Meeting was called to order by Mayor Noyce, the roll was called and Commissioners Noyce, Lindgren, Price, Stedham and Stephenson and City Attorney Clark responded. Taylor Construction Company, Galina, Kansas 172,711.00 was readCity Engineer's Preliminary Estimate of Cost in the amount of $181,896.25 . Bids were tabulated by the City Engineer. Commissioner Price moved that contract be awarded to the H. J. Taylor Con- struction Company, Salina, Kansas, as per bid submitted in theamount of $172,711.00, and that the Mayor be authorized to sign contract on behalf of the City of Salina for such improvements, in accordance with such proposal, and the form of contract and specifications attached thereto and referred to therein, and that checks be returned to unsuccessful bidders. Motion adopted. Mr. C. C. Shirk appeared before the Board of Commissioners regarding building at Elm Street and Front Street. Referred to City Manager for investigation. Building Application No. 1111 was presented and on motion of Commissioner Price granted. Lotion carried. Building Application No. 1118 was presented and on motion of Commissioner Stephenson comply with ordinances. ivotion carried. Irir. B. C. Easter appeared before the Board of Commissioners in reference to moving in house in the 900 Block on Cedar btreet. Commissioner Price moved that house be in line with Lohmiller house, not less than a twenty -foot setback. Motion adopted. 1_58 Applications for taxicab drivers license for the year 1947 presented as follows: Oscar Liinard Commissioner Lindgren moved that application be approved and license granted. notion adopted. Motion adopted. A petition was presented asking for the curbing and guttering of Fifth Street from Otis Avenue to Euclid. Referred to the Dity'Mlanager and City Engineer. to whom was referred the petition asking for the City Planning Commission, rezoning of Lot 4, College Court, from "A" Residential to "C Commercial, recom- mended that lot not be rezoned. Commissioner 6tedham moved that recommendation of Planning Board be accepted. Motion adopted. No protests were presented against the rezoning of the following described property: By removing from Class "A" Residential to Class "C" Commercial, all of Lot 91 Block 5, South Park Addition; By removing from Class "A" Residential. to Class "B" Residential, Lots 5,6,7,8,9,10, Block 4, Oakdale Addition. 159 An ordinance was introduced for first reading entitled: "An ordinance providing for the inclusion of certain lands in the City of Salina in "B" residential District, providing fort he inclusion of certain lands in "C" Commercial District, as those districts are respectively defined in Sections 4 and 5 of Ordinance No. 3188 and pro- viding for the proper use of each thereof." Ordinance was referred torhe Board of Commissioners. On motion of Commissioner Stedham, seconded and carried, E. J. Allison, City h«anager was ordered and directed to execute on behalf of the City of Salina, a certain "Articles of Agreement" dated the 30th day of June 1917, relating to disposal of trash and garbage, by and between Nellie W. White and the City of Salina. An ordinance was introduced for second reading entitled: "An ordinance creat- ing and defining a certain lateral sanitary sewer district in the City of Salina designated as Lateral Sanitary Sewer District No. 215 so created, providing for the payment of the cost thereof and for the levying of special assessments agai nit the property in said district for the payment of the cost of such construction; and for the issuing,of bonds therefor." On motion of Commissioner Price the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Noyce, Lindgren, Price, Stedham and Stephenson (5) Nays: (0) Mayor approved the ordinance and it is numbered 5227. An ordinance was introduced for second reading entitled: "An ordinance provid- ing for the condemnation of certain land for public use in the extension of a public alley in the City of Salina, Kansas." On motion of Commissioner trice the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Lindgren, Price, Noyce, Stedham and Stephenson (5) Nays: (0) Mayor approved the ordinance and it is numbered 5228. Mayor Noyce appointed J. Earl Wyatt, John Frederick and Wm. F. Commissioner Price moved that appointments be confirmed by the Board of Com- missionc:rs. Notion adopted. 160 Oil and Gas Drillers Bond for Charles Seaney and B. A. breon, in the amount of $2500.00 was presented, and on motion of Commissioner Price approved by the Board of Commissioners. Lotion adopted. Application was received from Charles Seaney and B. A. Breon for permit to drill for oil and gas in the City of Salina, Kansas; well to be located in Block 4, Stack 'lace, an addition to the City of Salina, Kansas, and Lots 2, 3 and 4, the North 100 feet of Lot 52 and all of Lot 6, in Surveyor's Plat 7, all being part of the NW 1/4 of Section 18, Township 14 South, Range 2 West, Saline County, Kansas. Commissioner Price moved that application be granted subject to filing of Drilling Contract. Motion adopted. Harry Connell of the Xlson and Company, Engineers, appeared before the Board of Commissioners and reported on trip of inspection of INater Softener Lquip- ment at the Dorr Plants. On motion of Commissioner Lindgren , draw up contract with Dorr Company, with charges and price of extra o"reir, and subject to approval of City Attorney and'hilson and Company, Engineers, and to present contract at next meeting.
