4egular meeting of the Board of Commissioners December 11,
1939. Meeting was called to order by Mayor lliorgenstern, the roll
was called and Commissioners luorgenstern, Branson, Breon, Ferm and
Price and City Attorney Norris responded.
The minutes of the Regular Meeting of December 4, 1939 were
read and approved as read.
A petition was presented asking the Board of Commissioners to
make no change in the 14ilk Ordinance precluding the purchase of
cream and milk from anyone, whether such cream and milk is labeled
"Grade D" or otherwise. Ordered filed.
A petition was presented asking the Board of Commissioners to
make no change in the Milk Ordinance precluding the farmers from mak-
ing direct sales of cream to persons in the City of Salina whether
thesame be graded "D" or otherwise. Ordered filed.
Applications for taxicab drivers license for the balance of
1939 received as follows:
Earl Hilterbrand
Earl B. Alldaffer
Elmer Dakin
John Fisher
Commissioner Perm moved that applications be approved and li-
cense granted. Motion adopted.
Commissioner Perm moved that the recommendation of Saline
County Medical Society asking the Board of Commissioners to enact
such amendments to the present Milk Ordinance as may be necessary to
prevent the sale of raw milk from any herd which has not been shown
by proper tests to be free from mastitis, tuberculosis and Bang's
disease, be adopted, and that the present Milk Ordinance be amended.
On the final adoption of the motion the roll was called and the follow.
ing vote was had; Ayes: torgenstern, Branson, Perm and Price (4)
Nays,: Breon (1).
An ordinance was introduced for first reading entitled: "An
ordinance amending Ordinance No. 4709 of the City of Salina relating
to the production of milk and milk products by adding thereto certain
new sections relating to and providing for the inspection and testing
of cows for certain diseases and providing penalties for the violation
of this ordinance." Referred to the Board of Commissioners.
An ordinance was introduced entitled: "An ordinance making
appropriation for the payment of certain claim."
On motion of Commissioner Ferm the ordinance was read and
adopted by sections and on its final adoption the roll was called
and the following vote was had; Ayes: 111orgenstern, Branson, Breon,
Perm and Price (5) Nays: (0) Mayor approved the ordinance and it
is numbered A-53.
An ordinance was introduced for second reandin T entitled: "An
ordinance authorizing and providing for the publication in book form
of the revised and compiled ordinances of the City of Salina, Kansas,
and providing for the authentication and distribution thereof."
On motion of Commissioner Perm the ordinance was read and
adopted by sections and on its final adoption the roll was called and
the following vote was had; Ayes: Morgenstern, Branson, Breon, Perm
and Price (5) Nays: (0) Mayor approved the ordinance and it is num-
berec_ 4959..
Frank 1LSaus and Hildegard Maus, and Claude Sowers their attor-
ney, appeared and made statements to the Board of Corunissioners in sup-
port of their claim against the City of Salina. After hearing the
statements no action was taken by the Board of Commissioners.
The appraisers reports for the. curbing and guttering of:
Beloit Avenue from the east line of Fourth Street to the cen-
ter line of Osborne Street;
Charles Street from the west line of Eleventh Street to the
east line of Twelfth treet;
Eithth Street from the south line of Pacific to the center
line ofWoodland Avenue;
Ellsworth Street from the west line of Pershing Street to the
east line of Funston treet, (excepting the part that is now curbed
and guttered);
Frost Street from the west line of Tenth Street to the east
line of Eleventh Street;
Hancock Street from the south line of Crawford Avenue to the
south line of Illinois Street;
Jewell Avenue from the east line of South Court Place to the
east line of Funston Street on the north side of Jewell, and from
the west line of Pershing Street to the west line of Lot 4, Park-
view Addition on the south side of Jewell Avenue;
Johnstown Avenue from the west line of Columbia Avenue to
the east line of Oa a e Avenue;
Kirwin Street from the west line of Ninth Street to the west
line ofPershing;
Seventh Street from the center line of Harsh Avenue to the
center line of Hamil-E—onAvenue; and
Twelfth Street from the south line of Prescott Avenue to
the north line of Crawford Avenue;
were received, and on motion of Commissioner Price, Tuesday, Decem-
ber 26, 1939 at 4:30 P. M. was designated as a Special Meeting, at
which time the above reports will be acted on by the Board of Com-
missioners, and the City Clerk was instructed to publish notice in
the official City paper as provided by law. Lotion adopted.
On motion of Commissioner Breon the Board of Commissioners
adjourned.
