08-02-1955 Minutes• COMMISSIONERS PROCEEDINGS, REGULAR MEETING. COMMISSIONERS ROOM, SALINA, KANSAS. AUGUST 2, 1955 Regular Meeting of the Board of Commissioners August 2, 1955• Meeting was called to order by Mayor Lake, the roll was called and Commissioners Lake, Exline, Hawkes, Ramsey and Wenger and City Attorney Clark responded. The minutes of the Regular Meeting of July 26, 1955 wereread and approved as read. An ordinance was introduced and passed entitled: "An ordinance making an 1 appropriation for the payment of certain claims." On motion of Cl ommissioner Wenger the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Lake, Exline, Hawkes, Ramsey and Wenger (5) Nays: (0) Mayor approved the ordinance and it is Numbered A-763. • An ordinance was introduced and read entitled: "An ordinance making an appropriation for the payment of certain claims." On motion of Commissioner Hawkes the ordinance wasread and adopted by sections and on its final adoption t.e roll was called and the following vote was had: j Ayes: Lake, byline, Hawkes, Ramsey and Wenger (5) Nays: (0) Mayor approved the ordinance and it is Numbered A-761. A resolution was introduced for second reading entitled: "A Resolution relating to the paving and grading of Ellsworth Avenues twenty-eight (28) feet wide from toe of gutter to toe of gutter, -two inch hotjasphalt mix over a six (6) inch crushed rock base, from the east side of Roach S reet to the west 4. side of Lewis Avenue." On motion of Commissioner Ramsey the resolution was adopted as read and on its final adoption the roll was called and the following vote was had; Ayes: Lake, Exline, Hawkes, Ramsey and Wenger (5) Nays: (0) Mayor approved the reso- lution and it is Numbered 1586. The above resolution is recorded in full on Page 389 Resolution Book 5. A resolution was introduced for second reading entitled: "A Resolution relating to the paving and grading of the alley first east of Twelfth Street, twenty (20) feet wide, with concrete, fron the Horth line of Elm Street to the South line of Bishop Street." On motion of Commissioner Ramsey the resolution was adopted as r ead and on its final adoption the roll was called and the following vote was had; Ayes: Lake, byline, Hawkes, Ramsey and Wenger (5) Nays-:. (0) Mayor approved the resolution • and it is Numbered 1587. The abbve'resolution is recorded in full on Page 390 Resolution Book 5. X resolution was introduced and passed entitled: "A Resolution providing for the extension of an authorized "C" District Emergency useof certain property under the terms and conditions of Ordinance Number 5882, for one (1) year after Sep- tember 1, 1955." (Kansas Wesleyan University Housing Units.) On motion of Commissioner Exlinethe resolution was adopted as read and on its final adoption the roll was called and the following vote was had; Ayes: Lake, Exline, Hawkes, Ramsey and Wenger (5) Nays: (0) Mayor approved the resolution and it is Numbered 1588. City Manager reported on the following petitions: 1632 Paving Duvall Street from Crawford to Haven. 1633 Curb and gutter triangular plot bounded by Banker's Addition to the north; U. S. Highway 81 on the wast and Block 8, Sunset Manor Addition on the south in Salina, Kansas. 1634 Sanitary Sewer to serve Lots 1 to 11, inclusive, in Mock 4, Golden • Belt Sub -Division, Salina, Kansas. 1638 Paving McAdams Road from Lewis Avenue to Pearl Street. An ordinance was introduced for second reading entitled: "An ordinance providing for the amendment of Zoning Ordinance 5549 and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain propefty within the City and prescribing the proper uses thereof." On motion of Commissioner Exline the ordinance was read and adopted by sec- tions and on its final adoption the roll was called and the following vote was had; Lake, Exline, Hawkes, Ramsey and Wenger (5) Nays: (0) Mayor approved the ordinance and it is Numbered 5981. An ordinance was introduced for second reading entitled: "An ordinance pro- viding for the curbing, guttering, paving and grading with two-inch hot mixed asphal- tic concrete over a six inch rock stabilized base, certain streets in the City of Sa- lina, Kansas, towit: The paving and grading of Charles Street , twenty-eight (28) feet wide from toe of gutter to toe of gutter with two 2 inch hot asphalt mix over six (6) inch rock base, from the west line of Eleventh Street to the east line of Twelfth Street; Paving and grading of Claflin Avenue to a width of twenty-eight (28) feet from toe of gutter to toe of gutter, from the east line of Roach Seet to the west line of Lewis Avenue , with six (6) inch crushed rock base and twtr(2) inch hot asphalt mix; Paving and grading to a width of twenty-eight (28) feet from toe of gutter to toe of gutter, with crushed rock base and two-inch hot asphalt mix, Fairview Street from the east line of Sherman Street to the west line of Eleventh Street; aving and grading of Illinois Street_, twenty-eight (28) feet wide from toe of gutter to toe of gutter, with two 2 inch hot asphalt mix over six (6) inch rock base, from the east line of Merrill Street to the east line of Hancock Street; Paving and grading of Roach Street, with two (2) inch hot mix asphalt over a six (6) inch rock base, from the north line of KirHrin Avenue to the south line of Claflin Avenue; Paving and grading of Tenth Street with two (2) inch hot asphalt mix over six (6) inch crushed rock base, from the south line of Antrim Avenue to the north line of Inez Avenue; Paving and grading Upper Mill hihts Drive twenty-seven (27) feet wide from back of header to back of header, with two � inch hot asphalt on six (6) inch rock base, from Greeley Avenue to Greeley Avenue; Curbing, guttering, paving and grading of Willow Drive , thirty-three (33) feet back of curb to back of curb, with two (2) inch hot asphalt over six (6) inch rock base, from a line on the south line of Willow Court extended across Willow Drive to a line crossing Willow Drive from the south-east corner of Lot 45, Block 6, Edgemere Addition to the south-west corner of Lot 13, Block 51 Edgemere Addition, and providing for the payment of the cost t hereof, how the same shall be assessed, nd the manner of the payment of the cost thereof." On motion of Commissioner Wenger the ordinance wasread and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Lake, Exline, Hawkes, Ramsey and Wenger (5) Nays: (0) Mayor approved the ord- nance and it is Numbered 5982. A resolution was introduced for first reading entitled: "A Resolution relating to the paving and grading of McAdams Road , twenty-eight (28) feet wide, from toe of gutter to toe of gutter, withconcrete, from the west line of Pearl Avenue to the east line of Legis Avenue." Resolution was referred to the Board of Commissioners. A resolution was introduced for first reading entitled: "A Resolution relat- ing to the paving and grading of Duvall Street twenty-eight (28) feet wide, from toe of gutter to toe of gutter, with concrete, from the north line of Crawford Avenue to the north line of Haven Avenue." Resolution was referred to the Board of Commissioners. A resolution was introduced for first reading entitled: "A Resolution relating to the curbing, guttering and grading of the West side of Broad y Boulevard beginning on the north, directly eaSt of the South-east corner of Bankers Addition, thence south 318.2 feet more or less to a point directly east of the North-east corner of Block 82 Sunset Manor Addition." Resolution was referred to the Board of Commissioners. A petition was presented from Busboom and Rauh, fro the rezoning from "A" to the use authorized by Section 13, Sub -Division 13 of Ordinance 5549 of that portion of the North Half (14/2) of the Southwest Quarter (SW/4) of Section 14, Township 14, South, Range 3 West. (See original petition for detailed description) Petition referred to the City Planning Commission. A petition was presented from Busboom and Rauh for the rezoning from "A" to tIF" of that certain tract of land lying and situate in the North Half (N/2) of the South-West Quarter (Sid/4) of Section 14, Township 14 South, Range 3 West of the 6th P. M. in Saline County, Kansas. (See original petition for detailed description) Petition referred to City Planning Commission. A petition was presented"from Salina Concrete Products Company to vacate - South 10 feet of Park Street from Missouri Pacific Right-of-way to Chicago Street. Petition referred to t he City Planning Commission. • The following petitions were presented and referred to the City Manager: Paving Armory Road. Paving NEAdams Road from Lewis to Pearl. Paving Pb flips Street from Crawford to Charles. Cemetery Trust Deed, with a deposit of Seventy -Five Dollars ($75.00) was presented from William Walker, for perpetual care of Lot 12, Block 24 (South 1/2) in the Gypsum Hill Cemtery, Salina, Kansas. Approved by Commissioner Wenger. Carried. City Engineer filed Final Estimate in the amount of $1.8,516.80 to H. J. Taylor Construction Company for Job 326. Approved by Commissioner Wenger. Carried. City Engineer filed Estimate Number 3 in the amount of $16,553.34 to Brown and Brown Construction Company for Job 324. Approved by Commissioner Wenger. Carried. City Engineer filed Estimate Number 1 in the amount of $6803,62 to H. J. Tay-- • for Construction Company for Engineer Job 328. Approved by Commissioner Wenger. Carried. Letter received from Dan Bolen regarding sale of Eberhardt property was again taken up by the Board of Commissioners. Final decision to be given Tuesday, August 9th, 1955• The following letters were presented from the City Planning Commission: Recommending that Petition Number 1635 filed by George Baxter, for the rezon- ing of Lot 22, Beloit Street, Addition to Grounds of Kansas Wesleyan University, from "A" to "B" be approved. Commissioner Wenger moved to refer to City Manager and City Engineer. Carried. Recommending that Petition No. 1626 filed by M. L. Michaelsen and W. R. Napier for the rezoning of Lot 7, and the East 80 feet of Lot 8, Block 6, Oakdale Ad- dition from "B" to "C" be approved. Accepted by Commissioner Wenger and City Clerk instructed to give thirty days Notice. Carried. Appraisers filed report for Street Improvement provided for in Job 324. Commissioner Ramsey set date of August 16th, 1955 for Hearing. Carried. City Manager brought up water situation and need for holding down consumption. No watering between 9:00 A. M. and 9:00 P. M. ; then only even house numbers on even days and odd numbers on odd days. If this does not work, will have to cut down further All this on voluntary basis, but ordinance placed on first reading to make it official if necessary. • An ordinance was introduced for first reading entitled: "An ordinance levying special assessments against certain property to pay the cost of constructing certain sewer and water service pipes and connections in certain streets in the City of Salina, Kansas." Ordinance was referred to the Board of Commissioners. An ordinance was introdu ;ed for first reading entitled: "An ordinance levy- ing special assessments against certain property to pay the cost of cutting weeds on certain lots and parts of lots, and the parkways abutting thereon, in the City of Salina, Kansas." Ordinance was referred to the Board of Commissioners. On motion of Commissioner Hawkes the Board of Commissioners adjourned« City Clerk f •
