Meeting was called to order by Layor Price, the roll was called and Commissioners Price, King, Ramsey and Webb and Acti:ig City Attorney Yordy responded. Commissioner Stephenson and City Attorney Clark absent. The minutes of the Regular iieeting of Iuay 23, 1949 were read and approved as read. E. L. Durham, 117 South Clark Street, appeared before the Board of Com- missioners about adding room on front of his house. Advised this would not leave the required set -back as required by ordinance. as follows: Application for Cereal Malt Beverage License for the year 1949 presented GEAERAL RETA__LER "INDIVIDUAL" game of Applicant Name and Location_ of Place of Business Robert E. Thompson Bob's Place 739 N. Eleventh and Broadway Commissioner King moved that application be approved and license granted. motion adopted. A petition was presented for the installation of a street light at the corner of West North and Phillips Street, or, at the corner of West iJorth Street and Reynolds. Referred to the City blanager. A petition was presented for the installation of a fire hydrant at the corner of West North Street and Phillips Street, or, at the corner of West North Street and Reynolds Street. Referred to the City kanager. A petition was presented for the construction of a sanitary sewer in Wisconsin from existing manhole in Stapler Avenue south to Gypsum Avenue. Referred to City !Manager. Wilson & Company, Engineers, filed Estimate Number 1 in the amount of $19,521.00 to Brown & Brown, Inc., and Johnson Bros. Construction Company, for the construction of a Sewage Disposal Plant. Commissioner King moved that estimate be approved by the Board of Commissioners. Lotion adopted. Wilson & Company, Engineers, filed Estimate Number 8 in the amount of $16,200.56 for Airport Improvements. Commissioner King moved that estimate be approved by the Board of Commissioners. blotionadopted. Work performed by H.J. Taylor Construction Company, Salina, Kansas. House Loving Bond was presented from Carney Brothers. Commissioner King moved that Bond be approved by the Board of Commissioners, lotion adopted. No persons appeared to protest against the rezoning of Lots 3 and 5, Block 19, E. Ni. I. Addition to Class "B" Residential District. Commissioner Ramsey moved that ordinance be introduced for first reading. Idiotion adopted. An ordinance was introduced for first reading entitled: "An ordinance providing for the inclusion of certain lands in the City of Salina, Kansas, in the "B" Fesidential District as that district is defined by Section 4 of Ordinance Number 3188 and providing for the proper uses thereof." Ordinance was referred to the Board of Commissioners. 1 Letter was presented from City Planning Commission approving Plat of Sheldon Brothers, for Upper Mill Heights. Commissioner King moved to accept. Carried. I Letter was presented irom City Planning Commission recommending that Lots 9, 10, 11, 12, 13, 14, 15 and 16 in Block 6, Bond's Addition not be rezoned from Class "A" Residential to Class "B" Residential. Commissioner King moved that report be accepted by the Board of Commissioners. Motion adopted. Letter was presented from City Planning Commission recommending that set -back requirement of 28 feet on the West 75 feet of Lots 96 a. -.d 98, on South Ninth Street, Grounds of Kansas Wesleyan University, ''aline, Kansas, be complied with. Commis- sioner Ramsey moved that report be accepted. Motion adopted. 460 A letter was presented from the City Planning Commission that they were highly pleased a reliable Planning Engineering F-rm has been employed by the City to make a complete survey and recommendations in regard to future planning. Ordered filed. An ordinance was introduced for first reading entitled: "An ordinance pro- viding and establishing the rates to be charged users of water sold by the Water Works Department of Salina and providing for certain discounts and increased minimum allowances to users of such water and providing for repealing of Section 1 of Ordinance Number 5015." Ordinance was referred to the Board of Commissioners. An ordinance was introduced for first reading entitled: "An ordinance reg;,lating the manufacture, s ale, transportation, possession, consumption and use of alcoholic liquor within the corporate limits of the City of Salina; prescribing penalties for the violation of its terms, and repealing Ordinance Number 5367• Ordinance was referred to the Board of Commissioners. An ordinance was introduced for first reading entitled: "An ordinance levying a license tax on retailers of alcoholic liquors by the package in the City of Salina, Kansas." An ordinance was introduced for first reading entitled: "An ordinance providing for the paving and grading of a certain north and south public alley between Twelfth Street and Thirteenth Street from the south line of Bishop Street south to the south line of Lot 61 extended west, on Twelfth Street, in Weavers Second Addition, and providing for the paving and grading of a certain alley lying between Tenth Street and Eleventh Street from the south line of Woodland Avenue, thence south 200 feet, and providing for the cost thereof, how the cost thereof shall be assessed and the manner of payment thereof." On motion of Commissioner Ramsey the resolution adopted as read and on its final adoption the roll was called and the following vote was had; Ayes: Ayes: Price, King, Ramsey and Webb (4) Nays: (0) Commissioner Stephenson absent. An ordinance was introduced for second reading entitled: "An ordinance relating to and apportioning and levying special assessments on certain lots and pieces of ground in the City of Salina, Kansas, to pay the cost of curbing, guttering, paving and grading of Morrison Avenue from the east line of Twelfth Street tothe west line of Phillips treet; and the curbing, guttering, paving and grading of North Oaurt Place from the north line of Beloit Street, thence northeast to the center line of Republic Avenue; and relating to and providing for the collection and payment of such assessments." On motion of Commissioner King the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Price, King, Ramsey and Webb (4) Nays: (0) Commissioner Stephenson absent. Taylor Construction Company for the construction of certain lateral sanitary sewers in the City of Salina heretofore designated as Lateral Sanitary Sewer Districts 236, 2373 23,8 and 239 and providing for the issuance of temporary notes to pay the cost thereof pending issuance and sale of bonds." City of Salina, Kansas, from the "C" Commercial District as that district is defined by Section 5 of Ordinance. Number 3188 and said ordinance as amended, and for the inclusion of said lands in the "D" Light Industrial Ustrict as that district is defined by Section 6 of Ordinance Number 3188 and providing for the proper uses thereof." Nayor approved the ordinance and it is numbered A-463. City Engineer filed plans and specifications for the construction of Later- al Sanitary Sewers Numbered 241 and 242. On motion of Commissioner Webb approved by the Board of Commissioners. Lotion adopted. Commissioner Webb moved that City Clerk advertise for bids for the constructi of Lateral Sanitary Sewers Numbered 240, 241 and 242, to 6p received up to and includ- ing 1,ionday, June 27th, 1949 at 7:30 o'clock P. M. Motion adopted. City Engineer submitted plans and specification for the construction of sidewalk adjacent to Lots 158, 160 and 166, Fourth Street, Original Town of Salina. Commissioner Ramsey moved that same be approved by the Board of Commissioners and City Clerk be instructed to advertise for bids for such sidewals to be received up to and including Monday.,June 27th, 1949 at 7:30 o'clock P. M. Motion adopted. The appraisers reports for the curbing., -guttering and/or paving certain streets provided for in Ordinances Number 5325, 5326 and 5327 were presented, and on motion of Commissioner '4ebb, Londay, June 20th, 1949 at 7:30 o'clock P. M. was desig- nated as a Special Meeting at which time the appraisers reports will be taken up and acted on by the Board of Commissioners, and that City Clerk give notice of such 1 meeting in the official City paper as provided by law. Motion adopted. A resolution was introduced for first reading entitled: "A Resolution relating tothe paving of Kirwin Avenue from the west line of Fourth Street to the west line of Osborne Street." Resolution was referred to the Board of Commis- sioners. An ordinance was introduced for first reading entitled: "An ordinance creating and defining a certain lateral sanitary sewer district in the City of Salina, Kansas, designated as Lateral Sanitary Sewer District Number 243, and providing for the construction of a lateral sanitary sewer in said Lateral Sanitary Sewer District Number 243, so created, and providing for the payment of the cost thereof and for the levying of special assessments against the property in said district for the payment of the cost of such construction of and for the issuing of bonds to pay the cost thereof." An ordinance was introduced for first reading entitled: "An ordinance providing for the curbing,guttering and grading of Fifth Street from the north line of Antrim Avenue tothe center line of Otis Avenue; for the curbing, guttering and grading of Grand Avenue from the west line of Tenth Street tothe west line of Eleventh Street; for the curbing, guttering and grading of Illinois Street from the west line of Sheridan Street tothe east line of Merrill Street; for the curbing, and guttering and grading of Illinois Street from the west line of Merrill Street to the east line of Hancock Street; for the curbing, guttering and grading of Kirwin Avenue from the west line of Pershing Street tothe center line of Funston Street; for the curbing and guttering and grading of Reynolds Street from the center line of Lincoln Street to tr,e center line of Broadway Boulevard; for the curbing, guttering and grading of Third Street from the north line of Republic Avenue to the south line of Lot 13, projected west, Block 5 in Hutchinson's Addition in the City of Salina, being approximately 153 feet north and south; and providing for the payment of the cost thereof, and how the same shall be assessed and the manner of payment thereof." Ordinance was referred tothe Board of Commissioners. Letter was presented from Roscoe Charter Service stating that feederline application had been filed with Washington for Salina to Topeka, and Wichita to Omaha through Salina. Ordered filed. Meeting was called to order by Mayor Price, the roll was alled nd Commissioners Price, King, Ramsey and Webb and Acting City Attorney Yordy responded. Commissioner Stephenson and City Attorney Clark absent. Meeting was held for the purpose of acting on the appraisers reports for the construction of Lateral Sanitary Sewers Numbered 224, 225, 226, 2272 228, 229, 230, 231, 2323 233, 234 and 235, No one appeared to protest. Commissioner Webb moved that appraisers reports be approved. Motion adopted. An ordinance was introduced for first reading entitled: "An ordinance relating to and apportioning and levying special assessments on certain lots and pieces of ground in the City of Salina, Kansas, to pay the cost of constructing Lateral Sanitary Sewers in Lateral Sanitary Sewer Districts Numbered 224, 225, 226, 227, 228, 229, 230, 231, 232, 233, 234 and 235, relating to and providing for the collection and payment of such assessments."
