ORDINANCE NUMBER 21-11050 AN ORDINANCE AMENDING THE FUTURE LAND USE MAP (FIGURE 2.1) AND THE NEIGHBORHOOD CENTER LIST OF POTENTIAL ZONING DISTRICTS(PAGE 2-13)OF W THE COMPREHENSIVE PLAN OF THE CITY OF SALINA, KANSAS. N BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: 0 Section 1. Findings. In relation to the following described real estate: Lots Two (2) and Three (3), Block One (1), Lot Two (2), Block Two (2); Lot One (1), Block Three (3); Lots One (1), Two (2), Three (3), Four(4) and Five (5), Block Four (4); and Lots One (1), Two (2),Three(3),and Four(4),Block Five(5)in the Corrected Plat of Liberty Addition No. 2 to the City of Salina, Saline County, Kansas. (the "Property") the Governing Body makes the following findings: 1. All conditions precedent for the amendment of the City's Comprehensive Plan have been timely met; IIE 2. The requested Future Land Use Map amendment is justified by changing conditions in the community because in 2003, when Liberty Addition No. 2 was originally created, PC-6 (warehousing) was envisioned for the lots around Cortland Circle. The market and development patterns in the surrounding neighborhood have changed in 17 years; 3. The owner of the Property is looking at doing mixed commercial/residential development which fits better within the Neighborhood Center land use category than an Employment Center. All four corners of the Schilling-Ohio intersection are part of a Neighborhood Center; 4. There is a public need to change the Comprehensive Plan Future Land Use Map to Neighborhood Center because PC-6 is not listed as a potential zoning district in Neighborhood Centers. Warehousing development was originally anticipated. Time and the market have shown that there was no demand for this land use in this area. The Employment land use classification does not list any type of housing as an appropriate land use, but the Neighborhood Center land use category does; 5. The public need is best served by changing the land use designation of the subject property as compared with other available property because Liberty Addition No. 2 is one of very few shovel ready sites in the community. All needed services to support development are in place and the Comprehensive Plan encourages new development to take place in locations that are already served by utilities and services; and 6. The requested change would not negatively impact the surrounding area because a change in zoning classification from PC-6 to PC-5 aligns better with the comprehensive plan and moving to a neighborhood center environment. PC-5 zoning is more consistent with the zoning of the adjacent lots of Schilling Road and the property across the street. Section 2. Comprehensive Plan Amendment. The Future Land Use Map(Figure 2.1)of the Salina Comprehensive Plan is amended to show the Property as a future Neighborhood Center land use area. Section 3. Comprehensive Plan Amendment. The Neighborhood Center list of Potential Zoning To Districts on Page 2-13 of the Comprehensive Plan is amended to read as follows: • C-2, PC-3, PC-5, R-3 • Urban Residential (New Recommended District) • Mixed Use (New Recommended District) • PDD (With Recommended Revisions) Section 4. Repealer. All prior ordinances relating to the Property are repealed to the extent they are in conflict with this ordinance. Section 5. Summary of ordinance for publication. This ordinance shall be in full force and effect from and after its adoption and publication once by summary in the official city newspaper. Ordinance No. 21-11050 Summary On February 1, 2021, the City of Salina, Kansas, passed Ordinance No. 21-11050. The ordinance amends the Future Land Use Map (Figure 2-1) in the Salina Comprehensive Plan to show the future land use designation of thirteen lots at the southwest corner of Schilling Road and South Ohio Street as part of a Neighborhood Center instead of an Employment area in order to be consistent with a PC- 5 (Planned Service Commercial) zoning district designation.
