Meeting was called to order by acting Mayor dampbell, the roll was called and Commissioners Campbell and Dodds and City Attorney Norris responded. Commissioner Helvering absent. The Minutes of the Regular Meeting of June 21st, 1926 were read and approved as read. City Engineer submitted Estimate Number 19 for paving work included in contract dated June 23rd, 1926. On motion of Commissioner Dodds same was approved by the Board of Commissioners. An ordinance was introduced entitled: "An ordinance making an appropriation for the payment of a certain claim." On motion of Commissioner Dodds the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Campbell and Dodds. (2) Nays: (0) Commissi oner Helvering absent. The Mayor approved the same and is numbered 3260: The following resolution was introduced for second reading: BE IT RESOLVED by the Board of Commissioners of the City of Salina J. Kansas: WHEREAS, on the 14th . day of June 1926 petitions were filed in the office of the City Clerk setting forth that portions of the following streets in said City described as follows, to -wit: Santa Fe Avenue from south line of Mulberry to north line of Claflin Avenue. Iron Avenue from west line of Ninth Street to east line of College Avenue. Seventh Street from north line of Ash Street to south line of Elm Street. Ash Street from west line of Santa Fe Xvenue to west line of lwelfth3treet. Twelfth Street from north line of Ash Street to south line of Bishop 6treet, shduld be specially illuminated and that additional systems of lights are necessary for that purpose and that such illumination thereof will be conducive to the public convenience and welfare, and praying the governing body of said City to specially illumin- ate such portions of said streets above mentioned and to con- struct, install, equip and maintain additional systems of street lights for such purposes, which petitions purported to be signed by the resident owners of not less than one-half of the feet owned by residents and fronting or abutting upon such portion of said streets described in said petitions and WHEREAS, at the meeting of the Board of Commissioners on June 14th, 1926 they fixed Monday, June 21st, 1926 at 5:00 P. M. at the meeting room of the Board of Commissioners in the City Hall of said City as a time and place for the hearing of said petitions, and directed the City Clerk to give notice thereof in the official City paper at least five days before the date fixed for such hearings,, and WHEREAS, the City Clerk has given due notice of the time and place fixed for such hearings by publication in the Salina Journal, the official city paper, and has presented such notice together with Proof of Publication thereof to the Board of Commissioners and the same has been found to be sufficient and to have been duly given; and 1 1 WHERE S, at the time and place fixed by said notice, after hearing all persons in favor of or opposed to the granting of the prayers of said petitions, and all other evidence submitted for the purpose of ascertaining whether such petitions are signed by the proper number of persons possessing the qualifications presrcibed by law, said Board of Commissioners Pound that said petitions are signed by the resident owners of not less than one-half of the feet owned by residents and fronting or abutting on that portion each of said streets, within the limits and above described, and that the allegations of said petitions are true and that it is advisable to s oilluminate said portions of said streets and that the cost thereof will not be too burdensome on the persons to be directly benefited; NOVI `!'HEREFuRE, BE IT RESOLVED that the construction, installation, equipment and maintenance of additional systems of lights on said portions of said streets as in said petitions and hereinabove described is necessary, and that such additional systems of lights to con- sist of what is commomly known as White lWay Systems, consisting of single lights on poles at intervals of approximately 200 feet, more or less, on either side of said streets within the limits above mentioned, be constructed, installed, equipped and maintained in the manner provided by law; that the Board of Commissioners be and they are hereby authorized to contract therefor, at a cost to the property abutting or fronting on such street of not to exceed 21¢ per foot, such cost to be paid by special assessments against the property abutting on each such street, in ten annual install- ments, for whelh Internal Imrpvement Bonds shall be issued in the manner provided by law; that the City Engineer 'shall on or before the 6th day of July, 1926, submit to the Board of Commissioners, under oath, detailed estimates of the cost of constructing, install- ing and equipping such additional systems of lights and detailed plans and specifications therefor, and that the City Clerk shall thereafter advertise in the official City paper for at least three consecutive days for sealed proposals for the construction, install- ing and equipping of such systems of lights according to such plans and specifications, such proposals to be received at the time and place hereafter to be fixed by the Board of Commissioners, at which time the Board of Commissioners shall let such work by contract to the lowest responsible bidder, or bidders whose bid shall not exceed such estimate, but with the right reserved to reject any and all such proposals; that after such contract or contracts shall have been awarded and the cost of such work determined the Board of Com- missioners ahall issue Internal Improvement Bonds payable in ten equal installments of equal amount each year bearing interest at not to exceed 5 per cent per annum, which shall not be issued in an amount in excess of the contract proces of such work, except that the installment coupons shall include the interest on such install- ments to the maturity thereof and shall be in such deonominations at the Board of Commissioners shall deem proper and such cost shall be assessed against the lots or pieces of land on that portion of said street above described according to the front foot thereof and such special assessment shall be levied by the City and certified by the City Clerk to the County Clerk to be placed on the tax rolls for collection, subject to the same penalties and collected in like manner as other taxes, which assessments shall be collected in ten approximately equal annual installments but in computing the amount of such special assessments on each lot liable therefor interest shall 'be added therefor at the rate of 5 per cent per annum from the date of the issuance of said bonds intil the maturity of the installment of bonds next thereafter maturing; that the cost of operating and maintaining such additional systems of lights and of illuninating such streets shall be paid by the City at large as provided by law and the Board of Commissioners shall contract with some private individual or corporation for the operation and maintenance of such lighting systems for a period not to exceed ten years. An ordinance was introduced for first reading entitled: "An ordinance specifying and selecting the material and letting contract for the construction of a storm sewer in Storm Sewer Dis- trict Number 2." On motion of Commissioner Dodds the ordinance was referred to the Board of Commissioners. On motion of Commissioner Campbell, City was authorized to draw $5450.00 from the Firemens Relief Fund for payment due to The Seagrave Corporation on aerial truck and issue warrant to Treasurer of Firemens Relief Fund for such amount bearing inter- est at the rate of 4% per annum due on or before two years from date, to be repaid out of Fire Department Fund.
