Regular meeting of the Board of Cornnissioners, December
13th, 1926. Meeting was called to order by 11ayor Helvering,
the roll was called and Commissioners Helvering, Campbell and
Dodds and City A ttorney Norris responded.
The minutes of the Regular Meeting of llecember 6th, 19261
were read and approved as read.
The following resolution was introduced for second read-
ing:
BE IT RE'SO-TWED by the Board of Commissioners of the City
of Salina , Kansas:
,[HEER.r AS , on the 29th day of November 1926, a petition wa s
filed in the office of the City Clerk setting forth that that
portion of Santa Fe Avenue in said City between the south side
of "alnut Street and the north side of 1-ilulberry Street should
be specially illuminated and that an additional system of lights
is necessary for that purpose, and that such illumination
thereof will be conducive to the public convenience and welfare,
and parying the governing body of said City to specially il-
luminate that portion of said street above mentioned. and to
construct, install, equip and maintain an additional system of
street lights for that purpose, which petition purported to be
signed b,%T the resident owners of not less than one-half of the
fe=t oti^rued b,7 residents and fronting of abutting upon that
portion of said street described in said petition; and,
'll -I LEAS, at the meeting of the Board of Commissioners on
November 29th, 19263, they fixed Monday, December 6th, 1926 at
5:00 o'clock P. Pd. at the meeting room of the Board of Commis-
sioners in the City Hall of said City as a time and place for
the hearing of said petition, and dir-eted the City Clerk to
gove notice thereof in the official city paper at least five
days before the date fixed for such hearing; and
ih aREAS, the City Clerk has given due notice of the time
and place fired for such hearing by publication in the Salina
Journal the official City paper, and has presented such notice
together with Proof of Publication thereof to the Board of Com-
missioners and the asme has been found to be sufficient and to
have been duly given; and
V,iI- , 11 at the time and place fixed by said notice, after
hearing all persons in favor of or opposed to the granting of
the prayer of said petition and all other evidence submitted
for the purpose of ascertaining whether such petition is signed
by the proper number of persons possessing the qualificaitions
prescribed by law, said Board of Commissioners found that said
petition is signed by the resident owners of not less than
one-half of the feet owned by residents and fronting or abutting
on that portion of Santa Fe Avenue above described and that
the allegations of said petition are true and that it is advisa-
ble to so illuminate said portion of said street and that the
cost thereof will not be too burdensome on the persons to be
directly benefited;

stalltion, equipment and maintenance of an additional system of

the manner provided by lata; that the Board of Commissioners be

exceed 25� per front foot, such cost to be paid by special
assessments against the property abutting on such street, in

On motion of Commissioner Dodds the resolution was adopted
as read, and on its final adoption the roll was called and the
following vote was had; Ayes: Helvering, Campbell and Dodds

An ordinance was introduced for first reading entitled:
"An ordinance relating to ^nd a pportioning and levying special
assessments on certain lots and pieces of ground in the City of
Salina, Kansas, to pay the cost of building and constructing a
lateral storm sewer in lateral storm sewer district Number 4 in
said City, and relating to and providing for the collection
and payment of such assessments."
On motion of Commissioner Dodds same s.,,,as referred to the
Board of Commissioners.
On motion of Commissioner Campbell, Board of Commissioners
adjourned until Tuesday, December 14th, 1926 at 11:00 otclock

ten annual: installments, for which internal Improvement Bonds
shall be issued in the manner provided by law; that the Cittr
Engineer shall on or before the 20th day of December 1926,
submit to the Board of Commissioners, under oath, a detailed
estimate of the cost of constructing, insto Hing and equipping
such additional system of lights and detailed plans and specifi-
cations therefor, and that the City Clerk shall thereafter
advertise in the official city paper for at least three conse-
cutive days for sealed proposals for the construction, insta llinG
and equipping of such system of lights according to such plans
and specifications, such proposals to be received at the time
and place hereafter to be fixed by the Board of Commissioners,
at which time the Board of Commissioners shall let such work
by contract to the lowest responsible bidder whose bid shall not
exceed such estimate, but with the right reserved to reject
any and all such proposals; that alter such contract shall have
been awarded and the cost of such work determined the Board of
Commissioners shall issue Internal Improvement Bonds payable
in ten equal installments of equal amounts each year bearing
interest at not to exceed 5 0 per annum, which shall not be issued
in an amount in excess of the contract price of such work except
that the installment coupons shall include the interest on such
installments to the maturity thereof and shall be in such denom-
inations as the Board of Commissioners shall deem proper and
such cost shall be assessed against the lots or pieces of land
on that portion of said street above described according to
the front foot thereof and such special assessments shall be lev-
ied by the City and certified by the City Clerk to the County
Clerk to be placed on the tax rolls for collection, subject to
the same penalties and collected in like manner as other taxes,
which assessments shall be collected in ten approximately equal
annual installments, but incomputing the amount of such special
assessments on each lot liable- therefor interest shall be added
therefor at the rate of 5' per annum from the date of the issuance
of said bonds until the maturity of the installments of the bonds
next thereafter maturing; that the cost of operating and main-
taining such additional system of lights and of illuminating
such street shall be paid by the City at large as provided by
law and the Board of Commissioners shall contract with some
private individual or corporation for the opera tion and mainte-
nance of such lithing system for a period of not to exceed ten
years.
