"' "' CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS May 3, 2021 4:00p.m. ~ The City Commission convened at 2:30 p.m. for a tour of the exhibits at the Smoky Hill Museum. w i The City Commission convened at 3:34 p.m. for Lower Smoky Hill Water Supply Access District i 4th Quarter Board Meeting at City-County Building, Room 107. :ll ~ Mayor Hodges asked the Clerk for verification that notice had been sent for today's City 8 Commission meeting. The Clerk replied yes . Mayor Hodges thanked the meeting attendees for wearing masks and suggested options for participation if an individual did not want to wear a mask. The Regular Meeting of the Board of Commissioners was called to order at 4 :00 p.m. in Room 107, City-County Building. Roll call was taken followed by the Pledge of Allegiance and a moment of silence. Those present and comprising a quorum: Mayor Melissa Rose Hodges (presiding), Commissioners Trent W. Davis, M.D., Michael L. Hoppock, and Karl Ryan. Also present: Michael Schrage, City Manager; Jacob Wood, Deputy City Manager; Greg Bengtson, City Attorney; and JoVonna A. Rutherford, City Clerk AWARDS AND PROCLAMATIONS The week of May 9th to May 15th , 2021, was proclaimed as "National Police Week" in the city of Salina. Brad Nelson, Chief of Police, read the proclamation and announced associated events. A memorial video was shown. The week of May 2nd through May 8th, was proclaimed as "Salina National Travel and Tourism Week" in the city of Salina. Tiffany Benien, Sports and Events Manager for Visit Salina, read the proclamation and announced associated events. CITIZENS FORUM Norman Mannel, Salina, Kansas, shared a statement George Washington made when they were forming the country. Denise Ward, Salina, Kansas, requested the mask ordinance to end and stated her opinions regarding the mask ordinance. Dalton McDowell, Salina, Kansas, inquired about a segment of road that he had previously spoken to Jacob Wood, Deputy City Manager, about and asked when it would be done right. John Blanchard, Salina, Kansas, stated his opinions on the mask mandate, vaccinations and possible consideration of lifting the mandate. He also mentioned rising taxes and fees and street budgets. In closing, Mr. Blanchard expressed his appreciation to the Salina Police Department. Chad Farber, Salina, Kansas, commented on the continued mask mandate and conveyed his thoughts on the matter. Sandra Welsh, Salina, Kansas, added to what Ms. Woody stated regarding the mandate and provided further opinions regarding the mandate. In closing, Ms. Welsh expressed her appreciation to the Salina Police Department. Karilea Jungel, Salina, Kansas, stated her hope that the City Commission had not considered mandating vaccinations and shared a story about a mother losing her baby after receiving the vaccine. Kevin Korb, Salina, Kansas, spoke via Zoom, indicating he was medically exempt from wearing a mask but could not speak in person at the meeting. He stated the mask mandate would be repealed as a result of a group of citizens who desire to sign a petition in support of ending the mask mandate. Mayor Hodges acknowledged Mr. Korb's comments and again provided options for citizens to provide input and participate in meetings. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None. CONSENT AGENDA (6.1) Approve the minutes of April 26, 2021. Moved by Commissioner Hoppock, seconded by Commissioner Ryan, to approve the consent agenda as presented. Aye: (4) Nay: (0). Motion carried 4-0. ADMINISTRATION (7.1) Street Vacation, Future Land Use and Zoning Items related to Saline County Jail project. (7.la) Second reading, Ordinance No. 21-11054 vacating the platted Woodland Avenue right-of-way east of North Front Street, except the West 200 ft. (7.lb) Second reading, Ordinance No. 21-11060 amending the Future Land Use Map designation of the proposed Saline County Jail site to Public/Semi- Public. (7.lc) Second reading, Ordinance No. 21-11061 rezoning the proposed Saline County Jail site from I-3 to PDD Public Use-Public Facilities. Commissioner Hoppock recused himself due to a conflict of interest. Michael Schrage, City Manager, and JoVonna A. Rutherford, City Clerk, stated no input or comments had been received from the public. Norman Mannel, Salina, Kansas, asked if research went back to 1803 on the property referenced in Item 7. lc and stated there was a claim against the property and title was not clear. Michael Schrage, City Manager, clarified that the City of Salina does not do title work. (7.2) Second reading Ordinance No. 21-11062 changing the zoning district classification from I-1 to I-2 on the southern and western portions of the Tony's Pizza campus in order to create a uniform zoning district for the entire campus located at 3019 Scanlan A venue. (7.3) Second reading Ordinance No. 21-11057 authorizing the execution of a Loan Agreement between the City of Salina, Kansas, and the State of Kansas for the purpose of financing improvements to the Wastewater Treatment Plant. Mayor Hodges stated no questions or comments were received from the public. 21-0119 Moved by Commissioner Davis, seconded by Commissioner Ryan, to adopt Ordinance No. 21- 11057, on second reading, authorizing the execution of a Loan Agreement between the City of Salina, Kansas, and the State of Kansas for the purpose of financing improvements to the Wastewater Treatment Plant. Aye: (4) Nay: (0). Motion carried 4-0. (7.4) Discussion of process to be utilized to fill City Commission vacancy resulting from the resignation of Commissioner Rod Franz. Mayor Hodges stated it was with deepest regret the resignation of Commissioner Rod Franz was accepted due to a fall that necessitated a long recovery period. Mayor Hodges read the letter of resignation from his family . ichael Schrage, City Manager, explained the City Commission's discretion in the decision and stated history and talking points had been provided. He further stated it would be helpful to staff to have a formal motion on the actions they wished to take. Mayor Hodges discussed previous appointments and current elected status and stated it was essential that there be consensus in what was viewed as important in the selection of a replacement. Mayor Hodges reviewed information and proposed a list of important attributes which she distributed to the Commissioners. UJ "' .s iii Ul "' ~ :g 0 "' c: 0 u A conversation ensued amongst the Governing Body regarding the list of attributes and the procedure involved to determine the importance of each. Mayor Hodges confirmed informal expressions of interest were submitted directly to the City Commission from former commissioners Joe Hay, Norm Jennings and Kaye Crawford. Commissioner Ryan inquired about a tiineline on a decision and a conversation followed to determine a deadline within the next two weeks. It was agreed by the Governing Body that expressions of interest would be utilized. Further discussion was had regarding the expression of interest form and the availability of the form located on the City of Salina website. The expression of interest submission deadline was decided to be May 12, 2021 . Michael Schrage confirmed there was a policy in place for board appointments, explained the procedure and stated any discussion amongst the Governing Body would need to be done in public. Discussion continued amongst the Governing Body regarding process . It was confirmed there would be an agenda item on May 17, 2021, to determine a course of action. It was further discussed that the Governing Body would be allowed to reach out to candidates unilaterally but could not have any communication amongst themselves unless it was in public. In summary, the application deadline would be May 12th, the applications would be in the City Commission packet for the May 17th meeting, Commissioners would individually contact applicants if desired and a nomination and vote would be held on May 17, 2021, unless more time would be needed . 21-0120 Moved by Commissioner Davis, seconded by Commissioner Ryan, to adopt the plan for addressing and discussing candidates for the city commission as described in summary set forth above. Aye: (4). Nay: (0). Motion carried 4-0. Michael Schrage, City Manager, mentioned that the family of Commissioner Franz was tuned into meeting. He stated Rod was unsurpassed in time, energy and commitment. Mayor Hodges expressed appreciation for Commissioner Franz's kindness and stated she was honored to serve with him. Commissioner Hoppock stated Commissioner Franz was greatly missed and wished him the best. DEVELOPMENT BUSINESS (8.1) Consider authorizing the City Manager to execute a License (Right-of-Way User's) Agreement with Missouri Network Alliance, LLC dba Bluebird Network to allow the installation of fiber optic and related facilities within the public rights-of-way in the City of Salina. Dean Andrew, Director of Planning, explained the request, fiscal impact and action options. Commissioner Hoppock asked about insurance requirement and Dean Andrew confirmed it was the standard rights and responsibilities. Page 4 1111 21-0121 r .. .. (8.2) Resolution Nos . 21-7954 and 21-7955, making certain findings and determinations as to the need for housing within the City of Salina, Kansas and setting forth the legal description of real property proposed to be designated as a Rural Housing Incentive District within the City. Lauren Driscoll, Director of Community & Development Services, explained the request, fiscal impact and action options. She also asked for the Governing Body to consider, under other business, Mr. Shukert's presentation to be moved from May lQth to May 17th. A conversation ensued amongst the Governing Body concerning total tax and appraised value, as well as waived permit fees. Discussion continued into Rural Housing Incentive District developments, grants, expenses and policies, as well as timing related to the scheduled Strategic Planning Session. Ms. Driscoll indicated that the Governing Body asked that incentives be brought before them so that is what has been presented. Commissioner Hoppock suggested that only the legal description of the area was going to be approved and no development agreement would be entered into. Further discussion on the Rural Housing Incentive Program followed, which included housing shortage, demand and construction costs. Mayor Hodges inquired about payment to Marty Shukert for his follow-up engagement, which was under $20,000. Mayor Hodges acknowledged the Governing Body gave staff guidance to present projects and she suggested obtaining Mr. Shukert' s advice. Mayor Hodges went on to comment on information received from surrounding cities, incentive policies, and the timeline for development. Mayor Hodges further inquired about the appraised value of the land being assessed as agricultural and a related discussion followed. Mayor Hodges inquired about length of ownership of Chapel Ridge Apartments and The Reserves at Prairie Glen which was stated to be a couple of years. She wondered what the current owner had planned for upgrades for these complexes and would want reassurance that the same situation would not be seen on I-135 . Alex Perry, participating via Zoom, indicated improvements are ongoing to Chapel Ridge and The Reserves at Prairie Glen and substantial remodeling, inside and out, was planned for the facilities. He shared that the discussions being had are common. Mr. Perry shared his thoughts on the Magnolia Pointe project. Mayor Hodges mentioned the current process of completing a revamp of a housing study, and policy discussions, among other items and asked about deadlines Mr. Perry might be facing. Mr. Perry indicated that if it were to go too long, construction costs, interest rates, and a number of variables could be an issue. Commissioner Hoppock questioned whether the construction would be completed in phases. Mr. Perry responded that after a prelimlli.ary look at the market he envisioned all buildings being constructed at one time but two phases would be possible. Further conversation ensured regarding occupancy of the buildings. Page 5 .. • • ,.. Ross Vogel, with Heartland Housing Partners, expressed appreciation of the Governing Body's service. Mr. Vogel commented that the community was fortunate to have local individuals step up to have workforce housing built. He touched on the issue of policy and provided further thoughts on workforce housing. Mr. Vogel provided pictures related to the Ryan project to the Governing Body and provided further detail of the construction and price of construction. Mayor Hodges inquired about the expectations the Governing Body would be setting for Mr. Vogel. Mr. Vogel indicated it was just the first step. The Governing Body would not be making a Rural Housing Incentive Development district, would only have decided to make the land eligible. Discussion of the timeline of the project followed . Stan Byquist, Salina, Kansas, responded to an inquiry by Commissioner Davis about basements or safe rooms. He stated there was a plan to incorporate a safe room in a closet. Commissioner Davis inquired about the different business models and returns of investment and Ross Vogel provided a response. Sandy Welsh, Salina, Kansas, mentioned the Governor's expansion of incentives. Michael Schrage, City Manager, indicated that he did not believe it changed the situation. A conversation ensued regarding a housing study being done by the state of Kansas which should not affect the projects. John Blanchard, Salina, Kansas, commented on a subdivision submittal which was passed in 2015. He stated the submittal was dropped due to having had no policy. He went on to discuss policies, zoning, and economic development. Mr. Blanchard inquired about the use of the state's housing assessment tool. Mayor Hodges asked if the assessment tool had been used or if the housing interagency advisory board had been contacted. A conversation followed about the assessment tool and other options. The Governing Body further discussed policy, project completion and related issues. 21-0122 Moved by Commissioner Hoppock, seconded by Commissioner Ryan, to approve Resolution No. 21-7954 setting forth the legal description as RHID within the city, making certain findings and determinations as to the need for housing within the City of Salina, Kansas, Magnolia Pointe. Nay: (1). Motion carried 3-1. OTHER BUSINESS Mayor Hodges addressed rescheduling the housing plan for May 17th which was approved. Commissioner Hoppock stated the need to have information available to visitors throughout Salina by means of brochures, billboards, video boards and other means. Mayor Hodges commented that staff at the Fieldhouse has had difficulty with mask compliance and stated that if that continues, discussion may need to be had regarding enforcement. She also mentioned the receipt of an email regarding the condition of the medians.
