MAY 10, 1948 Regular Meeting of the Board of Commissioners May 10ti., 1948. loeeting was called to order by mayor Noyce, the roll was called and Commissioners Noyce, Price, Stedham and Stephenson and City Attorney Clark responded. Commissioner Lindgren absent. read. The minutes of the Regular Meeting of hay 3, 1948 were read and approved as Board of Commissioners convened for the purpose of organizing. Harold h. Peterson, Deputy City Clerk presiding. On motion of Commissioner Price, seconded by Commissioner Stephenson, A. W. Sted: j nominated for Mayor. Commissioner Price moved that nominations be closed and on roll i call A. Yr. Stedham elected. On motion of Commissioner Price, seconded by Commissioner Noyce, L. F. Stephen- son nominated for Acting Mayor. Commissioner Price moved that nominations be closed and on roll call L. F. Stephenson elected. A. 01. Stedham took the chair. Bids for cleaning, sandblasting and painting 1,000,00 gallon elevated water tank and 265,000 gallon standpipe received as follows: Earl W. Hamman & Company, Wichita, Kansas $12,750.00 W. M. Wood, Salina, Kansas. 18,034.00 City Engineer's Estimate in the amount of $12,420.00 was read. Commissioner Price moved that bids be rejected. Engineer to ask for new bids. Checks returned to unsuccessful bidders. Leland T. O'Leary, owner of Taxicab drivers license No. 98, appeared in person to letter written by Chief Day. Commissioner Stephenson moved that license be returned and Leland T. O'Leary placed on probation until November 1, 1948. Carried. Trust Deed, with a deposit of $40.00 was presented from Mrs. Nathalie Dickens Administratrix of Keshner estate, for the perpetual care of Space Number 2, Flock ?8, Lot 39, in the Gypsum Hill Cemetery, Salina, Kansas. Commissioner Noyce moved that Deed be approved by the Board of Commissioners and City Treasuere be instructed to place the deposit in the Gypsum Hill Cemetery Lot Owners Endowment Fund as provided by Ordinance Number 3530 of the City of Salina, Kansas. Building Permit, Appli.;ation Ido. 1703 was presented from A. E. Harris, asking permission to erect a shed driveway at 636 north Santa r'e -venue. Comm-Lssioner Ste- phenson moved that request be rejected. Carried. Commissioner Price moved that City Manager's letter on Petition Number 1318 filed b Mrs. Henry A. Jones, relative to elimination of dead ends on Nort Oakdale, Penn, Columbia and Kansas be filed. Carried. Application for taxicab drivers license for the year 1948 presented as follows: James R. Green Commissioner Price moved that application be approved and license granted. Motion adopted. A resolution was introduced for second reading entitled: "A Resolution relat- ing to the paving of Fifth Street from the south line of Pacific Avenue tothe north line of Woodland Avenue." On motion of Commissioner Stephenson resolution was approved a s read and on its finaladoption the roll was called and the following vote was had; Ayes: Stedham, Boyce, Price and Stephenson (4) Nays: (0) Commissioner Lindgrenabsent. Mayor approved the resolution and it is numbered 1051. The above resolution is recorded in full on Page 44 Resolution Book Number 4. A resolution was introduced for second reading entitled: "A Hesolution relat- ing to the paving of Eighth Street from the south line of Hamilton Avenue to the north line of harsh Avenue." Onmotion of Commissioner Stephenson the resolution was adopted as read and on its finaladoption the roll was called and the following vote was had: Ayes: Stedham, Noyce, Price and Stephenson (4) Nays: (0) Commissioner Lindgren absent. Mayor approved the resolution and it is numbered 1052. On motion of Commissioner Stephenson the resolution was approved as read and on its finaladoption the roll was called and the following vote was had; Ayes: Sted- ham, Noyce, Price and Stephenson (4) Nays: (0) Commissioner Lindgren .absent. Mayor approved the resolution and it is numbered 10,1�3,. The above resolution is recorded in full on Page 46 Resolution Book Number 4. An ordinance was introduced for second reading enu, tied: "An ordinance providing for the vacation of portions or certain streets and alleys in the City of Salina, Saline County, Kansas." On motion of Commissioner Price the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Stedham, Noyce and Price (3) Nays: Stephenson (1) Commissioner Lindgren absent. Mayor approved the ordinance and it is numbered 5300• An ordinance was introduced for second reading entitled: "An ordinance allow- ing the change of frontage and replatting of certain lots and pieces of real estate being a part of Bond's Addition to the City of Salina, Saline County, Kansas." On motion of Commissioner Price the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; byes: Stedham, Noyce and Price (3) Nays: Stephenson (1) Commissioner Lindgren absent. Mayor approved the ordinance and it is numbered 5301. An ordinance was introduced for second reading entitled: "An ordinance provid- ing for a license as a condition precedent tothe sale and prescribing ti,e time of sale of fireworks, blank cartridges, pistols and other devices, or other devices and providing for the repeal of Sections 2 and 3 of Ordinance No. 4950 and Section 2 of said ordinance amended by Ordinance No. 5202 and ordaining a new section 2 and Section 3 in lieu thereof." On motion of Commissioner Stephenson the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Stedham, Noyce and Stephenson (3) Nays: Price (1( Commissioner Lindgren absent. Layor approved the ordinance and it is numbered 5302. An ordinance was introduced for second reading entitled: "An ordinance rati- fying and confirming a contract with the H.J. Taylor Construction Company for the construction of certain lateral sanitary sewers in the City of Salina heretofore designated as Lateral Sanitary Sewer:' 'districts No. 222 and 223, and providing for the issuance of temporary notes to pay the cost thereof pending issuance and sale of bonds." On motion of Commissioner Stephenson the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Stedham, Noyce, Price and Stephenson (4) Nays: (0) Commissioner Lindgren absent. Mayor approved the ordinance and it is numbered 5303• An ordinance was introduced for second reading entitled: "An ordinance providing for the curbing, guttering and grading of each the north side of Cloud Street from the west line of Quincy Street tothe center line of Roach Street; the west side of Roach Stre( from the north line of Cloud Street to the south line of Ciaflin Avenue; Norton Street from the nortt line of Cloud Street to the north line of Claflin Avenue; W ncy Street from the northli.ne of Cloud Street to the north line of Claflin Avenue; Russell Avenue from the west line of Quincy Street to the center line of Roach Street; Claflin Avenue (Street) from the west line of Custer Street tothe east line of Sheridan Street; Montrose Street from the center line of Charles Street to the center line of Prescott Avenue; Kirwin Avenue from the west line of Quincy Street to the center line of Roach Street; providing for the payment of the cost thereof, how the same shall be assessed, the manner of payment thereof and the issuance of bonds thereon." On motion of Commissioner Stephenson the resolution was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Stedham, Noyce, Price and Stephenson (4) Commissioner Lindgren absent. Mayor approved the ordinance and it is numbered 5304• No persons appeared to protest against the rezoning of Lot 23, Jewell Avenue, Grounds of Kansas Wesleyan University from Class "A" Residential to Class "B" Residential. An ordinance was introduced for first reading entitled: "An ordinance providing for the inclusion of certain lands in the City of Salina, Kansas, in the "B" Residential District as that district is defined in Section 4 of Ordinance No. 3188 and providing for the proper uses thereof." Ordinance was referred to the Board of Commissioners. A petition was presented for the curbing and guttering of Kirwin Avenue from Pershing Street to west City limits. Petition referred to City kanager. 1 1 1 1 L 32'7 A petition was presented asking for the curbing and guttering of Wilson Street from Fifth Street to Front Street." 0 Petition was referred to the City Manager. Letter was presenting from the City Planning Commission recommending that the alley east of Ohio Avenue from Ash Street tothe alley north of Johnstown Avenue not be vacated. Commissioner Noyce moved to accept recommendation. Carried. Letter was presented from the City Planning Commission recommending that the width of Fifth Street commencing with and including the 700 Block of north Fifth Street on North to Woodland Avenue be left as it is at 80 feet. Commissioner Price moved that recommendation be accepted. Carried. Letter was presented from the City Planning Commission recommending tt_at the dead-end street which is an extension of Cedar Street between Clark Street and the Railroad right-of-way be closed. Commissioner Price moved to accept recommenda- tion and City Manager to contact C. A. Winn in regard to sidewalk and drainage. Carried. Letter was presented from the City Planning Commission recommending that the North 110 feet of Lot 19, Ash Street, University Addition be rezoned from "A" Residential to "B" Residential. Commissioner Stephenson moved that recommendation be accepted by the Board of Commissioners and that City Clerk give thirty days notice in the officia City paper of intent to rezone from Class "A" Residential to Class "B" residential the North 110 feet od Lot 19, Ash Street, University Addition. kAotion adopted. A Resolution was introduced for first reading entitled: I'll Resolution relating tothe paving of Kirvrin Street from the west line of Ninth Street to the west line of Pershing Street." Resolution was referred to lie Board of Commissioners. A resolution was introduced for first reading entitled: "A Resolution relating tothe curbing and guttering of Stapler Avenue from the east line of Ohio Street to the east line of Delaware Avenue." Resolution was referred to the Board of Com- missioners. An ordinance was introduced for first reading entitled: "An ordinance creating and defining a certain Lateral Sanitary Sewer District in the City of Salina, desig- nated as Lateral Sanitary 0evver District iJo. 225,_nd providing for the construction of a lateral sanitary sewer in said Lateral Sanitary Sewer D_;.s trict Number 225, so created, and providing for the payment of the cost thereof and for the levying of special assessments against the property in said district for the payment of the cost of such construction and for the issiance of bonds to pay tie cost thereof." Ordinance was referred to the Board of Commissioners. An ordinance was introduced for first reading entitled: "An ordinance ratifying and confirming a contract with the H. J. Taylor Construction Company for the constructic of certain lateral sanitary sewers in the City of Oalina, heretofore designated as Lateral Sewer District Number 218 and 219, and for the construction of a certain rviain Sewer District "W" heretofore created, and providing for the issuance of temporary notes to pay the cost thereof pending issuance and sale of bonds." Ordinance was referred to the Board of Commissioners. On motion of Commissioner Price the Board of Commissioners adjourned. Meeting was called to order by Mayor Stedham, the roll was called and Commissioners Stedham, Noyce, Price and Stephenson and City Attorney Clark responded. Commissioner Lindgren absent. Meeting was held for the purpose of acting on the appraisers reports for the paving of the following alleys: Alley lying between Fifth Street and Fourth Street from Walnut Street to Mulberry Street; and Alley lying between Santa Fe avenue and Seventh Street from Elm Street north 532 feet. The appraisers report for -the paving of the alley lying between Fifth Street and Fourth Street from Walnut Street to Mulberry Street was taken up and read as follows: STATE OF KANSAS ) )SS COUNTY OF SALINE ) We, J.
