11-03-1952 Minutes395 • COMMISSIONERS PROCEEDINGS, REGULAR MEETING COMMISSIONERS ROOM, SALINA, KANSAS. NOVEMBER 32 1952 Regular Meeting of the Board of Commissioners November 3, 1952. Meeting was called to order by Mayor Barcafer, the roll was called and Commissioners Barcafer, Cobb, Pkice and Ramsey and City Attorney Clark responded. Commissioner King deceased. The minutes of the Regul r Meeting of October 27, 1952 and Board of Zoning Appeals of October 27, 1952 were read and approved as read. Pursuant to notice published in the Salina Journal bids were received for the construction of Ohio Street Storm Sewer (Job 296) as follows: L. W. Rexroad $73,710.00 H.J.Taylor Construction Company 47,061:00 Rhodes Construction Company 54,140.00 Engineer's Estimate $55,105.00 • Commissioner Price moved that contract be awarded to H. J. Taylor Con- struction Company as per bid submitted in the amount of $47,061.00 and that certified checks be returned to unsuccessful bidders. Carried. An ordinance was introduced for first reading entitled: "An ordinance ratifying and confirming a contract with H. J. Taylor Construction Company for the construction of a certain storm sewer a.d drainage in the City of Salina, to be designated as Ohio Street Storm Sewer, and providing for the issuance of temporary notes to pay the cost thereof pending the issuance and sale of bonds." Ordinance was referred to the Board of Commissioners. Pursuant to notice published in the Salina Journal bids were received for curbing, guttering and/or paving improvements provided for in Ordinance Number 5726 (Job 300) as follows: Brown and Brown Construction Company $40,530.00 L. W. Rexroad & Son 39,944.00 H. J. Taylor Construction Company 38,783.00 Engineer's Estimate $39,548.00 Commissioner Cobb moved that contract be awarded to H. J. Taylor Con- struction Company as per bid submitted in the amount of $38,783.00, and that certi- fied checks be returned to unsucceasful bidders. Carried. An ordinance was introduced for first reading entitled: "An ordinance ratifying and confirming a contract with the H. J. Taylor Construction Company for the construction of certain curbing, guttering, paving and grading improvements on certain streets in the City of Salina, and providing for the issuance of tempo- rary notes to pay the cost thereof pending the issuance and sale of bonds." Ordinance was referred to the Board of Commissioners. Mayor appointed J. Earl Wyatt, Wm. F. "Tosser, Jr. and Robert Frederick, to act as appraisers in ascertaining the valuation of certain lots and pieces of ground liable to special assessment for the cost of curbing, guttering and/or paving certain streets provided for in Ordinance Plumber 5726 (Engineer Job 300). Confirmed by Commissioner Ramsey. Pursuant to notice published in the Salina Journal bids were received for the curbing and guttering certain streets provided for in Ordinances Numbered 5634 and 5725 (Engineer Job 295), as follows: Brown and Brown Contruction Company $37059.00 L. W. Rexroad & Son 36,lol.8o H. J.Taylor Construction Company 38,958.00 Engineer's Estimate $372974.50 Commissioner Ramsey moved that contract be awarded to L. W. Rexroad and Son as per bid submitted in the amount of $36,101.80 and that certified checks be returned to unsuccessful bidders. Carried. An ordinance was introduced for first reading entitled: "An ordinance ratifying and confirming a contract with L. W. Rexroad and Son Construction Company for the construction of certain curbing, guttering and grading improvements on cer- tain streets in the City of Salina, and providing for the issuance of temporary • Notes to pay the cost thereof pending the issuance and sale of bonds." Ordinance was referred to the Board of Commissioners. '396 Mayor appointed J. Earl Wyatt, Wm. F. Grosser and Robert Frederick as appraisers to ascertain the valuation of certain lots and pieces of ground liable to special assessment for the cost of curbing and guttering certain streets provided for in Ordinances Numbered 5634 and 5725 (Engineer Job 295) Appointments confirmed by Commissioner Ramsey. Carried. A resolution was introduced and passed relating to street lights. On motion of Commissioner Price the resolution was adopted as read and on its final a doption the roll was called and the following vote was had; Ayes: Barcafer, Cobb, Price and Ramsey (4) Nays: (0) Commissioner King deceased. Mayor approved the resolution and it is Numbered 1351. The above resolution is recorded in full on Page 40 Resolution Book Number 5. An ordinance was introduced and passed entitled: "An ordinance making appro- priation for the payment of certain claims." On motion of Commissioner Price the ordinance was read and adopted by sec- tions and on its final adoption the roll was called and the following vote was had; Ayes: Barcafer, Cobb, Price and Ramsey (4) mays: (0) Commissioner King deceased. Mayor approved the ordinance and it is Numbered A-615. In ordinance was introduced and passed entitled: "An ordinance making appro- priation for the payment of certain claims." On motion of Commissioner Price the ordinance was read and adopted by sec- tions and on its finaladoption the roll was called and the following vote was had; Ayes: Barcafer, Cobb, Price and Ramsey (4) Nays: (0) Commissioner King deceased. Mayor approved the ordinance and it is Numbered A-616. Murray A. Wilson, Engineer, filed Estimate Number 2 in the amount of $55,975.10, to L. C. Peddicord, fbr the construction of Storm Sewers D -A to D -C (Job 152-44). Approved by Cbmmissioner Ramsey. Carried. Murray A. Wilson, Engineer, filed Estimate Number 3 in the amount of $42,882.71, to C. N. McCollum Construction Company, for the construction of Lateral Sewers DH -1 to DH -32 and for Main Sewer DH -A. Approved by Commissioner Ramsey. Carried. Verner C. Smith filed Plat for HLocks 1 and 2 Claflin Addition, Addition to Kansas Hesleyan University. Referred to City Planning Commission. Verner C. Smith filed petitions for sewer, curbing and guttering, water main and opening streets in Block 1 and 2, Claflin Add tion, Add..tion to Kansas Wesleyan University. Referred to City Manager. Petition was presented for the installation of a street light on Bishop Street between Twelfth and Thirteenth Streets. Referred to City Manager. Commissioner Price moved that City Manager request Kansas Power and Light Company to replace old style light fixtures with new fixtures. Carried. Mayor appointed herschel Logan a member of the Library Board to succeed E. -J. Dyck, who resigned. Appointment.confirmed by Commissioner Ramsey. Carried. NOVEMBER 3, 1952 Special Meeting of the Board of Commissioners November 3, 1952. Meeting was called to order by Mayor barcafer, the roll was called and Commissioners Barcafer, Cobb, Price and Ramsey and City Attorney Clark responded. Commissioner King deceased. Meeting was held for the purpose of acting on appraisers reports for the construction of Lateral Sanitary Sewers 278 to 283 inclusive. No protests. Commissioner Price moved that Appraisers Reports for the construction of Lateral Sanitary Sewers Numbered 278 to 283 be approved as read. Motion adopted. • An ordinance was introduced for first reading entitled: "An ordinance relating to and apportioning and levying special assessments on certain lots and pieces of ground in the City of Salina, Kansas, to pay the cost of construction of Lateral Sanitary Sewers Numbered 278, 279, 2802 281, 282 and 283, and relating to and providing for the collection and payment of such assessments." Ordinance was referred to the Board of Commissioners. On motion of Commissioner Price the Board of Commissioners adjourned. Conimissioner King deceased. Hearing on Notice of Appeal filed by J. W. Brooks (Building Application 4389) for the non-compliance with Section 6, Ordinance No. 5549, for Lot 16, Block 1, Beebe's Second Addition, to add to private garage on said lot was taken up by the Board of Commissioners. Commissioner Ramsey moved to approve for no set back. Carried. Notice of Appeal was presented from K. L. Druet, (Building Application 4403) asking said Board of Zoning Appeals to authorize the non-compliance with Section 6 of Ordinance 5549, for Block 7, Claflin Addition, an Addition to the City of Salina, Kansas. Commissioner Ramsey moved to set hearing for November 10th, 1952. On motion of Commissioner Cobb, Board of Zoning Appeals adjourned. City QLerk
