MAY 1, 1950 Regular Meeting of the Board of Commissioners May 1, 1950. keeting was called to order by Iviayor King, the roll was called and Commissioners King. Price, Ramsey, Stephenson and Webb and City Attorney Clark responded. The minutes of the Regular tweeting of April 24, 1950 were read and approved as read. Representatives of the International biiilling Company appeared before the Board of Commissioners and presented their side of the reason they are against the reopening a part of Seventh Street as filed by the Robinson Ldlling Company petition. Commissioner Ramsey moved that petition be referred to agenda for May 8th, 1950 for decision. Carried. An ordinance was introduced for second reading entitled: "An ordinance relating to and apportioning and levying special assessments on certain lots and )feces of ground in the City of Salina, Kansas, to pay the cost of constructing lateral sanitary sewers in Lateral Sanitary Sewer Districts Numbered 216 and 217, • and relating to and providing for the collection and payment of such assessments." On motion of Commissioner trice the ordinance was read and adopted by sec- tions and on its final adoption the roll was called and the following vote was had; Ayes: King, Price, Ramsey, Stephenson and Webb (5) Nays: (0) laiayor approved the ordinance and it is Numbered 5461. An ordinance was introduced for second reading entitled: "An ordinance relating to and apportioning and levying special assessments on certain lots and pieces of ground in the City of Salina, Kansas, to pay the cost of construction of 1uain Sewer liumber "V" and relating to and providing for the collection and payment of such assessments." On motion of Commissioner Webb the ordinance was read and adopted by sec- tions and on its final adoption the roll was called and the following vote was had; Ayes: King, Price, Ramsey, Stephenson and Webb (5) Nays (0) Mayor approved the ordinance and it is numbered 5462. An ordinance was introduced for second reading entitled: "An orclinance creating and defining a certain lateral sanitary sewer district in the City of Salina, Kansas, designated as Lateral Sanitary Sewer District Number 250, and providing for the construction of a lateral sanitary sewer in said Lateral Sanitary Sewer District Number 250, so created, and providing for the payment of the cost thereof and for the levying of special assessments against the property in said district for the payment of the cost of such construction of and for the issuing of bonds to pay the cost thereof." On motion of Commissioner Price the ordinance was read and adopted by sec- tions and on its final adoption the roll was called and the following vote was had; • Ayes: King, Price, Ramsey, Stephenson and Webb (5) Nays: l0) layor approved the ordinance and it is Numbered 5463• An ordinance was introduced for second reading entitled: "An ordinance pro- viding for the amendment of Section 13-703 Revised Ordinances of the City of Salina, 1948, and providing for the repeal of said section." On motion of Commissioner Webb the ordinance was read and adopted by sec- tions and on its final adoption the roll was called and the following vote was had; Ayes: King, Price, Ramsey, Stephenson and Webb (5) Nays: (0) Mayor approved the ordinance and it is Numbered 5464. An ordinance was introduced for second reading entitled: "An ordinance providing for the sub -division of the Fifth Ward in the City of Salina into voting precincts and providing for the amendment and repeal of Sections 27-119, 27-120, 27-121 ad 27-122, Revised Ordinances of the City of Salina, 1948." On motion of Commissioner Ramsey the ordinance was read and adopted by sec- tions and on its final adoption the roll was called and the following vote was had; Ayes: King, Price, Ramsey, Stephenson and 'Hebb (5) Nays: (0) luiayor approved the ordinance and it is Numbered 5465. No persons appeared to protest against the rezoning of South 1/2 of Lots 8 and 9, Block 1, Fruitland Addition from "A" Residential to "C" Commercial. 41 1 • 1 An ordinance was introduced for first reading entitled: "An ordinance providing for the inclusion of certain lands in the City of Salina, Kansas, in the "C" Commercial District as that district is defined by Section 5 of Ordinance Number 3188 and the amendments thereto and providing for the proper use thereof." Ordinance was referred to the Board of Commissioners. Wilson and Company, Engineers, filed Estimate Number 12 in the amount of $14,614.37 to Brovrn L Brown, Inc. and Johnson Bros. Construction Company for Sewage Disposal job. On motion of Commissioner Price approved by the Board of Commission- ers. Notion adopted. Chas. W. Shaver, Architect, filed Estimate Number 2 in the amount of $27,090.00 to Busboom and Rauh for erection of Fire Station. On motion of Commissioner Ramsey approved by the Board of Commissioners. Notion adopted. Application for Cereal Malt Beverage License was presented from Gilbert Wm. Dunbar, d/b/a North Santa Fe Recreation at 806 North Santa Fe Avenue. Commissioner Price moved that application be approved and license granted. itiiotion_:.dopted. An ordinance was introduced for first reading entitled: "An ordinance provid- ing for the paving and grading and for the curbing, guttering and paving of certain streets in the City of Salina, Kansas described as follows: for the paving and grading of Front Street from the south line of Crawford Avenue to the north line of Republic i.venue; and for the curbing, guttering, paving and grading of Claflin Avenue from the west line of Eleventh Street tothe east line of Pershing Street; and for the curb- ing, guttering, paving and grading of Twelfth Street from the south line of Broadway Boulevard to the south line of Grand Avenue, and providing for the payment of the cost thereof, how the same shall be assessed and the manner of payment of the cost thereof." Ordinance was referred to the Board of Commissioners. An ordinance was introduced for first reading entitled: "An ordinance pro- viding for the curbing, guttering and grading of Beloit Avenue from the west line of Quincy Street west approximately 300 feet; Connecticut Avenue from the north line of Gypsum Avenue to the south line of Stapler Avenue; Delaware Avenue from the north line of Gypsum Avenue tothe south line of Stapler Avenue; South side of Hamilton Aveue from the center line of Eleventh Street to the center line of Twelfth Street; Marsh Avenub from the center line of Eleventh Street to ttie center line of Twelfth Street; Indiana Avenue from the center line of Gypsum Avenue to the south line of Stapler Avenue; Pacif- ic Avenue from the center line of Eleventh Street to the center line of Twelfth Street; Stapler Avenue from the center line of Delaware Avenue tothe east line of Indiana Aven- ue; Twelfth Street from the center line of Pacific Avenue to the center lire of Harsh Street; East side of Twelfth Street from the center line of Harsh Avenue to the center line of Hamilton Avenue; and the north side of Wilson Street from the west line of Front Street tothe east line of Third Street and on the south side of Wilson Street from the west line of Front Street to a point 125 feet west of the west line of Second Street; and providing for the payment of the cost thereof and how the same shall be assessed and the manner of payment thereof." Ordinance was referred to the Board of Commissioners. Cona issioner Ramsey made motion to charge City $45-00 per year Hydrant rental as per plans on Softener, January 1, 1951. On roll call the following vote was had; Ayes: Ayes: Ramsey and Webb (2) :Nays: King, Price and Stephenson (3) A letter was presented from the City Planning Commission recommending that Lots 25, 26, 27, 28, 29 and 30, Block 5, in Stack Place be rezoned from Class "A" Residential to Class "B" Residential. Commissioner Webb moved to accept recommenda- tion and City Clerk be instructed to give thirty days notice as provided by law. Notion adopted. Letter was presented from CLty Planning Commission recommending the vacation of a strip of ground running north and south along the east side of Fourth Street from the North line of Republic Avenue, north tothe south line of Lot 1, Block 3, Hutchin- son's Addition, said width being approximately 13 feet. An ordinance was introduced for first reading entitled: "An ordinance provid- ing for the vacation of a portion of a certain street in the City of Salina, Kansas." Ordinance was referred to the Board of Commissioners. Letter was presented from City Planning Commission recommending that Aorth 72 feet of Lots 1, 2 and 3 in Block 5, Elmdale Addition not be rezoned to "C" Commercial. Commissioner Stephenson moved to accept recommendation. 1�iotion adopted. Letter was presented from City Planning Commission recommending that Lots 5, 7 and 9, Block 8, Leavenworth Addition riot be rezoned to "C" Commercial. Commissioner Price moved to accept recommendation. Notion adopted. 1u.ayor King appointed ivorbert Skelley, G. N.
