JUNE 21st, 1926.
Regular meeting of the Board of Commissioners'. June 21st,
1926. Meeting was called to order by Mayor Helvering the roll
was called and Commissioners Helvering, Campbell and odds and
City A ttorney Norris responded.
The minutes of the Regular Meeting of June 14th, 1926 were
read and approved as read.
An ordinance was introduced entitled: "An ordinance making
appropriations for miscellaneous purposes."
On motion of Commissioner Campbell the ordinance was read and
adopted by sections and on its final adoption the roll was called
and the following vote was had; Ayes: Helvering. Campbell and
Dodds (3) Nays: (0) The Mayor approved the same and is numbered
3256.
An ordinance was introduced for second reading entitled.-
"An
ntitled:"An ordinance specifying and selecting the material End letting
a contract for the curbing, guttering, excavating, grading and
graveling with sand clay Ash Street from the west line of the
right-of-way of the Missouri Pacific Railway Company to the east
line of Olive Street; for the curbing, excavating, grading and
graveling with sand clay College Avenue from .the south line of
South Street to the north line of Morrison Avenue; for the curbing,
excavating, grading and graveling with sand .clay Ellsworth Avenue
from the east line of Santa Fe Avenue to the west line of
Osborne Street; for the excavating, grading and paving Baker Street
from the south line of South Street to the north line of Morrison
"venue; and for the excavating, grading, and surfacing with sand
clay Third Street from the south line of Iron Avepue to the
Smoky Hill River all in the City of Salina, Kansas.
On motion of Commissioner Dodds the ordinance was read and
adopted by sections and on its final adoption the roll was called
and the following vote was had; Ayes: Helvering, Campbell and
Dodds. (3) Nays: (0) The Mayor approved the same and is num-
bered 3257.
City Engineer submitted final estimates for paving work
constructed under contracts dated April 5th, 1926.
On motion of Commissioner Dodds same were adopted and approved
by the Board of Commissioners.
An ordinance was introduced entitled: "An ordinance making
an appropriation for the payment of certain claims."
On motion of Commissioner Campbell the ordinance was read
and adopted by sections and on its final adoption the roll was
called and the followsn� vote was had; Ayes: Helvering, Campbell

(0) Whe Mayor approved the same and is
numbered 3258.
An ordinance was introduced for second reading entitled:
'An ordinance providiN for the construction of certain sidewalks
in the City of Salina.
On motion of Commissioner Dodds the ordinance was read and
adopted by sections and on its final adoption the roll was called
and the following vote was had; Ayes: Helvering, Campbell and
Dodds (3) Nays: (0) The Mayor approved the same and is num-
bered 3259. -
The following resolution was introduced for second reading:

BE IT RESOLVED that the construction, installation, equip-
ment and maintenance of an additional system cf lights on Iron Aven-
ue in the City of Salina, Kansas between the limits above mentioned
Is necessary and that such additional system of lighting, to
consist of what is commonly known as a White flay System, consist-
ing of single lights on poles at intervals of approximately 200
feet, more or less, on either side of said street within such lim-
its be constructed, installed, equipped and maintained in the
manner provided by law; that the Board of Commissioners be and
they are hereby authorized to contract therefor at a cost to the
property abutting on fronting on such street of not to exceed 21�
per front foot, such street, in ten annual installments, for
which Internal Improvement Bonds shall be issued in the manner
provided by law; that the City Engineer shall on or before the
6th day of July 1926, submit to the Board of Commissioners under
oath, a detailed estimate of the cost of constructing, installing
and equipping such additional system of lights and detailed plans
and specifications therefor., and that the City Clerk shall there-
after advertise in the official City paper for at least three
consecutive days for sealed proposals for the constructiorr, install-
ing and equipping of such system of lights according to such plans
and specifications., such proposals to be received at the time and
place hereafter to be fixed by the Board of Commissioners, at which
time the Board of Commissioners shall let such work by contract to
the lowest responsible bidder whose bid shall not exceed such
estimate, but with the right reserved to reject any and all such
proposals; that after such contract shall have been awarded and
the cost of such work determined the Board of Commissioners shall
issue Internal Improvement Bonds payable in ten equal installments
of equal amounts each year bearing interest at not to exceed 5%
per annum, which shall not be issued in an amount in excess of the
contract price of such work except that the installment coupons shall
include the interest on such installments to the maturity thereof
and shall be in such denominations as the Board of Commissioners
shall deem proper and such cost shall be assessed against the lots
or pieces of land on that portion of said street above described
according to the front foot thereof and such special assessment
shall be levied by the City and certified by the City Clerk to the
County Clerk to be placed on the tax rolls for collection, subject
to the same penalties and collected in like manner as other taxes,
which assessments shall be collected in like manner as other
taxes, which assessments shall be collected in ten approxina tely
equal annual installments, but in computing the amount of such
special assessments on each lot liable therefor interest shall
be added therefor at the rate of 5% per annum from the date of
the issuance of said bonds intil the maturity of the installments
of the bonds next thereafter maturing; that the cost of operating
and maintaining such additional system of lights and of illumin-
ating such street shall be paid by the City at large as provided
by law and the Board of Commissioners shall contract with some
proviate individual or corporation for the operation and main-
tenance of such lighting system for a period of not to exceed
ten years.

Pursuant to the action of the Board of Commissioners taken
at their meeting on June 14th, 19269 the City Clerk produced the
notice published by him in the Salina Journal for five connective
days commencing Tuesday June 15th, 1926 at 5 P. M. at the Commis-
sionerts meeting rooms in the City Hall, was the time and place
fixed by the Board of Commissioners for the hearing of the pets-
tions filed with the City Clerk on June 14th, 1926 praying the
governing body of the City of Salina to especially illuminate the
following portions of the following streets, to -wit:

Santa Fe Avenue from south line of Mulberry to north line
of C laf lin Ave nue ;
Iron Avenue from west line of Ninth Street to east line
of Col eg�"�venue;
Seventh Street from north line of Ash Street to south line
of Elm treet;
Ash Street from west line of Santa Fe Avenue to west line of
Twelfth Street;
Twelfth Street from north line of Ash Street to south line
of Bishop 6treet.
The Board of Commissioners having examined said notice and
the proof of publication thereof to ascertian and determine
*hether such notice has been given for the time and place fixed
for the hearing of said petitions as required by law, finds and
determines that such notice has been duly given by publication
in the official city paper for the time required by law and that
such notice is sufficient, thereupon upon motion of Commissioner
Campbell duly seconded and carried the City Clerk was ordered and
directed to enter such finding and declaration upon the record of
the minutes of this meeting. Thereupon all persons in favor
of or opposed to the granting of the prayers of said petitions
were duly heard and all other evidence submitted to the Board of
Commissioners relating to said petitions and to the sufficiency
thereof was duly heard and considered by the Commissioners and upon
such hearing it was found by the Board of Commissioners that such
petitions are in conformity to all of the requirements of law
relating to such petition, and that the allegations thereof are
truw, that such petitions are signed by the proper number of per-
sons possessing the qualifications prescribed by law, being signed
by the resident owners of not less than one-half of the feet owned
by residents and fronting or abutting upon such portions of said
streets described in said petitions, that it is advisable to so
illuminate said portions of said streets above mentioned, and that
the cost thereof will not be too burdensome upon the persons to be
directly benefited, and thereupon the following resolution was
presented for eonsiderationand adoption:
BE IT RESOLVED by the Board of Commissioners of the
City of Salina, Kansas:
WHL EAS, on the 14th day of June 1926 petitions were filed
in the office of the City Clerk setting forth that portions of
the following streets in said city deveribed as follows, to -wit:
Santa Fe Avenue from south line of Mulberry to north line
of Claf lin Avenue.
Iron Avenue from west line of Ninth Street to east line of
College7venue.
Seventh Street from north line of Ash Street to south line of
Elm Street.
`ash Street from west line of /santa Fe Avenue to west line
of Twelfthgreet;
'Twelfth street from north line of Ash Street to south 1 the of
Bishop treeto
should be specially illuminated and that additional systems of
lights are necessary for that purpose and that such illumination
thereof will be conducive to the public convenience and welfare,
and praying the governing body of said city to specially illumin-
ate such portions of said streets above mentioned and to construct,
install, equip and maintain additional systems of street lifhts for
such purposes, which petitions purported to be signed by the resi-
dent owners or not less than one-half of the feet owned by residents
and fronting or abutting upon such portion of said streets described
in said petitions and,

WHEREAS, at the meeting of the Board of Commissioners on
June 14th, 1926 they fixed Monday.. June 21st, 1926 at 5:00 P. M.
at the meeting room of the Board of -Commissioners in the City
Hall of said City as a time and place for the hearing of said
petitions, and directed the City Clerk to give notice thereof
in the official city paper at least five days before the date
fixed ,for such hearings, and
WHEREAS., the City Clerk has given -due notice of the time
and place fixed for such hearings by publication in the Salina
Journal, the official city paper, and has presented such notice
together with Proof of Publication thereof to the Board of Com-
missioners and the same has been found to be usfficient and to
have been duly given$ and
WHEREAS, at the time and place fixed by said notice, after
hearing all persons in favor of or opposed to the granting of
the prayers of said petitions and all other evidence submitted
for the purpose of ascertaining whther such petitions are signed
by the proper number of persons possessing the qualific ations
prescribed by law, said Board of Commissioners found that said
petitions are signed by the resident owners of not less than
onephalf of the feet owned by residents and fronting or abutting
on that portion of said streets, within the limits anad above
described, and that the allegations of said petitions are true
and that it is advisable to so illuminate said portions of said
streets and that the cost thereof will not be too burdensome on
the persons to be directly benefited, NOW THEREFORE,
BE IT RESOLVED bhat the construction, installation, equip-
ment and maintenance of additional systems of lights on said
portions of said streets as in said petitions and herinabove
describef is necessary, and that such additional systems of
lights to consist of what is commonly known as White May Systems,
consisting of single lights on poles at intervals of approxi-
mately 200 feet, more or less, on either side of said streets
within tge limits above mentioned, be constructed, installed,
equipped and maintained in the manner provided by law; that the
Board of Commissioners be and they are hereby authorized to
contract therefore, a t a cost to the property abutting or front-
ing on such street of not to exceed 21� per front foot, sueh
cost to be paid by special assessments against the property abutting
on each such street, in ten annual installments, for which Inter-
nal Improvement Bonds shall be issued in the manner provided by law;
that the City Engineer shall on or before the 6th day of July,
1926, submit to the Board of Commissioners, under oath, detailed
estimates of the cost of constructing, installing and equipping
such additional systems of lights and detailed plans and speci-
fications therefor, and that the City Clerk shall thereafter ad-
vertise in the official city paper for at least three consecu-
tive days for sealed proposals for the construction, installing
and equipping of such systems of lights according to such plans
and specifications, such proposals #6 be received at the time
and place hereafter to be fixed by the Board of Commissioners,
at which time the Board of Commissioners shall let such work by
contract to the lowest responsible bidder or bidders whose bid
shall not exceed such estimate, but with the right reserved to

contracts shall have been awarded and the cost of such work
determined the Board of Commissioners shall issue Internal Im-

On motion 'of Coamiissioner Dodds the foregoing resolution
was referred to' the Board of Gonnissioners.
A petition was received asking for the installation of
an are light at the corner of Thirteenth and State Streets.
City 1,%nager reported favorable on the installation of an
incandescent light at the above location, and on motion report
was adopted by the Board of Commissioners.
Mayor Helvering appointed yd. S. Frey, C. J. Peck and Alex
Berg as appraisers to ascertain the valuation of certain lots
and pieces of ground on which to base the cost of construct-
ing a sewer on Ash Street from Missouri Pacific Right-of-lVay
to Olive Street.
On motion of Commissioner Campbell, appointments were con-
firmed by the Board of Commissioners.
On motion, Mayor Helvering was instructed to sign contract
between City of Salina and James R. Ackerman for automobile
races to be held in Kenwood Park, July 5th, 1926.
The Board of Commissioners decided to have a semi-annual
audit of the Water Works Accounts, and the City Manager was
instructed to procure prices for the same.
Sewer connection was ordered at the north-west corner of
Columbia. Avenue and Lots eight (8) and Nine (9) in Cunningham's
Replat.
On motion of Commissioner Dodds, Board of Commissioners
adjourned.
