Regular meeting of the Board of Commissioners September 11,
1939. Meeting was called to order by Mayor Morgenstern, the roll was
called and Commissioners Morgenstern, Branson, Breon and Ferm and City
Attorney Norris responded. Commissioner Mitchell deceased.
The minutes of the Regular Meeting of September 5, 1939 were
read and approved as read.
L. D. O'Neil made application for permit to construct an
enclosed porch at 610 North Ninth Street to extend closer to street
than established set -back line. No action taken.
City Plumbing Company represented by i•:`_. H. Schindler made
application for permit to erect a galvanized iron pipe shed at 127
South Eighth Street for storage of iron pipe only, to be removed when
applicant removed from the premises. Commissioner Ferm moved appli-
cation be approved. Carried.
Application for taxicab drivers license wasr eceived from
L. D. Taylor. Action deferred.
Pearl W. Hartzell and C. B. Dodge, Jr. his attorney, again
presented to the Board of Commissioners the petition filed with the
City Clerk on September 5, 1939, for change of lot frontage and for
permission to replat Lots 7 to 16 inclusive in Block 2, in Brown's
Addition to be known as "Tenlawns Court", and the quit -claim deed
covering the street to be opened through said lots as re -platted, to
be known as "Tenlawns Court'. Commissioner Branson moved that the
petition be allowed, subject tot he legal requirements of the City
Attorney, with regard to the title, and payment in full of all
taxes on said lots, and on condition that the petitioner install and --
pay for all necessary water and sewer lines to serve said lots as
re -platted, and for curb and gutter and oil mat road on said street,
subject to specifications and approval of the City Engineer, and
that the petitioner Pearl W. Hartzell and his wife convey the land
for such street to the City by Warranty Deed, free of all liens,
encumbrances and taxes, and that no garage or other structure be con-
structed on the lots adjacent to Sherman Street within twenty (20)
feet from the street line, and that the premises adjacent to Sherman
Street be at all times kept and maintained as lawns so as not to
become or present an unsightly frontage on Sherman Street, and subject
to other conditions, all as mentioned in an ordinance relating thereto.
Lotion carried.
An ordinance was introduced for first reading entitled: "An
ordinance authorizing the change of frontage and the refplatting of
Lots 7 to 16 inclusive in Block 2, in Brown's Addition.' Referred to
the Board of Commissioners.
Orville R. Benwell appeared in response to notice in the
matter of revocation of Malt and Uereal Beverage License. On motion
of Commissioner Breon hearing and action was deferred for one week.
Motion adopted.
The Mausoleum Builders Corporation reported sales of crypts and
presented deeds to purchasers to be executed by the City as follows:
Crypt No. 342 to Anna C. Smith, purchase price $400.00, with
check to City of Salina for $100.00 to be credited as follows: $40.00
or 10% of purchase price on original endowment fund, and $60.00 or 150
of purchase price to be credited on note of Mausoleum Builders Corpo-
ration.
Crypts No. 340 and 341 to W. S. Vrey, purchase price of
$800.00, with check to City of Salina for $200.00 to be credited as
follows: $60.00 or 10% of purchase price on original endowment fund
and 9120.00 or 15% of purchase price to be credited on note of Mausoleum
Builders Corporation.
Commissioner Breon moved that the deeds be approved and that the
Mayor be authorized to sign the same and that the checks for $100.00
and $200.00 be accepted and credited as above set forth. Carried.
Application for taxicab license No. 27 from Deluxe Cab Company
as operator and G. E. French, owner, with evidence of insurance
coverage, was presented to the Board of Commissioners. Commissioner
Ferm moved that the application be approved and license issued.
Carried.
An ordinance was introduced for first reading entitled: "An
ordinance relating to and regulating sales by auction of certain kinds
of new and unused merchandise and relating to and regulating the calling,
trade or occupation of conducting auctions of such merchandise, and
providing for and requiring a license for such auction sales and of
those engaged in such calling, trade or occupation providing penalties
for the violation of the provisions of this ordinance and repealing
Ordinance No. 4394 of the City of Salina, and all other ordinances or
parts of ordinances in conflict with this ordinance." Referred to
the Board of Commissioners.
An ordinance was introduced for first reading entitled: "An
ordinance relating to and regulating taxicabs and the conveyance of
passengers for hire in the City of Salina; fixing fares and rates there-
for; providing for the licensing of taxicabs and the drivers thereof
and the use of taximeters; establishing the rules and regulations for
the operation thereof; making provisions for the carrying of liability
insurance; providing penalties for the violation of this ordinance and
repealing Ordinances numbers 2948 passed March 3, 1924; 3306 passed
November 1, 1926; 4625 passed March 23, 1936; 4633 passed April 20, 1936
and 4787 passed October 11, 1937 and all other ordinances or parts of
ordinances in conflict herewith. Referred Referred to the Board of Commission-
ers.
An ordinance was introduced for first reading entitled: "An
ordinance regulating vehicular and pedestrian traffic and the use and
parking of vehicles upon the public streets and elsewhere in the City
of Salina, Kansas, defining certain words and terms used herein, and
repealing; ordinances numbered 2958, 3209, 3474, 4136, 4476, 451804519,
4520, 4695 and 4851 and all other ordinances and sections of ordinances
in conflict herewith and providing penalties for the violation of this
ordinance. Referred to the Board of Commissioners.
An ordinance was introduced for first reading entitled: "An
ordinance designating the name of a certain public street and highway
in Salina, Kansas, as and changing the name of certain portions of
Olive Street and Short Street in said city to Broadway Boulevard."

An ordinance was introduced for first reading entitled: "An
ordinance repealing certain ordinances of the City of Salina, Kansas."

An ordinance was introduced for first reading entitled: "An
ordinance regulating the use of poisonous or explosive gases in the
City ct Salina, Kansas." Referred to the Board of Commissioners.
An ordinance was introduced for first reading entitled: "An
ordinance providing for the levying and paying of a license tax on and
regulating a certain trade, calling or occupation and providing for the
issuance of licenses thereon and providing a penalty for the violation
of this ordinance." Referred to the Board of Commissioners.
An ordinance was introduced for first reading entitled: "An
ordinance amending Section 22 of Ordinance No. 1480, being Section 9-113
of the Revised Ordinances of the City of Salina 1925 relating to the

ordinance regulating the possession, offering for sale, sale, giving
away, and/or use of fireworks, blank cartridges, pistols or other

or corporations engaging in the sale of fireworks or pyrotechnics not
prohibited by the terms of this ordinance and providing penealties
for the violation of the terms hereof; defining certainnuisances and
providing -for terms hereof; defining certain nuisances and providing for

On motion of Commissioner Breon the Board of Commissioners
