Regular meeting of the Board of Commissioners, June 27,
1935. Meeting was called to order by Mayor Pafford, the roll was
called and Commissioners Pafford, Peters, Jackson, Mitchell and
Surface and City Attorney Norris responded.
Mr. 0. W. debar and x1r. J. J. Wiesendanger, appeared in
behalf of Salina Street Railway Company at invitation of Board of Com-
missioners to submit whatever proposition they might have with reference
to a bus franchise for the operation of busses in the City of Salina.
The City Attorney stated that the purpose of the meeting was
to hear from them what proposition they had to make with reference to
securing a bus franchise from the City, including a statement as to
just what equipment they would propose to furnish, the kind and number
of vehicles, the kind of service, the insurance protection which they
would agree to furnish and any other details as to kind and quality
of service which they would agree to give, and that any proposition
so submitted should be independent and distinct from any other proposi-
tion or communication at any time heretofore submitted to the
Commissioners and should not be hinged or conditioned upon any former
proposition or communication made by the Company to the City.
Mr. Weber stated on behalf of the Company that the Company
had no proposition to submit other than had been previously sub-
mitted to the Commissioners; that the Company would do nothing which
would waive its existing rights; that it considered that it had a
franchise and that it wanted only an extension of the existing franchise
and that they had no proposition to make; that they considered that
any proposition for new equipment or different service should come
from the City and that the Company would accept or reject the proposi-
tion; that they would not enter into any competition with any other
applicant for a franchise.
The City A ttorney stated that so far as the City was con-
cerned, the Company had no franchise, that the District Court had
entered a final judgment so decreeing and that any dealing with the
Company would have to be on the basis of a new franchise upon such
terms as could now be agreed on, independent of any existing claims
or rights, and independent of any former propositions submitted by
the Company.

Mr. Weber again stated that he considered that the Company
already ha d a franchise, that it needed only an extension for a
proper period after the expiration of the present franchise, which,
he said, had seven or eight years yet to run, and that they would not
under any consideration accept a new franchise.
The City Attorney again stated that the City was giving the
Salina Street Railway Company an opportunity to submit a proposition
for a franchise, if they could to make one which would state the kind,
quality and amount of equipment which they would furnish, the insurance
protection for passengers and public which they would furnish, and
other details as to service.
Mr. Wiesendanger stated that he had already offered the only
proposition he could or would offer, that he had offered and furnished
for years the best transportation system in the county, and that he
wanted to do whatever could be done peaceably.
Mr. Weber said that he wanted it understood that Mr. Wiesen -
danger is not agreeing to accept a new franchise, but only a renewal
of the existing franchise as the Company has a franchise at this time;
that the judgment of the District Court does not amount to anything,
and that they will not have to pay any attention to it as it is merely
a technical judgment; that if Mr. Wiesendanger intended to say that
he would consider and accept a new franchise that he was wrong and
that fir. W iesendangerts statement was false and that they would accept
no new franchise and would submit nothing further than had already been
submitted.
The Mayor avowed that if the Company had nothing further to
submit, that whatever they had submitted would be considered in con-
nection with the propositions submitted by other persons for a bus
franchise, and that a franchise would be granted to whatever person or
company was able, in the opinion of the Commissioners, to furnish the
best and most reliable service under such conditions as would best
serve the public.

Meeting was called to order by Mayor Pafford, the roll was called
and Commissioners Pafford, Peters, Jackson, Mitchell and Surface
and City Attorney Norris responded.
Propositions for a bus franchise in the City of Salina were
considered.
Commissioner Surface moved that the proposition submitted by
M. Angwin of Pittsburg, Kansas, on behalf of Salina Transit Company,
for a bus franchise in the City of Salina be accepted, with the terms
of a proposed Franchise Ordinance, submitted by him. Motion adopted.
An ordinance was introduced for first reading entitled: "An
ordinance granting to The Salina Transit Company, a corporation; its
successors and assigns the right to maintain and operate over, upon,
along and across certain streets, alleys and public highways in the
City of Salina, Kansas, a bus transportation line with all conveniences
and necessities necessary or useful in the operation of the same,
prescribing the terms and conditions thereof and relating thereto."
On motion, same was referred to the Board of Commissioners.
On motion of Commissioner Peters the Board of Commissioners
adjourned.
