"' "' z Cl. w "' -~ «i en i :!2 g c 0 u CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS September 20, 2021 4:00p.m. The City Commission convened at 3:00 p.m. in Room 107, City-County Building, for a continuation of last week's study session which consisted of a Parks and Recreation presentation on ballfields and bathrooms. Mayor Hodges asked the Clerk for verification that notice had been sent for today's City Commission meeting. The Clerk replied yes . The Regular Meeting of the Board of Commissioners was called to order at 4:00 p.m. in Room 107, City-County Building. A roll call was taken. Mayor Hodges called to mind the 145 citizens of Salina who have lost their lives to Covid-19 which was followed by the Pledge of Allegiance and a moment of silence. Those present and comprising a quorum: Mayor Melissa Rose Hodges (presiding), Trent W. Davis, M.D., Michael L. Hoppock, Aaron Peck and Karl Ryan. Also present: Mike Schrage, City Manager, Jacob Wood, Deputy City Manager; Greg Bengtson, City Attorney; and JoVonna A. Rutherford, City Clerk. AWARDS AND PROCLAMATIONS (3.1) Recognition of the week of September 17, 2021, to September 23, 2021, as Constitution week in the city of Salina. Melissa Stuchlik read the proclamation and announced related activities . (3.2) Recognition of Rod Franz for his contributions to the city of Salina. Mayor Hodges read the proclamation and presented a copy of the same to Mr. Franz, together with a plaque and key to the city in recognition of his service. Rod Franz shared his thoughts and appreciation for the support he has received. CITIZENS FORUM Deborah Corrales, Salina, Kansas, provided information on animal breed bans and stated it should be a priority to repeal the city of Salina's breed ban. Norman Mannel, Salina, Kansas, share his thoughts on the water shortage in the United States. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None. CONSENT AGENDA (6.1) (6.2) Approve the minutes of September 13, 2021. Authorize the purchase and installation of four HV AC units for the Great Plains Manufacturing Convention Hall at the Tony's Pizza Event Center and the installation of the necessary HV AC controls to make operation of the system efficient and manageable. (6.4) Consider acceptance of a permanent trail easement for the Markley Road Trail project. Moved by Commissioner Davis, seconded by Commissioner Ryan, to approve the consent agenda as presented. Aye: (5). Nay (0). Motion carried. ADMINISTRATION (7 .1) Second reading, Ordinance No . 21-11077, prohibiting public camping. Mayor Hodges stated Ordinance No. 21-11077 was first passed on September 13, 2021 , and there have been no comments received since that time. Karen Shade, Salina, Kansas, shared her thoughts on the ordinance and stated she was in agreement with the ordinance but felt there could be some unintended consequences as it is moved forward. Ms. Shade also shared that she had spoken to Chief Nelson prior to the meeting and it was her understanding Ashby House had not been part of the meeting that discussed the issue. Chief Brad Nelson, Salina Police Department, confirmed Ashby House was not part of meeting; however, he had since visited personally with the executive director of Ashby House and there were no concerns with the ordinance. Mike Schrage, City Manager, clarified that providers were simply being identified as a source of assistance and no requirements or policy changes were expected from any providers. Bill Longbine, Salina, Kansas, declared the ordinance should move forward . Moved by Commissioner Hoppock, seconded by Commissioner Peck, to approve Ordinance No. 21-11077 on second reading. A roll call vote was taken. Aye: (5). Nay (0). Motion carried. (7.2) Second reading, Ordinance No. 21-11028, changing the zoning district classification from A-1 to R-1 on a 9.82 acre tract of land located on the north side of Cedar Ridge Drive between the Grand Prairie Addition and the Briargate Addition south of the Salina Municipal Golf Course. Mayor Hodges stated Ordinance No. 21-11028 was first passed on February 24, 2020, and there have been no comments received since that time. Dean Andrew, Director of Planning, acknowledged a typographical error in the blue sheet, stated it should read "Cedar Ridge" not "Cedar Point" and confirmed it was correct in the ordinance. 21-0290 Moved by Commissioner Hoppock, seconded by Commissioner Ryan, to approve Ordinance No. 21-11028 on second reading. "' "' z ll. w C1I .s n; CJ) ~ :!2 0 "' c: 0 u DEVELOPMENT BUSINESS (8.1) Consider the acceptance of the offered right-of-way, easement and restricted access dedications from Cedar Ridge Development, LLC to serve the proposed Cedar Point Addition a 22 lot subdivision of a 9.82 acre tract of land located on the north side of Cedar Ridge Drive between the Grand Prairie Addition and the Briargate Addition. Dean Andrew, Director of Planning, explained the request, fiscal impact and action options. A discussion followed related to the storm water detention pond the fees associated therewith. Stephanie Cool, Salina, Kansas, Cedar Ridge Development, thanked the Governing Body for the opportunity provided. 21-0291 Moved by Commissioner Ryan, seconded by Commissioner Davis, to accept the offered right-of- way, easement and restricted access dedications and to authorize the Mayor to sign the plat on behalf of the City. Aye: (5). Nay (0). Motion carried. (8.2) Consider acceptance of the offered public utility easement dedication on the Elliott Electric property at 700 York Street. Dean Andrew, Director of Planning, explained the request, fiscal impact and action options . 21-0292 Moved by Commissioner Hoppock, seconded by Commissioner Peck, to accept the offered public ~ utility easement and authorize the Mayor to sign the easement dedication on behalf of the City. (8 .3a) Ordinance No. 21-11079 -Consider an amendment to the South 9th Street Corridor Plan portion of the Salina Comprehensive Plan and the boundaries of the Service Commercial portion of the CO District. (8 .3b) Ordinance No. 21-11080 -Consider an application filed by F&W Tractor Co., Inc. dba Agri-Center requesting the annexation of a 24 acre tract of land located on the west side of South 9th Street south of Water Well Road. Dean Andrew, Director of Planning, advised that Agri-Center had formally withdrawn all applications for this project and there was no further action required on Item 8.3 . OTHER BUSINESS None.
