Regular meeting of the Board of Commissioners October 30, 1939. leeting was called to order by Mayor I'Iorgenstern, the roll was called and Commissioners Morgenstern, Branson, Breon and Ferm and City Attorney Norris responded. Commissioner Price absent. The minutes of the Regular Meeting of October 23, 1939 were read and approved as read. Application for taxicab license for the balance of 1939 re- ceived from: Name of Owner Name of Operator Cab Number H. J. DelVIars Yelloway Cab Company 31 Commissioner Ferm moved that application be approved and license granted, subject to insurance coverage and taxicab inspection. Motion adopted. Pool Hall Application received from A. H. Brockman, October 9, 1939, was again taken up by the Board of Commissioners. Commission- er Branson moved that application be approved and license granted. Motion adopted. City Engineer reported favorable on petitions asking for the curbing and guttering of: Tenth 6treet from Franklin Street south 300 feet; and Oakdale Avenue from Ash Street to Elm Street. Petitions ordered filed. The 1101ausoleum Builders Corporation reported the sale of crypt and presented the deed to purchaser to be executed by the City as follows: Crypt No. 361 to Karl R. King, purchase price $400.00, with check{to City of Salina for X100.00, to be credited as follows: X40.00 or 10% of purchase price on original endowment fund, and X60.00 or 15jo of purchase price to be credited on note of Mausoleum Builders Corporation. Commissioner Branson moved that the deed be approved and that I,Layor be authorized to sign the same and check for ; 100.00 be accepted and credited as above set forth. Motion adopted. An ordinance was introduced for second reading entitled: "An ordinance vacating a certain alley which runs north and south in Block 4, in Replat of 11orrison's Third Addition." On -notion of Commissioner Branson the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: I41orgenstern, Branson, Breon and Ferm (4) Nays: (0) Commissioner Price absent. Mayor approved the ordinance and it is numbered 4957. C. B. Dodge appeared in connection with the claim filed by The Homestead Building and Loan Association, and the Trustees of the seg- regated assets Homestead Building and Loan Association, which was filed with the City Clerk February 10, on account of claimed damages to the north 75 feet of Lots 1 and 2 in Block 6 Elmdale Addition to the City cf Salina, Saline County, Kansas, and John H. Wilson appeared in connection with the claim filed by Earl r'. Long and Berneita M. I=long and the Se- curity Savings and Loan Association on account of claimed damages to the North 35 feet of the South 105 feet of Lots 1 and 2 in Block 6, in Elmdale Addition to the City of Salina, Saline County, Kansas, which properties are claimed by the said claimants to have been damages on account of the construction of the retaining walls along and in front of said properties and on account of other damages as set forth in said claims. Commissioner Fern moved that the City offer to pay to The homestead Building and Loan Association and the Trustees of the segregated assets of said Homestead Building and Loan Association as a compromise of their claim for damages on account of the building of said retaining walls, the sum of 4'700.00, anal that the City offer said Earl F. IvIong, ber-neita 1,11. 1,iong and the Security Savings and Loan Association $350.00 in compromise of their claim for damages on accoun of the buildin,-, of said retaining wall and that all other and further claims be rejected, and that if such offers are accepted, that such sums be paid in full settlement and compromise of the claims ,As above specified without recognizing any legal liability on the part of the City for the payment of any sum on account of such claims. 1-otion carried.
