DECEMBER 13, 1954 Regular Meeting of the Board of Commissioners December 13, 1954• Meeting was cal led to order by Mayor Wenger, the roll was called and Commissioners Wenger, Cobb and Lake and City Attorney Clark responded. Commissioner Barcafer absent, Commissioner Cunningham deceased. The minutes of the Regular Meeting of December 6th, 1954 were read and approved as read. Pursuant to Notice published in the Salina Journal bids were received for the construction of Lateral Sanitary Sewers Numbered 306 to 310 inclusive, (Job 321) as follows: McCollum ConstructionODmpany, Salina, Kansas $10,797.00 H. t' . Taylor Construction Company, Salina, Kansas. $10,420.50 City Engineer's Estimate $10,803.00 On motion of Commissioner Cobb contract was awarded to H. J. Taylor • Construction Company, as per bid submitted in the amount of $10,420.50, and that check be returned to unsuccessful bidder. Carried. An ordinance was introduced for first reading entitled: "An ordinance ratifying and confirming a contra t with H. J. Taylor Construction Company for the construction of certain lateral sanitary sewers in the City of Salina, Kansas, here- tofore designated as Lateral Sanitary Sewer Districts 306, 307, 308, 309 and 310, and providing for the issuance of temporary notes to pay the cost thereof, pending issuance and sale of bonds." Ordinance was referred to the Board of Commis- sioners. Mayor appointed J. Earl Wyatt, C. B. Dodge, Jr. and Harley Rose to act as appraisers for Lateral Sanitary Sewers Numbered 306 to 310 inclusive (Job 321). Confirmed by Commissioner Lake. Carried. An ordinance was introduced and passed entitled: "An ordinance making an appropriation for the payment of certain claims." On motion of Commissioner Lake the ordinance was read and adopted by sec- tions and on its final a doption the roll was called and the following vote was had; Ayes: Wenger, Cobb and Lake (3) Nays: (0) Commissioner Barcafer absent, Commissioner Cunningham, deceased. A resolution was introduced and passed entitled: "A Resolution authorizing and providing for the issuance of Temporary Note of the City of Salina, Kansas., in the sum of $20,591.21 to pay a portion of the cost of certain sewer improvements in the City of Salina, to be designated as ST -22 pending the issuance of bonds to pay the cost of said work." On motion of Commissioner Cobb the resolution was adopted as read and on its final adoption the roll was called and the following vote was had; Ayes: Wenger, j Cobb and Lake (3) Nays: (0) Commissioner Barcafer absent, Commissioner Cunning- ham, deceased. A resolution was introduced and passed entitled: "A resolution authorizing and providing for the issuance of Temporary Note of the Qity of Salina, Kansas, in the sum of $3,977.08 to pay a portion of the cost of improving a certain street in the City of Salina, Kansas, to be designated as Series PT -20, pending the issuance of bonds to pay the cost of said work." On motion of Commissioner Cobb the resolution was adopted as read and on its final adoption the roll was called and the following vote was had; Ayes: Wenger, Cobb and Lake (3) Nays: (0) Commissioner Barcafer absent, Commissioner Cunning -- ham deceased. A resolution was introduced for second reading entitled: "A Resolution re- lating to the grading and paving with two-inch hot mixed asphaltic concrete over a six-inch rock stabilized base, on Kansas Avenue from the north line of Ash Street to the south line of Elm Street." An ordinance was introduced for second reading entitled: "An ordinance repealing Ordinance Number 5905." Mayor approved the ordinance and it is Numbered 5923. No persons appeared to protest against the rezoning of the following property: The rezoning of Lot 17, Surveyor's Plat 8 in the City of Salina, Kansas, to District "B". The resoning of Lots 37, 38, 39 and 40 on Ellsworth Avenue in Addition to Grounds of Kansas Wesleyan University to District "B". An ordinance was introduced for first reading entitled: "An ordinance provid- ing for the amendment of Zoning Ordinance 5549 and the Zoning District Map thereto and thereby adopted and providing for the rezoning of certain property * thin the City and prescribing the proper uses thereof." Ordinance was referred to the Board of Commissioners. City Manager reported on the following petitions: hot asphalt paving on East Kirwin from Roach to Lewis. Curb and gutter Lewis Avenue from Jewell to Kirwrin. A resolution was introduced for first reading entitled: "A Resolution relat- ing to the curbing, guttering and grading of Lewis Avenue from the center line of Jewell Avenue to thec;center line of Kirwin Avenue, Salina, Kansas." Resolution was referred to the Board of Commissioners. A resolution was introduced for first reading entitled: "A Resolution relat- ing to the grading and paving, with two-inch hot mixed asphaltic concrete, over a six-inch rock stabilized base, Kirwin Avenue from the east side of Roach Street to west side of Lewis Avenue, Salina, Kansas." Resolution was referred to the Board of Commissioners. Letter presented from the City Planning Commission recommending that east and west public alley between Kirwin Avenue and Claflin A enue and Pershing -venue and Ninth Street be closed. CommissioneY Lake moved that report be accepted. Carried. An ordinance was introduced for first reading entitled: "An ordinance pro- vidin for the vacation of a part of an east and west alley, within the City of Salina, Saline County, Kansas." The following letters were received from the City Planning Commission: - Recommending that Petition Number 1529, filed by Kenneth Campblee, for the rezoning of Lots 1 and 2 on Elm Street, and Lots 9, 10, 11, 12 on Ninth Street, in Bishop's Addition from Zone "C" to Zone "E" be denied. Commissioner Cobb moved that report be accepted. Carried. Recommending that Petition Number 1532 filed by Aaron N. Zemler, November 22, 1951, for the rezoning of Lot 35, Block 5, Sunset Manor Addition from Zone "A" to Zone "D" be denied. Commissioner Cobb moved that report be accepted. Carried. A petition was presented for the curbing, guttering and paving of Redwood Drive from Cherokee Street to Willow Street. Referred to the City 'IAai'ager,' Letter presented som 0. K. Webster, of the Board of '.Trustees of the Evangelical United Brethren Church thanking the Board of City Commissionersfor the old "Welcome Sign" given to Camp Webster. Ordered filed. Articles of Agreement entered between Clarence 0. ingermanson and Gertrude D. Talley (Developers) and the City of Salina, Kansas. Approved by O:)mmis- sioner Lake. Carried. H. E. Peterson, City Clerk, took the chair and Commissioner Wenger nominated A. W. Hawkes for City Commissioner, to fill vacancy caused by the death of Commis- sioner Lloyd Cunningham. Seconded by Commissioner Lake. Carried. Ayes: Winger, Cobb and Lake (3) Nays: (0) Commissioner Barcafer absent. A. W. Hawkes, Bond filed and approved. He took the oath of office from City Clerk and was declared elected as City Commissioner for the term and until the City Election of April 1957• On motion of Commissioner Lake the Board of Commissioners adjourned.
