Regular meeting of the Board of Commissioners October 2, 1939. ., eetin g was called to order by I,iayor Morgenstern, the roll was called and Cormissioners ly'lorcrenstern, Branson, Ferm and Price and City Attorney Norris responded. Commissioner Breon absent. The minutes of the Regular 14eeting of September 25, 1939 were read and approved as read. An ordinance was introduced entitled: "An ordinance making, appropriation for the payment of certain claims." On motion of Com- missioner Perm the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Morgenstern, Branson, Fern and Price (4) Nays: (0) Commis- sioner Breon absent. Mayor approved the ordinance and it is numbered A-44. An ordinance was introduced entitled: "An ordinance making appropriation for the payment of certain claims." Elmer uihn, representini- Bell r2a,:i Company, and Elaine Tltiller, appeared before the Board of Commissionrs and asked for permission to use the first two parking spaces on the south side of Ash Street, west of Santa Fe Avenue, and to discontinue the use of the two spaces west of the alley lying between Santa Pe Avenue and Seventh Street. Commissioner Branson moved that permission be granted. Motion carried. A proposal was received from the iiausoleum Builders Corporation dated September 22, 1939, relating to the settlement of all contro- versies involved in the case filed in the District Court of Saline County, Kansas, entitled 111he Vermont Liarble Company plaintiff, versus the Ilausoleum Builders Corporation, et al defendant No. 15523, includ- ing the settlement of all claims of secured and unsecured creditors of the T.iausoleum Builders Corporation, relating to the mausoleum build- ing in Gypsum Hill Cemetery known as Hillcrest I,"emorial T:':_ausoleum, and providing for the conveyance to the City of Salina of all unsold space in said building and for the sale by the City of Salina of such space and the distribution and application of the proceeds of such sales. On consideration of such proposal it was moved by Commissioner Perm that proposal be approved and accepted by the City of Salina, that the Mayor be authorized to sign acceptance thereof on behalf of the City. The motion vias duly carried and the iv:ayor signed the acceptance of said proposal on behalf of the City of Salina. On motion of Commissioner Branson., duly carried, the Vayor was authorized to sign on behalf of the City the correction deed executed by the Iausoleum Builders Corporation on July 30, 1938, relating to the correction of the deed on conveyance affecting; private rooms "C and "J" in Illillcrest T�Iemorial I:ausoleum. (— City Attorney submitted a written opinion on the light petitions 1 which were presented to the Board of Commissioners at their meeting of September 18, 1939. On motion opinion was ordered filed. An ordinance was introduced for first reading entitled: "An ordinance amending Ordinance No. 3188 by adding; certain territory to the "C" Commercial District as defined in Section 5 of said ordinance." Referred to the Board of Commissioners. i An ordinance was introduced for first reading; entitled: "An ordinance amending Section 4, Section 5 and Section 17, of Ordinance No. 4709 being an ordinance defining and relating to production, grading and sale of milk and milk products, and repealing said original sections.
