Meeting was called to order by Mayor Stevenson, the roll was called and Commissioners Stevenson, Morey, Peters and Spaeth and City Attorney Norris responded Commissioner Pafford absent. The minutes of the Regular Meeting of November 27, 1933 and Regular Meeting of December 1, 1933, were read and approved as read. F Commissioner Spaeth moved that the Waterworks Department be author- ized to sell to the United Life Insurance Company, Bonds numbered 9 and 109 in theamount of $2300.00 each, at par and accrued interest. Motion adopted. An ordinance was introduced entitled: "An ordinance making an appropriation for the payment of certain claims." On motion of Commissioner Morey the ordinance was read and adopt- ed by sections and on its final adoption the roll was called and the fol- lowing vote was had; Ayes: Stevenson, Norey, Peters and Spaeth (4) Nays: (0) Commissioner Pafford absent. Mayor approved the same and, is numbered 4327. An ordinance was introduced for second reading entitled: "An ordinance providing for the repaving of Ninth St eet from the south line of Ash Street to the south line of North Street west of Ninth Street) and providing for the cost thereof, how the same shall be assessed and the manner of payment therefor." f On motion of Commissioner Spaeth the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Stevenson, Morey, Peters and Spaeth (0) Nays: (0) Commissioner Pafford absent. Mayor approved the same and is numbered 4329. An ordinance was introduced for second reading entitled: "An ordinance providing for the recurbing of Ninth Street from the south lire of Bishop Street to the south line of North Street west of Ninth Street) and providing for the cost thereof, how the same 'shall be assessed and the manner of payment therefor." On motion of Commissioner Peters the ordinance was read and adopted by sections and on its final adoption the roll was called and the followsz� vote was had; Ayes: Stevenson, Morey, Peters and Spaeth (4) Nays: t0) Commissioner Pafford absent. An ordinance was introduced for second reading entitled: "An ordinance providing for the curbing, guttering and paving of University Place from the east line of Baker Street to the west line of welfth Street, and providing for the cost thereof, how the same shall be assessed and the manner of payment therefor. On motion of Commissioner Peters the ordinance was read and adopted by sections and on its final adoption the roll was called and the fol- lowing vote was had; Ayes: Stevenson, Morey, Peters and Spaeth (4) Nays: (0) Commissioner Pafford absent. Mayor approved the same and is numbered 4330. An ordinance was introduced for second reading entitled: "An ordinance providing for the curbing, guttering and paving of Columbia Avenue from the north line of Ash Street to the south line of Elm Street and providing for the cost thereof, how the same shall be assessed and the manner of payment therefor." On motion of Commissioner Spaeth the ordinance was read and adopt- ed by sections and on its final adoption the roll was called and the fol- lowing vote was had; Ayes: Stevenson, Morey, Peters and Spaeth (4) Nays: (0) Commissioner Pafford absent. Mayor approved the same and is numbered 4331. A resolution was introduced entitled: "A Resolution authorising H. N. Lame., City Engineer of the City of Salina, Kansas, to sign on behalf of the City of Salina an application to the Federal Emergency Administration of Public Works for a grant of money to be used in payment of part of the cost of the construction of repaving Ninth Street from the south line of Ash Street to the south line of North Street, extended west of Ninth Street; recurbing of Ninth Street from the south line of Bishop Street to the south line of North Street (west of Ninth Street); curbing, guttering and paving Columbia Avenue from the north line of Ash Street to the south line of Elm Street; and curbing, gut tering and paving University Place from the east line of Baker Street to the west line of Twelfth Streetol" On motion of Commissioner Spaeth the resolution was adopted as read and on its final adoption the -roll was called and the following vote was had; Ayes: Stevenson, Morey, Peters and Spaeth (4) Nays: (0) Commissioner Pafford absent. Mayor approved the same and is num- i bered 593. The above resolution is recorded in full on Page 255 of Resolution Book Number 2. Application No. 1-01, asking permission to erect a metal face sign on front of building located at 126 South Fifth Street was received from Stevenson's Grocery, and on motion of Commissioner Morey same was approved by the Board of Commissioners. Application No. 102, asking permission to erect a metal face sign on front of building located at 250 South Santa Fe Avenue was received from Help Yourself Grocery Company, and on motion of Commis- dioner Morey same was approved by the Board of Commissioners. Commissioner Morey moved that the City Clerk publish the fol- lowing notice in the official City paper: Motion carried. I NOTICE OF PROPOSED CHANGE IN ZONING j ORDINANCE Pursuant to recommendations made by the City Planning Commission notice is hereby given of the following proposed changes in and amend- ments to the zoning ordinance of the city of Salina, being Ordinance No. 3188 as amended, in the following respectss 1. By removing the following territory, to -wit: Lot 14 Block 2 Fruitland Addition, Lot 7, Block 5 Phillips East Salina Addition. Lots 2-3-4-5-6-7-8-12-13 and the West 150 feet of Lot 1, Survey- or's Plat No. 8. I Lots 1-2-3-4-5-6-7-8 and 9 in Block 2 in Hanson Court from the "A" R sidenee Use District as defined and governed by Sections 3 and 8 of gaid ordinance and placing the same in the "C" Commercial Use District as defined in said Ordinance and subject to the.rcgulations provided for in Section 10 thereof, subject however to the further additional restrictions, to-wit:That in the construction, reconstruction or remodeling of any building within such territory a minimum set back of twenty feet from the street line shall be observed on all that part of the above described territory lying east of Delaware Street, and on that part lying west of Delaware Street, the same set back shall be observed in any cause as is now required for residence properties in the remaining portion of the blocks in which such territory is located, and as would be required in such territory if the same were left in the residence zone; and provided further that any building or structure of any kind constructed, reconstructed or remodeled within any such terri- tory shall be of what is commonly known as residence type of architect- ure and no permit shall be issued by the Building Inspector of the City of Salina for the construction, reconstruction or remodeling of any building within such territory and no building shall be constructed, reconstructed or remodeled within such territory unless and until j plans therefor are submitted to the Board of Commissioners of the City of Salina and approved by such Board. 2. By removing the following territory, to -wit: Lots 1, 2, 30 and 4 on Ninth Street in Block 1 and Lots 1, 2, 3 and 4 on Ninth Street in Block 2 in Evergreen Park Addition, and Lots 74, 76, 78, 80, 82, 840 860 880 90, 92, 940 96 and 98 on Ninth Street in the grounds of Kansas Wesleyan University, being the territory bounded on the north by Claflin Avenue on the south by Cloud Street, on the east by the alley between Ninth Street and Highland Avenue and on the west by the alley running north and south from Claflin Avenue to Cloud Street west of Ninth Street, from the "A" Residence Use District as defined and governed by Section 3 and 8 of said Ordinance , and placing the same in the "C Commercial Use District as defined in said ordinance and subject to the regulations provided for in Section 10 thereof, pro- vided however that no buildings shall be erected within such territory for use as tourist cabins or what is known as tourist camps or cabin camps and the lots within such territory or any buildings thereon shall be at no time used for any such purpose; and subject to the further additional restrictions, to -wit: That in the construction, reconstruction or remodeling of"any building within such territory, minimum set backs shall be observed as follows: 28 feet from the street line on each side of Ninth Street and 20 feet from the respect-ive street lines on Claflin Avenue, Cloud Street and Woodlawn Avenue, and provided further that any building or structure of any kind con- strutted, reconstructed or remodeled within any such territory shall j be of what is commonly known as residence type of architecture and no j permit shall be issued by the Building Inspector of the City of Salina for the construction, reconstruction or remodeling of any building within such territory and no building shall be constructed, reconstruct- ed or remodeled within such territory, unless and until plans therefor are submitted to the Board of Commissioners of the City of Salina and j approved by such Board. 3. The ordinance providing for such amendments and changes shall further provide that if any clause provision or part of any section or such ordinance or any restriction contained in any such a section shall be determined by the final judgment of any court of com- petent jurisdiction to be invalid or ineffective for any reason, then in such event, the whole of any such section shall be deemed to be wholly invalid or ineffective, it being the intention of the Board of j Commissioners to passeach section of this ordinance as a whole, and in any such event the territory described in any such section shall be considered to be within the Use zone in which it was located prior to the taking effect of such amending ordinance. z A public hearing will be granted to any person interested in the foregoing proposed chs.anges by the Board of Commissioners at 5:00 o'clock PM. on January 8th, 1934 at the Commissioners Meeting Room in the City Hall of said city, at which meeting all protests and objections to any such proposed changes may be filed and consid- ered.
