ORDINANCE NUMBER 21-11084 AN ORDINANCE AMENDING THE SALINA CODE BY ADDING A SECTION TO BE NUMBERED 7-56.1 PERTAINING TO THE REQUIREMENT THAT THE OWNER OR OPERATOR OF A HORSE-DRAWN VEHICLE SHALL EQUIP ANY HORSE OR MULE USED TO POWER A HORSE-DRAWN VEHICLE WITH A FECES-CAPTURING, DIAPERING APPARATUS WHILE OPERATING THE HORSE-DRAWN VEIDCLE ON PUBLIC RIGHT-OF- W AY AND THE REQUIRED MANNER OF DISPOSING OF CAPTURED FECES. BE IT ORDAINED by the Governing Body of Salina, Kansas: Section 1. Amendment. The Salina Code is amended by adding a section to be numbered 7-56.1 , which section reads as follows: Sec. 7-56.1. Capture of feces in the operation of a horse-drawn vehicle on public right-of-way. In addition to the requirements of Sec. 7-56, the owner or operator of a horse-drawn vehicle shall be required to equip any horse or mule used to power, in whole or in part, a horse-drawn vehicle with an effective feces-capturing, diapering apparatus while operating the horse-drawn vehicle on any public right-of-way. The owner or operator of the horse-drawn vehicle shall be required to frequently remove the captured feces from the diapering apparatus, treat it with odor reducing chemicals, seal it in an airtight bag, and discard the sealed bag only in either (a) a solid waste container owned by the owner or operator, or (b) a privately-owned solid waste container, with the express written permission of the private owner. For purposes of this section, horse-drawn vehicle means a wagon, coach, carriage, or other vehicle that is powered in whole or in part by one or more horses or mules and is used to carry passengers for hire. Section 2. Effective. This ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper by the following summary: Ordinance No. 21-11084 Summary On October 11, 2021, the City Commission passed Ordinance No. 21-11084. The Ordinance amends the Salina Code by adding Sec.7-56.1 pertaining to the requirement that the owner or operator of a horse-drawn vehicle shall equip any horse or mule used to power a horse-drawn vehicle with a feces- capturing, diapering apparatus while operating the horse-drawn vehicle on any public right-of-way and the required manner of disposing of captured feces.
