COMMISSIONERS PROCEEDINGS, REGULAR MEETING.
COMMISSIONERS ROOM,
SALIVA, KANSAS.
FEBRUARY 20, 1933.
Regular meeting of the Board of Commissioners, February 20,
1933. Meeting°was called to order by Mayor Stevenson, the roll was
called and Commissioners Stevenson, Morey, Pafford, Paulsen and Spaeth
and City Attorney Norris responded.
The minutes of the Regular Meeting of February 13th, 1933,
were read and approved as read.
An ordinance was introduced entitled: "An ordinance making an
appropriation for the payment of certain claims."
On motion of Commissioner Morey the ordinance was read and
adopted by sections and on its final adoption the roll was called and
the following vote was had; Ayes: Stevenson, Morey, Pafford, Paul-
sen and Spaeth (5) Nays: (0) Mayor approved the same and is num-
bered 4234.
A resolution was introduced for second reading entitled: "A
resolution relating to the recurbing of Santa Fe Avenue from the
north line of Ash Street to the north line of Elin 9treef."
On motion of Commissioner Pafford the resolution was adopted
as read and on its final adoption the roll was called and the follow-
ing vote was had; Ayes: Stevenson, Morey, Pafford, Paulsen and
Spaeth (5) Nays: (0) Mayor approved the same and is numbered 557.
The above resolution is recorded in full on Page 217 of Reso-
lution Book Number 2.
An ordinance was introduced for first reading entitled: "An
ordinance providing for the repaving of Santa Fe Avenue from the
north line of Elm Street to the south line of Wdrn—ufFeet, and pro-
viding for the cost thereof, how the same shall be assessed and the
manner of payment therefor."
On motion of Commissioner Paulsen same was referred to the
Board of Commissioners.
An ordinance was introduced for first reading entitled: "An

north line of Ash Street to the south line of WaMu-fStreet, and
providing for the cost thereof, how the same shall be assessed and
the manner of payment therefor*"
0n motion of Commissioner Spaeth same was referred to the Board
of Commissioners.
A petition was presented from property owners asking that no
permit by given to any individuals, corporations or firms to carry
on any business in the Residence District which requires a City
license.
Commissioner Pafford moved that no license or permits be issued
to any businesses now requiring license or permits, which are doing
business in residence districts in violation of Zoning Ordinance.
Motion seconded by Commissioner Morey and on roll call the following
vote was had; Ayes: Morey, Pafford, Paulsen, Stevenson and Spaeth
(5) Nays: (0).
The following communication was received from the City Plan-
ning Commission in reference to rezoning Lots 51-52-53, Front Street,
Original Town from "B" Residence to "C" Commercial District:
Salina, Kansas. February 9, 1933.
The City Planning Commission met in regular session in the
Chamber of Commerce rooms, City Building at 5:00 P.M. for the pur-
pose of considering a petition presented by Mrs. E. M. Brown and
Mr. W. L. Cubberly for the rezoning from B -Residential to C -Commercial
Lots 51, 52 and 53 on Front Street, Original Town Plat.
All members of the Commission were present except Mr. McCarty.
The purpose of this meeting was advertised and all parties
interested were invited to attend.

There was presented at this meeting in connection with the
re-zoning petition a remonstrance petition signed largely by in-
dividual property owners and residents living in thip Immediate
vicinity. In addition.to this several of these adjacent resident
property owners verbally ex+essed their opposition to this re- i
zoning.

The Planning Commission, after listening to both groups
of petitioners voted to refuse the request for rezoning the above
named site, Lots 51, 52 and 53, Front Street, Original Town Plat.
There being no further business for consideration the Commis-
sioners adjourned at 6:15. j

On motion of Commissioner Pafford the above communication was
ordered filed.

Application of Busboom & Rauh for release of Concrete Construe-
tion Bond #37105 issued by Ohio Casualty Company from future liabil-
ity-,was received. as follows:

Gentlemen:
You are informed that your bond No. 37105 given to cover
the license of Busbo.om and Rabh_as_Principal may be cancelled as of
February 21st, 1933, for the reason that cancellation of future
liability under such policy after that date has been requested.

Commissioner Morey moved that City Clerk be authorized to
release bond from future liability.. Seconded by Commissioner
Pafford. Motion carried.
John Boyer appeared before the Board of Commissioners in
the matter of notice received for the operation of dairy at Franklin
and Hancock Streets. Moved by Commissioner Pafford and seconded by
Commissioner Spaeth that-City Attorney proceed to enforce ordinance
and prevent violation of Zoning Ordinance. Motion carried.
A communication was received from Salina Municipal Band
of appointment of Clifford Gross as Trustee of Salina Municipal
Band. Same was ordered filed.
On motion of Commissioner Pafford the Board of Commissioners
adjourned until February 21st, 1933 at 1:30 P. M.
