Meeting was called to order by Mayor Hawkes, the roll was called and Commissioners Hawkes, Exline, Lake, Ramsey and Wenger and City Attorney Barta responded. i The minutes of the Regular Meeting of August 7th, 1956; and Meeting of Board of Zoning Appeals of August 7th, 195,j were read and approved as read. Pursuant to Notice published in the official City paper bids were received for the improving of Parking Lot Number four on Fifth Street between Iron Avenue and Walnut Street as follows: 1 0. D. Wilmoth $153117.50 Brown & Brown, Inc. $173590.00 L. W. Rexroad $17,645.00 Commissioner Exline moved that contract be awarded to O.D. Wilmoth as per bid submitted in the amount of $15,117.50,and checks returned to unsuccessful bidders. Carried. Mr. F.2. Reaves appeared before the Board of Commissioners regarding addi- tions to Traco frailer Court. City Attorney to bring File and Facts on case at the next meeting. An ordinance was introduced for second reading entitled: "An ordinance making a levy of taxes for general revenue and other purposes by the City of Salina, Kansas, for the year 1957. " I On motion of Commissioner Ramsey the ordinance was read and adopted by sec- tions and on its final adoption the roll was called and the following vote was had; Ayes: Hawkes, Exline, Lake, Ramsey and Wenger (5) Nays: (0) Mayor approved the ordinance and it is Numbered 6081. An ordinance was introduced for second reading entitled: "An ordinance levy- ing special assessments against certain property to pay the cost of cutting weeds on certain lots and parts of lots, and the parkways abutting thereon in the City of Salina, Kansas." On motion of Commissioner Wenger the ordinance was read and adopted as read and on its final adoption the roll was called and the following vote was had; Ayes: Hawkes, Exline, Lake, Ramsey and yenger (5) Nays: (0) Mayor approved the ordinance and it is Numbered 6082. An ordinance was introduced for second reading entitled: "An ordinance ratifying and confirming a contract with Brown and Brown, Inc., for the construction of certain paving and grading improvements on certain streets in the City of Salina, Kansas, and providing for the issuance of temporary notes to pay the cost thereof • pending the issuance and sale of bonds." On motion of Commissioner Exline the ordinance was read and adopted by sections and on its final adoption the roil was called and the following vote was.had; Ayes: Hawkes, Exline, Lake, Ramsey and Wenger (5) Nays: (0) Mayor approved the ordinance and it is Numbered 6085. An ordinance was introduced for second reading entitled: "An ordinance ratifying and confirming a contract with the 0. On motion of Commissioner namsey the ordinance was read and adopted by sec- tions and on its final adoption the roll was called and the following vote was had; Ayes: Hawkes, Exline, Ramsey, Lake and Vienger (5) Nays: (0) Mayor approved the ordinance and it is Numbered 6084. An ordinance was introduced for second reading entitled: "An ordinance pro- viding for the amendment of Zoning Ordinance 5549 and the Zoning District Map therein and thereby adopted and providing for the rezonin of certain property within the City and prescribing the proper uses thereof." On motion of Commissioner Exline the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Hawkes, Exline, Lake, Ramsey and Wenger (5) Nays: (0) Mayor approved the ordi- nance and it is Numbered 6085. a • 1 • 1 C 1 • An ordinance was introduced for second reading entitled: "An ordinance defin- ing "milk" and certain "Milk products", 111w1ilk producer", "Pasteurization", etc., i prohibiting the sale of adulterated milk and misbranded milk and milk products, requiring permits for the sale of milk and milk products; regulating the inspection of dairy farms and milk plants, and the examination, grading, labeling, pasteurization, ! regrading, distribution, and sale of milk and milk products; providing for the pub- lishing of milk grades, the construction of future dairies and milk plants, the enforcement of this ordinance, the fixing of penalties, and repealing Article 3, Section 11-301 through 11-316, Revised Ordinances of the City of Galina, Kansas, 1948." On motion of Commissioner Lake the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Hawkes, Exline, Lake, Ramsey and Wenger (5) Nays: (0) Mayor approved the ordinance and it is Numbered 6086. A resolution was introduced and passed entitled: "A "esolutiondeclaring the policy of the Board of Commissioners of the City of Salina, Kansas, regarding Coronado Courts, Kans. 14051." On motion of Commissioner Ramsey the resolution was adopted as read and on its final adoption the roll was called and the following vote was had; Ayes: Hawkes, Exline, Lake, Ramsey and Wenger (5)Nays: (0) Mayor approved the resolution and it is Numbered 1739." A resolution was introduced and passed entitled: "A Resolution providing for the extension of an authorized "C" District Emergency use of certain property under the terms and conditions of Ordinance No. 5882 for one (1) year, from September 0 1, 1956.►r On motion of Commissioner Exline the resolution was adopted as read and on its final adoption the roll was called and the following vote was had; Ayes: Hawkes, i Exline, Lake, Ramsey and Wenger (5) Nays: (0) Mayor approved the resolution and it is Numbered 1740. Pursuant to Notice published in the Salina Journal bids were received for a Boiler at the Police Station, as follows: City Plumbing Oompan y $1560.00 Holm Plumbing Company $1.826.00 Commissioner Wenger moved that contract be awarded to City Plumbing Company as per bid submitted in the amount of $1560.00 and check returned to unsuccessful bidder. Carried. Petition presented for the installation of a street light in the alley that divides the 200 Block and 300 Block on South Eleventh Street and South Twelfth Street. Commissioner Lake moved to instruct City Manager to have said light installed. Carried. Petition presented fort he rezoning of South one-half of Lot One, Surveyor's Plat 12, (1043 East Iron Avenue from "A" Residential to "D" Local Business. Petition referred to the City Planning Commission. i City Engineer filed Final Estinato in the amount of $31,237.05 to H. J. Taylor Contruction Company for Job 340. Approved by Commissioner Wenger. Carried. AL resol:iition lwEis -introduced fors first reading entitled: "A Resolution relating to the paving and grading of Sherman Street with concrete, twenty-eight (28) feet wide toe of gutter to toe of gutter, from the north line of Franklin Street to the south line of Wilson Street." Resolution was referred to the Board of Commissioners., A resolution was introduced for first reading entitled: "A "esolution relating to the paving and grading of Eleventh Street with concrete, twenty-eight (28) feet wide toe of gutter to toe of gutter from the south line of Jewell Avenue to the north line of Kirwin Avenue." Resolution was referred to the Board of Commissioners. An ordinance was introduced for first reading entitled: "An ordinance creat- ing and defining a certain laterals anitary sewer district in the City of Salina, --- Kansas, designated as Lateral Sanitary Sewer District Number 349 and providing for i the construction of a lateral sanitary sewer insaid Lateral Sanitary Sewer District Number 349 so created, and providing for the payment of the cost thereof and for the levying of special assessments against the property insaid district for the payment for .the cost of such construction andfor the issuing of bonds to pay the cost thereof." Ordinance was referred to the Board of Commissioners. On motion of Commissioner Wenger the Board of 'Commissioners adjourned. Hearing was held on Appeal Notice filed by Wm. Schmidt for non-compliance with the Side Yard Requirements of Ordinance No. 5549 for Lots 34 and 36, Block 61 in North Park Addition to Salina, Kansas. No protests. A resolution was introduced and passed entitled: "A Resolution relating to the authorization of non-compliance with the Side Yard Requiremen s of Ordinance 5549 for Lots 34 and 36, Block 61 in North Park Addition to the City of Salina, Saline County, Kansas." On motion of Commissioner Ramsey the resolution was adopted as, read and on - its final adoption the roll was called and the following vote was had; Ayes: Hawkes, Exline, Lake, Ramsey and Wenger (5) Nays: (0) Mayor approved the Reso- lution and it is Numbered 1741..
