Meeting was called to order by Mayor Helvering, the roll tiaras called and Commissioners Helvering and Dodds and City Attorney Norris responded. Commissioner Campbell absent. The minutes of the Regular 11eeting of June 7th, 1926 were read and approved as read. Bids for the construction of q sewer on Ash Street from Missouri Pacific Railroad Right -of --ray to Olive as advertised for were received from: Snyder & Meilert, Salina, Kansas. L. d . Rexr oad , it It Commissioner Dodds moved that contract be awarded to Snyder & 14eilert as per their bid submitted. Pursuant to the action of the Board of Commissioners taken at their meeting on June 7th, 19269 the City Clerk produced the notice published by him in the Salina Journal for five consecutive days commencing Tuesday June 8th, 1926 notifying all persons interested that Monday July 14th 1926 at 5 LM, at the Conmiissioners meeting rooms in the City Half, was the time and place fixed by the Board of Commissioners for the hearing of the petition filed. with the City Clerk on June 7th, pra-;ing the governing body of the City of Salina to specially illuminate that portion of Iron Avenue between the east line of the Iron Avenue bridge across the Smoky Dill River and the present eastern liihitssof the City of Salina being the center line of Section 18, Township 14, Range 2. The Board of Commissioners having examined said notice and the Proof of Publication thereof to ascertain and determine whether such notice has been given of the time and place fixed for the hearing of said petition as required by lawfinds and determines that such notice hzs been duly given by pubfication in the official City paper for the time required by law and that such notice is sufficient; thereupon, upon motion of Commissioner Dodds, duly seconded and carried the City Clerk was ord_red and directed to enter such finding anJ declaration upon the record of the minutes of this meeting. TEereupon allpersons present in favor of or opposed to the granting of the prayer of said. petition were dully heard and all other evidence submitted to the Board of Commissioners relating to said petition and to the sufficien- cy thereof was duly heard and considerbd by the Commissioners and upon such hearing it was found by the Board of Commissioners that such petition is in conformity to all of the requirements of relating to such petitions, and that the allegations thereof are true, that such petition is signed by the proper number of persons possessing the qualifications prescribed by law, being signed by the resident own- ers of not less than one-half of the feet owned, by residents and fronting or abutting upon that portion of Iron Avenue described in said petition that it is advisable to so illuminate said portion of said street above mentioned and that the cost thereof will not be too burdensome upon the persons to be directly benefited, and there- upon the following resolution was presented for consideration and adoption: BE IT RESOLVED by the Board of Commissioners of the City of Salina-, Kansas: WHEREAS on the 7th day of June 1926 a petition was filed in the office of the City Clerk setting forth that that portion of Iron Avenue ins aid City between the east side of the Iron Avenue bridge across the Smoky Hill River and the eastern city limits of the City of Salina, being the center line of Section 18, Township 14, Range 2, should be specially illuminated and that an additional system of lights is necessary for that purpose, and that such illumination thereof will be conducive to the public convenience and welfare, and praying the governing body of said city to spec- ially illuminate that portion of said street above mentioned and to construct, install, equip and maintain an additional system of street lights for that purpose, which petition purported to be signed by the reisident owners of not less than one-half of the feet owned by residents and fronting or abutting upon that portion of said street described in said petition; and eVH�,REAS, at the meeting of the Board of Commissioners on June 7th, 1926 they fixed Monday, July 14th at 5:00 o'clock P. M. at the meeting room of the Board of Commissioners in the City Hall of said City as a time and place for the hearing of said petition, and directed the City Clerk to give notice thereof in the official city paper at least five days before the date fixed for such hearing; and �"�iEREAS, the City Clerk has given due notice of the time and place fixed for such hearing by publication in the Salina Journal the official City paper, and has presented such notice together with Proof of Publication thereof to the Board of Com- missioners and the same has been found to be sufficient and to have been duly given; and ,; 1.1 SAS, at the time and place fixed by said notice, after hearing all persons in favor of or opposed to the. granting of the prayer of said petition and all other evidence submitted for the purpose of ascertaining whether such petition is signed by the proper number of persons possessing the qualifications prescribed by law, said Board of Commissioners found that said petition is signed by the reisidents and fronting or abutting on that portion of Iron Avenue above described and that the allegations of said petition are true and that it is advisable to so illuminate said portion of said street and that the cost thereof will not be too burdensome on the persons to be directly benefited; NOW THEREF0R W 9 BE IT RESOLVED, that the construction, installation, equip- ment and maintenance of an additional system of lights on Iron t,'venue in the City of Salina, Kansas between the limits above metntioned is necessary and that such additional system of lighting to consist of what is commonly known as a ,'bite flay Syste„ con- sisting.of single lights on poles at intervals of approximately 200 feet, more or less, on either side of said street within such limits be constructed, installed, equipped and maintained, in the manner provided by law; that the Board of Commissioners be and they are hereby authorized to contract therefor at a cost to the property abutting or fronting on such street of ,not to exceed 21� per front Foot such cost to be paid by special assessrients against the property abutting on such street, in ten annual installments, for which Internal Improvement Bonds shall be issued in the manner provided by law; that the City Manager shall on or before the 5th day of June 1926, submit to the Board of Commissioners, under oath, a detailed estimate of the cost of constructing, installing and equipping such additional system of lights and deteeiled plans and specifications thereofor, and that the City Clerk shall thereafter advertise in the official City paper for at least three consecu- tive days for sealed proposals for the construction, installing and equipping of such system of lights according to such plans and specifications, such proposals to be received at the time and place hereafter to be fixed by the Board of Commissioners, at which time the Board of Commissioners shall let such work by contract to the lowest responsible bidder whose bid shall not exceed such estimate, but with the right reserved toveject any and all such proposals; that after such contract shall have been awarded and the cost of such work determined the Board of Commissioners shall issue Internal Improvement Bonds payable in ten equal installments of equal amounts each year bearing interest at not to exceed 510 per annum, which shall not be issued in an amount in excess of the contract price of such work except thqt the installment coupons shall include the interest on such installments to the maturity thereof and shall be in such denominations as the Board of Commis- sioners shall deem proper and such cost shall be assessed against the lots and pieces of land on that portion of said street above described according to the front foot thereof and such special assessment shall be 'levied by the City and certified by the City Clerk to the County Clerk to be placed on the tax rolls for col- lection, subject to the same penalties and collected in like manner as other taxes, which assessments shall be collected in ten approximate- ly equal annual installmenl-s, but in computing the amount of such special assessments on each lot liable thereofor interest shall be added therefor at the rate of 5,`_1 rrer annum from the date of the issu- ance of said bonds until the maturity of the installments of the bonds next thereafter maturing; that the cost of operating and maintain -1. ing such additional system of lights and of illuminating such street shall be paid by the City at large as provided by law and the Board. of Commissioners shall contract with some private individual or cor- poration for the operation and maintenance of such lighting system for a period of not to exceed ten years. 19 1 i Introduced for first reading, June 1.4th, 1926. Peti-ti©iid "were, r z•esented setting forth that that portion of: Santa Fe Avenue from the south line of 2.1ulberry Street to the north line of C laf 1 in Avenue; Iron Avenue from the west line of Ninth Street to the east line of College Avenue; Seventh Street from the north line of Ash Street to the south line of Elm-"'atreet; Ash Street from the west line of Santa "�e "'venue to the west line of Twelfth Street; Twelfth Street from the north line of Ash Street to the south line of Bishop Street, should be especially illuminated and that an additional system of lights is necessary for that purpose and that such illumina- tion thereof will be conducive to public convenience and welfare, which petitions purported to be signed by the resident owners of more than half of the feet ovrned by the residents and fronting or abutting upon that portion of Santa Fe "venue; Iron Avenue; Seventh Street; "sh Street and Twelfth Street above described and praying the governing body of the City to especially illuminate such portion of said streets and to construct, install, equip and maintain an additional system of lights for that purpose, the cost of such construction and installation of such system to be taxed against the abutting property by special assessments in manner provided by law and payable in ten annual installments, at an expense to said property of not to exceed 21¢ per front foot, such system to consist of what is known as one light white way poles erected at intervals on either side of such street. On motion.of Commissioned Dodds"-;; duly seconded and carried the Board of Commissioners fixed Monday, June 21st, 1926 at 5:00 P. IT. at the Commissioners meeting room in the city Hall, as the time and place for the hearing of such petitions and directed the City Clerk to give notice thereof in the official City paper at least five days before the date above mentioned. An ordinance was introduced for second reading entitled: "An ordinance providing that certain unplatted tracts of land and certain platted additions or sub -divisions which have been sub -divided into lots and blocks be added to, taken into and made parts of the City of Salina, Kansas; extending the City limits of said City so as to include such added land and repealing all ordinances or parts of ordinances in conflict with the provisions of this ordinance." On motion of Commissioner Dodds the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Helvering and Dodds (2 ) Nays (0) Commissioner Campbell absent. The I.7ayor approved the same and is numbered 3254. 192 An ordinance was introduced for second reading entitled: "An ordinance fixing a license tax on billiard and pool tables, providing for the issuing of licenses and the conditions thereof, and regulating pool and billiard halls, limiting the number thereof, providing penalties for the violation therecE and repeal- ing Ordinance Number 2018." On motion of Commissioner Dodds the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Helvering and Dodds (2) Nays (0) Commissioner Campbell absent. The Ilayor approved the same and is numbered 3255. An ordinance was introduced for first reading entitled: "An ordinance specifying and selecting the material and letting a contract for the curbing, guttering, excavating, grading and graveling with sand clay Ash Street from the west line of the right-of-way of the Missouri Pacific Railway Company to the east line of Olive Street; for the curbing, excavating, grading and graveling with sand clay College Avenue from the south line of South Street to the north line of P: �orrisob'Avenue; for the curb- ing, excavating, grading and graveling with sand clay Ellstiorth Avenue from the east line of Santa Fe Avenue to the west line of asborne Street; for the excavating, grading and paving Baker Street from the south line of South Street to the north line of ror�si n Avenue; for the excavating, grading and surfacing with sand clay Third Street from the south line of Iron Avenue south to the Smoky Hill River, all in the City of Salina, Kansas." On motion of Commissioner Dodds same was referred to the Board of Commissioners. An ordinance was introduced for first reading entitled: "An ordinance providing for the construction of certain sidewalks in the City of Salina, Kansas. On motion of Commissioner Dodds same was referred to the Board of Commissioners. On motion of Commissioner Dodds, Board of Commissioners adjourned. City Clerk.
