02-02-1953 Minutes421 • COMMISSIONERS PROCEEDINGS, REGULAR 1&ETING COMMISSIONERS ROOM, SALINA, KANSAS. FEBRUARY 2, 1953 Regular Meeting of the Board of Commissioners February 2, 1953. Meeting was called to order by Mayor Barcafer, the roll was called and Commissioners Barcafer, Cobb, Price, Ramsey and 01enger and Assistant City Attorney Yordy responded. City Attorney Clark absent. The minutes of the Regular Meeting of January 26, 1953 were read and approved as read. An ordinance was introduced for second reading entitled: "An ordinance providing for the construction of a certain storm sewer and drainage in the City of Salina, ansas, to be designated as Franklin Street S orm Sewer, and providing for the letting of contract for such construction and fox; the payment of the cost there- of." On motion of Commissioner Ramsey the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Barcafer, Cobb, Price, Ramsey and Wenger (5) Nays: (0) Mayor approved the • ordinance and it is Numbered 5718. An ordinance was introduced for second reading entitled: "An ordinance levy- ing special assessments against certain property to pay the cost of constructing certain water service pipes and sewer connections in certain streets in the City of Salina, Kansas." On motion of Commissioner Price the ordinance was read and adopted by sections and on its finaladoption the roll was called and the following vote was had; Ayes: Barcafer, Cobb, Price, Ramsey and Wenger (5) Nays: (0) Mayor approved the ordinance and it is Numbered 57.9. An ordinance was introduced for second reading entitled: "An ordinance pro- viding for the amendment of Zoning Ordinance Number 5549 and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof." On motion of Commissioner Cobb the ordinance was read and adopted by sections and on its finaladoption the roll was called and the following vote was had; Ayes: Barcafer, Cobb, Price, Ramsey and Wenger (5) Nays: (0) Mayor approved the ordi- nance and it is Numbered 5750. City Engineer filed plans for sidewalks in Sunrise Addition., Commissioner Ramsey moved to accept plans for sidewalks in Sunrise Addition and City Clerk be instructed to advertise for bids to be received up to and including, February 23, 19-)3. Carried. Letter presented from City Planning Commission recommending that alley lying between Second Jtreet and Front Jtreet from Republic Avenue to Wilson Street be • vacated. Commissioner Price moved that report be accepted. Carried. An ordinance was introduced for first reading entitled: "An ordinance pro- viding for the vacation of a certain north south alley located between Second Jtreet and Front Jtreet from the north line of Republic Avenue to the south line of Wilson Street, subject to reservations." Ordinance was referred to the Board of Com- missioners. Letter presented from City Planning Commission recommending that alley lying between Third Street and Fourth Street from the Smoky Hill River to Mulberry Street be vacated. Commissioner Uobb moved that report be accepted. Carried. An ordinance was introduced for first reading entitled: "An ordinance pro- viding for the vacation of a part of a certain north south alley located between Third J reet and Fourth Jtreet from the Smoky Hill River north to the north line of Lot 179+on Fourth Street and Lot 180 on Third Street in the Original Town of Salina, Kansas, subject to reservations." - Ordinance was referred to the Board of Commissioners. City Manager reported on Petition Number 1360 for paving Connecticut Avenue from Gypsum Avenue to Stack Avenue." t. A resolution was introduced for first reading entitled: "A Resolution relat- ing to the paving of Connecticut Avenue from the south line of Gypsum Avenue to the south line of Stack rvenue." resolution was referred to the Board of Commis- sioners. • City Manager reported on the following sewer petitions: 1354 Sewer in alley between Third and Fourth from Lincoln to North, Jones Addition. 1359 Sewer in the 600 Block on North Third Street. b Ifdf.1 An ordinance was introduced for first reading entitled: "An ordinance creating and defining a certain lateral sanitary sewer district in the City of Salina, Kansas, designated as Lateral Sanitary Sewer District Number 294 and providing for the - construction of a lateral sanitary sewer in said Lateral Sanitary Sewer District Number 294, so created, and providing for the payment of the cost thereof and for the levying of special assessments against the property insaid district for the payment of the cost of such construction and or the issuing of bonds to pay the cost thereof." Ordinance was referred to the Board of Commissioners. City Engineer filed Partial Estimate Number 3 in the amount of $11,127.60 to L. W. Rexroad for street improvements, (Job 295)• Approved by Commissioner _ Cobb. Carried. City Engineer filed Final Estimate in the amount of $8,382.33 to H. J. Taylor Construction Company for street improvements, (Job 290). Approved by Commissioner Wenger. Carried. A resolution was introduced entitled: "A Resolution authorizing and pro- viding for the issuance of Temporary Note of the City of Salina, Kansas, in the sum of $8,382.33 to pay a portion of the cost of improving certain streets in the City of Salina, to be designated as Series PT -13 pending the issuance of bonds to pay the cos of said work." On motion of Commissioner Wenger the resolution was adopted as read and on its final adoption the roll was called and the following vote was had; Ayes: Barcafer, Cobb, Price, Ramsey and Wenger (5) Nays: (0) Mayor approved the resolution and it is Numbered 1375• The above resolution is recorded in full on Pages 90 to 92 inclusive, Resolu- tion Book Number 5. City Engineer filed Final Estimate for Street Improvements, Job 290. Commissioner Wenger moved to accept. Carried. Murray A. Udlson, Engineer, filed Final Estimate Number 6 to C. N. McCollum Construction Company, in the amount of $21,895.08, for Main Sanitary and Lateral — Sanitary Sewers DH -A and DH -1 to DH -32 inclusive, Job 151-81.2.. Approved by Commissioner Price. Carried. A resolution was introduced entitled: "A resolution authorizing and pro- viding for the issuance of Temporary Note of the City of Salina, Kansas, in the sum of $21,895.08 to pay a portion of the cost of certain sewer improvements in the City of Salina to be designated as ST -10 pending the issuance of bonds to pay the cost of said work." On motion of Commissioner Price the resolution was adopted as read and on its final adoption the roll was called and the following vote was had; Ayes: Barcafer, Cobb, Price, Ramsey and Wenger. (5) Nays: (0) Mayor approved the red6lution and it is Numbered 1376. The above resolution is recorded in full on Pages 93 to 95 inclusive, Resolu- tion Book Number 5. Murray A. X1son, Engineer, filed kinal Estimate for Main Sanitary and Lateral Sanitary Sewers DHA and DH -1 to DH -32 inclusive. Commissioner Price moved to accept. Carried. Murray A. Wilson, Engineer, filed Estimate Number 5 in the amount of $50,225.22 to L. C. Peddicord for the construction of storm Sewers D -A to D -D, Job 152-44. Approved by Commissioner Price. Carried. A resolution was introduced entitled: "A resolution authorizing and pro- viding for the issuance of temporary note of the City of "alinap Kansas, in the sum of $50,225.22 to pay a portion of the cost of certain stwer improvements in the City of Salina to be designated as ST -11 pending the issuance of bonds to pay the cost of said work." On motion of Commissioner Price the resolution was adopted as read and on its final adoption the roll was called and the following vote was had; Ayes: Barcafer, Cobb, Price, "amsey and Wenger (5) Nays: (01 Mayor approved the resolution and it is Numbered 1377. Petition was presented for the curbing and guttering the North side of Cloud from Eleventh Street to Pershing Street. Petition was referred to the City Manager. Petition presented to rezone Dots 18 and 20 on Kirwin Avenue, Grounds of - Kansas Wesleyan University Addition from Zone "A" to Zone "D". Petitnn was referred to the City Planning Commission. • Trust Deed with a deposit of 6100.00 was presented from Charles L. Ong for the perpetual care of Lot 11, Block 12, in the Gypsum Hill Cemetery. Approved by Commissioner Price. Carried. Seven taxicab applications presented from Red Top Cab Company. Approved by Commissioner Wenger. Carried. An ordinance was introduced and passed entitled: "An ordinance making appro- priation for the payment of certain claims." On motion of Commissioner Price the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Barcafer, Cobb, Price, Ramsey and Wenger (5) Nays: (0) Mayor approved the ordinance and it is Numbered A-629. An ordinance was introduced and passed entitled: "An ordinance making appro- priation for the payment of certain claims." On motion of Commissioner Cobb the ordinance was read and adopted by sections and on its final adoption the roll was called and the following votewas had; Ayes: Barcafer, Cobb, Price, Ramsey and Wenger (5) Nays: (0) Mayor approved the • ordinance and it is Numbered A-630. Commissioner Cobb moved that an ordinance be introduced for first reading, to place on General City Election Ballot, April 7th, 1953, the proposition of Water Softener and Treatment Plant for the City of Salina, Kansas Carried. Meeting was held for the purpose of acting on the appraisers reports for the construction of the following sewers: Main Sewer DH -A Lateral Sanitary Sewers DH -1 to DH -32 Lateral Sanitary Sewers DH -33 to DH -41 No protests received on the above appraisers reports. Commissioner Cobb moved to accept Appraisers Reports. Carried. An ordinance was introduced for first reading entitled: "An ordinance relating to and apportioning and levying special assessments on certain lots and pieces of ground in the City of Salina, Kansas, to pay the cost of construction of lateral sanitary sewers in Lateral Sanitary Sewer Districts Numbered DH -33 to DH -410 inclusive, and relating to and providing for the collection and payment of such assessments." Ordinance was referred to the Board of Commissioners. An ordinance was introduced for first reading entitled: "An ordinance relating to and apportioning and levying special assessments on certain lots and pieces of ground in the City of Salina, Kansas, to pay the cost of construction of lateral sanitary sewers in Lateral Sanitary Sewer Districts Numbered DH -1 to DH -32 inclusive, and relating to and providing for the collection and payment of such assessments." Ordinance was referred to the Board of Commissioners. An ordinance was introduced for first reading entitled: "An ordinance relating to and apportioning and levying special assessments on certain lots and pieces of ground in the City of Salina, Kansas, to pay the cost of construction of mainsanitary sewer in Vain Sanitary Sewer District DH -A, and relating to and providing for the collection and payment of such assessments."
