08-29-1932 MinutesCOMMISSIONERS PROCEEDINGS, REGULAR MEETING. COMMISSIONERS ROOM, SALIVA, KANSAS. AUGUST 29th, 1932. Regular meeting of the Board of Commissioners ,August 29th, 1932. Meeting was called to order by Mayor Stevenson, the roll was called and Commissioners Stevenson, Benfield,.,Norey, Pafford and Spaeth and City, Attorney_ Norris responded, The minutes of the Regular Meeting,of August 22nd, 1932 were read and approved as read. An ordinance was introduced for first reading entitled: "An ordinance providing for and authorizing the issuance of Improvement Bonds of the City of Salina, Kansas in the sum or.$23,377.47 to pay the cost of improving certain streets in said City." On motion of Commissioner Spaeth same was referred to the Board of Commissioners. A resolution was introduced entitled: "A resolution relating to the Maintenance Bond given by the H. J. Taylor Construction i Company in connection with the construction of paving Job leo. 71." On motion of Commissioner Morey the re.s.olution.was adopted as read and on its final adoption the roll was called and the following vote was had; Ayes: Stevenson, Benfield, Morel, Pafford and Spaeth (5) Nays: (0) Mayor approved the same and is numbered 539. The above resolution is recorded in full on Pages 198 and 199 i of Resolution Book Number 2. i Combination Plumbers and Gas Fitters Bond received from I A. J. Bachofer, and on motion of Commissioner Pafford some was ap- proved by the Board of OR'' issioners• Commissioner Pafford moved that the City purchase from the Northview Country -Club, the airport hangar located on the Airport property, for the sum of $200.00 Notion adopted. The proposition of amending Zoning Ordinance No. 3188 by placing Lot 9 in Surveyor's Plat "A", located at the southwest corner of Ninth and Walnut Streets, in the "C" Commercial District and removing the same from the "B" Residence District, as recommended by the City Planning Commission, came on for hearing: pursuant to Notice of meeting to be held for such purpose as published in the Salina Journal on July 30, 1932• The owner of the property affected, H. D. Miller, appeared in support of such proposed change, and J. F. Corder and others appeared in opposition thereto, and on the request and representation of Mr. J. F. Corder that the persona opposed to such change had had no opportunity to be heard by the City Planning Commission before the proposed change was recommended and approved i by that body, it was moved by Commissioner Pafford and duly seconded by Commissioner Spaeth that the matter be referred back to the City i PlanningCowission, with all petitions and protests now on file i concerning the same, with the request that the City Planning Commis- sion hold another hearing on the matter at which all persons inter- ested may have an opportunity to be heard, and that after such hear- ing the City Planning Commission report to the City Commissioners whether it adheres to its previous recommendation in the matter, or whether it desires to change its recommendation, and that pending such rehearing by the City Planning Commission, this matter be contin- ued for further hearing and .action before the Board of Commissioners j until September 12th, 1932. The proposition of amending Zoning Ordinanoe No. 3188 by placing Lots 44, 46 and 48 on Santa Fe Avenue in the Grounds of Kansas Wesleyan Universitq, in the "C" Commercial District and re- moving the same from the A" Residence District, as recommended by the City Planning Commission, came on for hearing, pursuant to Notice of meeting to be held for such purpose as published in the Salina Journal on July 30, 1932. The owner of a part of the property affected, Mr. Geo. F. Bogue, appeared in support of the proposed change, and Mr. W. A. Hilands and W. H. Gardner and others appeared In opposition thereto, and on the request and representation of W. A. Hilands and W. H. Gardner that the persons opposed to such change had had no opportunity to be heard by the City Planning Com- mission before the proposed change was recommended and approved by that body, it was moved by Commissioner Spaeth and duly seconded by 1 �l 1 1 rj 1 1 Commissioner Pafford that the matter be referred back to the City Planning Commission, with all petitions and protests now on file con- ,cerning the same,_ with the request that the City planning Commission hold another hearing on the matter at which all persons interested in the matter may be heard, and that after such hearing the City Planning Commission report to the City Commissioners whether it adheres to its former recommendation in the matter or whether it de- sires to change its recommendations, and that pending, such rehearing by the City Planning COnmisslon, this matter be continued for further hearing and action by the Board of Commissioners until September 12j, 1932. Motion carried. The proposition to amend Zoning Ordinance Number 3188 by establishing set back lines of 30 feet on Santa Fe Avenue and 20 feet on Fifth Street, in that part of the "B" Residence District located In the Block bounded by Santa Fe Avenues Fifth street,.South street and Prescott Avenue, and by changing certain lot area per family and rear yard requirements in the "B" Residence District, as set forth in the Notice of such proposed changes published in the Salina Journal on July 30, 1932s as recommended by the City Planning_Conmission, came on for hearing. Dr. Suttaft appeared in support of much,proposed changes and no other appeared. It was moved by Commxissioner .Pafford and duly seconded by CO mnissiolior Benfield that the proposed changes as set forth in the published notice be approved, and that the City Attorney be instructed to prepare the necessary ordinance.._providing for such amendment.
