08-07-1956 MinutesCOMMISSIONERS PROCEEDINGS, REGULAR MEETING COMMISSIONERS ROOM, SAUNA, KANSAS. AUGUST 7, 1956 Regular Meeting of the Board of Commissioners August 7th, 1956. Meeting was called to order by Mayor Hawkes, the roll was called and the following responded: Commissioners Hawkes, Exline, Lake, Ramsey and Wenger and City Attorney Barta. The minutes of the Regular Meeting of July 31, 195rp; and Board of Zoning Appeals of July 31, 1956 were read and approved as read. An ordinance was read for second reading entitled: "An ordinance providing for the inclusion of certain land within the corporate limits of the City of Salina, Knsas, prescribing the corporate limits of said City, and repealing Section 2 of Ordinance No. 6022." On motion of Commissioner Exline the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Hawkes, Exl.ine, Lake, Ramsey and ��enger (5) Nays: (0) mayor approved the ordinance and it is Numbered 6080. An ordinance was introduced and passed entitled: "An ordinance making an appropriation for the payment of certain claims." On motion of Commissioner Wender the ordinance was read and adopted by sections and on its final adoption the roll was called and the: following vote was had; Ayes: Hawkes, Exline, Lake, Ramsey and Wenger (5) Nays: (0) Mayor approved the ordinance and it is Numbered A-813. An ordinance was introduced and read entitled: "An ordinance making an appropriation for the payment of certain claims." On motion of Commissioner Ramsey the ordinance was read and adopted by sec- tions and on its final adoption the roll was called and the following vote was had; Ayes: Hawkes, Exline, approved the Lake, Ramsey and �Ienger (5) Nays: (0) Mayor ordinance and it is Numbered A-8111. y y Pursuant to Notice published in tte official City paper bids were received for curbing, guttering and paving certain streets (Job 3115), as follows: Brown and Brown $168,768.00 0. D. Wilmoth $150,053.00 L. W. Rexroad $151,826.00 Engineer's Estimate $172,390.00 Commissioner Wenger moved that contract be awarded to O.D. Wilmoth as per bid submitted in the sum of $150,053.00, and checks returned to unsuccessful bidders. Carried. Mayor appointed J. Earl Wyatt, Wm. F. Grosser, Jr., and Robert Frederick to act as appraisers for Job 345• Approved by Commissioner Exline. Carried. An ordinance was introduced for first reading entitled: "An ordinance ratifying and confirming a contract with the O.D. Wilmoth Construction Company for the construction of certain curbing, guttering, paving and grading improvements on certain streets in the City of Salina Kansas and temporary providing for the issuance of { p ary notes to pay the cost thereof pmding ti -e issuance and sale of bonds." Ordinance was referred to the Board of Commissioners. Pursuant to notice published in the official City Paper bids were received for curbing, guttering and two-inch Hot Lax Paving, certain streets (Job 347) as follows: Broce and Smith $199,312.50 Nall Brothers $187,993.50 Rhoades Construction Company $201,1110.50 Brown and Brown $179,542.50 Engineer's Estimate $190,705.00 Commissioner Ramsey moved that contract be awarded to Brown and Brown as per bid submitted in the sum of $.179,5112.50, and checks returned to unsuccessful bidcbrs. No persons appeared to protest the rezoning of Lots 3, 4, 5, 6, 7, 8, 9 and 10, Block 8, of the Replat of Lots 1 to 15, Garden Home Addition to the City of Salina, Kansas, from Zone "A" to Zone "C". An ordinance was introduced for first reading entitled: "An ordinance pro- viding for the amendment of Zoning Ordinance 5549 and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof." Ordinance was referred to the i Board of Commissioners. i Letter received from the City Planning Commission recommending that Petition 1788 submitted by the Dodge Investment Company, for the rezoning of Lot 30, Claflin A enue, Addition to Grounds of Kansas Wesleyan University, be rezoned from "A" to be approved. Commissioner Ramsey moved to accept recommendation and City Clerk instructed to give thirty days Notice. Carried. Letter received from City Planning Commission recommending that Petition 1795 submitted by Walter A. Culley and Glenn Merriman, for the closing of the 14 -foot alley from Montrose Avenue to IvIssouri Pacific Railroad Right-ofiay between Lots 17 and 18, Block "B" Morrison's Fourth Addition, Salina, Kansas, be approved. Commissioner Wenger moved to table for Joint Meeting with City Planning Commis- sion.. Carried. City Manager reported on the following petitions: 1792 For Sanitary Sewer in Block 19, E. M. I. Addition from Otis Avenue to Lot 7, Block 9, E. M. I. Addition. Referred to City Engineer for description. 1791 Concrete paving of Eleventh Street from Jewell to Kirwin. Referred to City Engineer for description. 1789 Concrete paving on Sherman between Franklin and Wilson. Referred to City Engineer for description. Hearing was held on 1957 Budget. No protests. An ordinance was introduced for first reading entitled: "An ordinance making a levy of taxes for general revenue and other purposes by the City of Salina, Kansas, for the year 1957•" Ordinance was referred to the Board of Commissioners. An ordinance was introduced for first reading entitle d: "An ordinance levying special assessments against certain property to pay the cost of cutting weeds on cer- tain lots and parts of lots, and the parkways abutting thereon in the City of Salina, Kansas." Ordinance was referred to the Board of Commissioners. An ordinance was introduced for first reading entitled: "An ordinance defining "milk" and certain "Milk Products", "milk producer", "pasteurization", etc., prohibit- ing the sale of adulterated and misbranded milk and milk products, requiring permits for the sale of milk products; regulating the inspection of dairy farms and milk plants, and the examination, grading, labeling, pasteurization, regrading, distribution and sale of milk and milk products; providingfbr the enforcement of this ordinance, the fixing of penalties, and repealing Article 3, Section 11-301 through 11-316, Revised Ordinances of the City of Salina, Kansas, 1948." Ordinance was referred to the Board of Commissioners. Plans for Fire Station Number 2 approved, subject to checking by Fire Chief, J. E. i'ravis and City Engineer, H. F. Harper. Commissioner Ramsey moved to accept and set date of September 4th, 1956, at four o'clock P. M. to receive bids. Carried. The following petitions w ere presented and referred to the City Manager: Street Light in the 600 Block on South Fourth Street. Protesting the paving of Lots 2-4, Block 3, Pacific Addition and Lots 6-8 Block 3, Pacific Addition. i The following petitions were presented and referred to the City Planning Commission: ' -- For extension of Zone "E" to include Lots 5, 6 and 7 on Ninth Street in Phillips Addition to the City of Salina, Kansas. For rezoning part of Tract 1, Plat 51 from "A" to "D" (Local Business). City Engineer filed the following estimates: i Number 1 in the amount of $1360.89 to O.D. Wilmoth Construction Company --- for Lateral Sanitary Sewer No. 346 (Job 334-A). Approved by Commissioner Wenger. Carried. i Number 1 in the amount of $9,981.25 to McCollum Construction Company, for Lateral Sanitary Sewers 347 and 348 (Job 344). Approved by Commissioner Wenger, Carried. Number 1 in the amount of $12,324.75 to Young Construction Company for Sanitary Sewers (Job 339)• Approved by Commissioner Wenger. Carried. Wilson and Company, Engineers, filed Estimate No. 7 in the amount of $24,023.12 to Jarvis Construction Company, for Water Treatment Plant. Approved by Commissioner Wenger. Carried. Meeting was called to order by Mayor Hawkes, the roll was called and Commissioners Hawkes, Exline, Lake, Ramsey and Wenger and City Attorney Barta responded. i Notice of Hearing filed by Floyd L. Miller, regarding Front Setback Require- ments for Lot 14, Rush Street, in Pershing Heights Addition to the City of Salina, Kansas was taken up by the Board of Zoning Appeals. No protests. A resolution was introduced and passed entitled: "A "esolution relating to the authorization of non-compliance with the Front Setback Requirements of Section 6, Paragraph "C" of Ordinance Number 5549 for Lot Fourteen (14) on Rush Street in Persh- ing Heights Addition to the City of Salina, Saline County, Kansas." • On motion of Commissioner namsey the resolution was adopted as read and on its final adoption the roll was called and the following vote was had; Ayes: Hawkes, Exline, Lake, Ramsey and Vienger (5) Nays: (0) Mayor approved the Resolution and it is Numbered 1738. Schmidt for addition to dwelling located on Lots 34-36, Block 6, North Park Addition, Salina, Kansas was presented. Commissioner Exline mored to advertise for Hearing, August 11th, 1956 at four o'clock P. M. Carried. On motion of Commissioner Exline, Board of Zoning Appeals adjourned. The minutes of the Regular Meeting of August 7th2 1956; and Meeting of Board of Zoning Appeals of August 7th, 195 were read and approved as read.
