COMMISSIONERS PROCEEDINGS, REGULAR MEETING
COMMISSIONERS ROOM,
SALIVA, KANSAS.
JULY 19, 1943
Regular Meeting of the Board of Commissioners July 19, 1943. Meeting was
called to order by Mayor Morgenstern, the roll was called and Coamiissiow re
Morgenstern, Breon, Elliott, Moore and Price responded.
The minutes of the Regular Meeting of July 14, 1943 were read and approved
as read.
Application for taxicab drivers license for the year 1943 received as
follows:
Eugene N. Jones
Commissioner Elliott moved that application be approved and license granted.
Motion adopted.
Mr. fin. K. Jarvis appeared before the Board of Commissioners and asked
permission to build a horse barn on Lots 18 to 32 inclusive, Block 4; and Lots 23-32
inclusive, Block 6, Bond's Addition to the City of Salina , Kansas. Mr. Jarvis was
instructed to present the request in the form of a letter to t he City Planning
Commission.
Application for Cereal Malt Beverage License for the year 1943 received
as follows:

Commissioner Price moved that application be rejected by the Board of
Commissioners. Motion adopted.
A letter for the Option Sale of Lot 1, Surveyor's Plat I, to the City of
Salina, Kansas, for the price of $2250.00 to August 1, 1943 was received from
Larry Gutsch.
Commissioner Price moved that the lot be purchased by the City of Salina for
$2250.00, and on its final adoption the roll was called and the following vote was
had; Ayess Morgenstern, Breon, Elliott, Moore and Price (5). Nays (0)
Mr. J. W, Sprout appeared before the Board of Commissioners for a special
permit to construct a stucco and brick building with an eight inch (8") wall,
size of building 40 x 20 feet, and a set-baok of ten (10) feet, on Lot 6, Block 10,
Pacific Addition to the City of Salina, Kansas. Commissioner Breon moved that
permit be granted subject to the approval of the Building Inspector and the City
Engineer. Motion adopted.
An ordinance was introduced entitled: "An ordinance making appropriation
for the payment of certain claims."
On motion of Commissioner Price the ordinance was read and adopted by sec-
tions and on its final adoption the roll was called and the following vote was had;
Ayess Morgenstern, Breon, Elliott, Moore and Price (5) Nayss (0) Mayor approved
the ordinance and it is numbered 206-A.
A resolution was introduced for second reading entitled: "A Resolution
relating tothe curbing, guttering and grading of Tenth Street from the south
line of Wilson Street to the north line of Repub o venue.
On motion of Commissioner Breon the ond&kutionwas read and adopted by sec-
tions and on its final adoption the roll was called and the following vote was had;
Ayess Morgenstern, Breon, Elliott, Moore and Price (5) Nays: (0) Mayor approved
the resolution and it is numbered 830.
The above resolution is recorded in full on Page 207, Resolution Book
Number 3.
A report was received from Alen H. Miller, Attorney -At -Law, for an
opinion concerning benefits assessed by the City against certain property
located in Chicago Addition to the City of Salina and belonging to the Butzer
Packing Company. Ordered filed.
A resolution was introduced entitled: "A Resolution relating to certain
assessments of benefits on lots in Chicago Addition levied under the provisions
of Ordinance Number 4940."

On motion of Commissioner Elliott the resolution was adopted as read and
on its final adoption the roll was called and the following vote was had; Ayes:
Morgenstern, Breen, Elliott, Moore and Price (5) Nays: (0) Mayor approved
the resolution and it is numbered 831.
The above resolution is reborded in full on Pages 208 and 209, Resolution
Book Numb er 3.
An ordinance was introduced for second reading entitled: "An ordinance
relating to and defining the offense of vagrancy and providing a penalty for the
violation of said ordinance and repealing Section 22 of Ordinances Number 635 of the
City of Salina, being Section 15-172, Revised Ordinances 1939."
On motion of Commissioner Moore the ordinance was read and adopted by sec-
tions and on its final adoption the roll was called and the following vote was had;
Ayes: Morgenstern, Breen, Elliott, Mows and Price (5) Nays: (0) Mayor approved
the ordinance and it is numbered 5033.
