive as follows: "According to records in the Register of Deeds office of Saline County, Kansas, a majority of the resident property owners have signed said remonstrance, and that resolution passed and approved by the Board of Commissioners, March 27th, 1928 is defeated." On motion of Commissioner Dodds report was accepted by the Board of Commissioners.
