Regular meeting of the Board of Commissioners, November
16th, 1931. Meeting was called to order by Mayor Stevenson, the
roll was called and Commissioners Stevenson, Benfield, Morey, Paf-
ford and Spaeth and City Attorney Norris responded.
The minutes of the regular Meeting of November 9th, 19310
were read and approved as read.
An ordinance was introduced entitled: "An ordinance making
an appropriation for the payment of certain claims."
On motion of Commissioner Morey the ordinance was read and
adopted by sections and on its final adoption the roll was called
and the following vote was had; Ayes: Stevenson, Benfield, Morey,
Pafford and Spaeth (5) Nays: (0) Mayor approved the same and is
numbered 4117.
An ordinance was introduced for second reading entitled: "An
ordinance vacating a portion of the north and south sides of Antrim
Avenue from the west line of Ninth 6treet to the west City limits
of the City of Salina."
On motion of Commissioner Pafford the ordinance was read and
adopted by sections and on its final adoption the roll was called
and the following vote was had; Ayes: Ste{tenson, Benfield, Morey,
Pafford and Spaeth (5) Nays: (0) Mayor approved the same and is
numbered 4118.
An ordinance was introduced for second reading entitled: "An
ordinance providing for and requiring the paving of certain portions
of North Street in the City of Salina between the east line of Santa
Fe Avenue and the west line of Fifth Street, occupied by certain
railroad companies."
On motion of Commissioner Pafford the ordinance was read and
adopted by sections and on its final adoption the roll was called
and the following vote was had; Ayes: Stevenson, Benfield, Morey,
Pafford and Spaeth (5) Nays: (0) Mayor approved the same and is
numbered 4119.
An ordinance was introduced for second reading entitled: "An
ordinance providing for and relating to the construction, reconstruc=
tion, repair, maintenance, use and inspection of gas pipes and pip-
ing for natural or artificial gas, and the fittings, devices, appli-
ances and connections appurtenant thereto, within the City of Salina,
Kansas, requiring a license and bond of persons engaged in such work,
and providing for the regulation thereof and providing penalties
for the violation of said ordinance, and repealing Ordinances No.
3078 and 3642 and Section 7 of Ordinance No. 2993."
On motion of Commissioner Morey the ordinance was read and
adopted by sections and on its final adoption the roll was called and
the following vote was had; Ayes: Stevenson, Benfield, Morey,
Pafford and Spaeth (5) Nays: (0) Mayor approved the same and is
numbered 4120.
A resolution was introduced entitled: "A Resolution relating
to the building to be erected by the Cultra Company."
On motion of Commissioner Benfield the resolution was read
and adopted as read and on its final adoption the roll was called
and the following vote was had; Ayes: Stevenson, Benfield, Morey,
Pafford and Spaeth (5) Nays: (0 Mayor approved the same and is
numbered 521.
The above resolution is recorded in full on Pages numbered
172 and 173 of resolution Book Number 2.
Mr. Chas. W. Shaver submitted his resignation as a member of
the City Planning Commission as follows:

Dear Friend:
In view of my recent appointment to the Salina Water
Board, and the apparent fact that one person should not occupy two
appointive city offices, I hereby tender to you and the Honorable
Board of City Commissioners my resignation from the City Planning
Commission.
I am sending a copy of this letter to Mr. F. S. Dyar, Salina
of the City Planning Commission; and want to assure you and the
members of the City Planning Commission that I have thoroughly en-
joyed the association of these men and the work accomplished by the
Planning Commission.

Commissioner Morey moved that resignation be accepted by the
Board of Commissioners. Motion carried.
Mayor Stevenson appointed Chas. W. Shaver as a member of the
Waterworks Advisory Board to fill vacancy caused by the resignation
of Roy M. Heath.
On motion of Commissioner Morey the appointment was confirmed
by the Board of Commissioners.
Mayor 43tevenson appointed Ben H. Byrnes as a member of the
City Planning Commission to fill vacancy caused by resignation of
Chas. W. Shaver.
On motion of Commissioner Pafford the appointment was confirmed
by the Board of Commissioners.
Bids for the construction of Storm Sewers No. 10-A and 14 as
advertised were received.
The following statement was read before bids were opened:
"The following statement was read before bids on storm sewers
No. 10-A and 14 were opened and read at Commissioners meeting on
lovember 16, 1931, at 3:00•P. M. and any bidders not agreeable to
accepting these conditions were given the opportunity of withdrawing
their bids. None of the bidders whose bids had been filed withdrew
their bids.
The successful bidder will be required to agree in waiting,
before a contract is awarded, that the decision as to the ability
or willingness of any laborer to work will be left to the City Engineer
and will be entirely within his discretion; also that the decision of
the City Engineer will govern as to the suitability of westerh conditions!
for carrying on the work.
If the contract is let on the basis of the use of concrete pipe,
the successful bidder will be required to secure from the manufacturer
of the concrete pipe which he uses an agreement in writing that all
of such pipe will be manufactured in Salina and that all labor employed
in the manufacture and handling of such pipe will be governed by the
special specifications relating to labor in the construction of such
work by the principal contractor.
The successful bidder will be required to furnish a bond executed
by some surety company which has an authorized agent residing in
Salina, and the City shall be furnished with the name of the surety
company which the contractor proposes to have execute his bonds so
that the city may have a reasonable opportunity to investigate the
financial responsibility of the surety before the bonds are approved.
All material used in the job shall be purchased in Salina if the
same can be so purchased on a competitive basis. At least three low
bids will be held until Wednesday at 3:00 P. M. for decision.

I hereby agree to the foregoing as additional conditions and
as a consideration for the awarding to me of the contract for Storm
Sewers No. 10-A and 14.
Contractor."
Proposals from the following bidders were opened and read:
Brown Bros., Kansas City, Kansas.
Thomson & Schooley, Kansas City, Kansas.
W. B. Honska Construction Company, Concordia, Kansas.
H. J. Peterson Company, Omaha, Nebraska.
Frank Parrott, Dallas, Texas.
H. J. Taylor Construction Co., Salinas Kansas.
City Engineers estimate of cost for the above named work was
read.
Commissioner Morey moved that the bid of H. J. Taylor Con-
struction Company; Frank Parrott and Brown Bros.., the three lowest
bidders, be retained for further consideration until November 18th,
1931 at 3:00 P. M. and that certified checks be returned by the City
Clerk to the other bidders. Motion adopted.
Application No. 47 for a sign on front of building located at
117 South Santa Fe Avenue was received, and on motion of Commissioner
Benfield same was rejected by the Board of Commissioners.
On motion of Commissioner Morey the Board of Commissioners
adjourned until Wednesdays November 18th, 1931 at 3:00 P. M.
