08-09-1954 MinutesCOMMISSIONERS PROCEEDINGS, REGULAR MEETING COMMISSIONERS ROOM, SALINA, KANSAS AUGUST 9, 1954 Regular Meeting of the Board of Commissions rs August 9, 1954• Meeting was called to order by Mayor Wenger, the roll was called and Commissioners Wenger, Cunning— ham and Lake and City Attorney Clark responded. Commissioners Barcafer and Cobb absent. The minutes of the Regular keeting of August 2nd, 1954 and Special Budget Hearing Meeting of August 6th, 1954 were read nd approved as read. Hearing was held on Petition Number 1460 filed by 0. K. Webster, for the rezoning of the following property: :7 Wymore Addition Lots 1 and 18, Block 2 to District "C" Lots 2 to 17 inclusive, Block 21 to District I'D:V. Protest petition filed by property owners. • Carried. Commissioner Lake moved to refer petition back to City Planning Commission. A resolution was introduced for second reading entitled: "A Resolution relating to the curbing, guttering, paving and grading of Kirwin Avenue , with concrete 32 feet wide from face of curb to face of curb, from the East line of Osborne Street to the West line of Quincy Street." On motion of Commissioner Cunningham the resolution was adopted as read and on its final adoption the roll was called and the following vote was had; Ayes: Wenger, Cunningham and Lake (3) Nays: (0) Commissioners Barcafer and Cobb absent. Mayor approved the resolution and it is Numbered 1475. The above resolution is recorded in full on Page 260 Resolution Book Number 5. A resolution was introduced for second reading entitled: "A Resolution relating to the curbing, guttering and grading of the east side of Roach Street— from the center line of Claflin Avenue to the ce.iter line of Kirwin Avenue." On motion of Commissioner Cunningham the resolution was adopted as read and on its final adoption the roll was called and the following vote was had; Ayess Wenger, Cunningham and Lake (3) Nays: (0) Commissioner Barcafer and Cobb absent. I i An ordinance was introduced for second reading entitled: "An ordinance re- pealing Sub -section 22 of Article 1 of Chapter 13, Revised Ordinances of the City of j Salina, Kansas, 1948." On motion of Commissioner Lake the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had: Ayes: Wenger, Cunningham and Lake (3) Nays: (0) Commissioners Barcafer and Cobb absent. Mayor approved the ordinance and it is Numbered 5080. An ordinance was introduced for second reading entitled: "An ordinance pro- viding for the vacation of a part of an east and west alley, within the City of Salina, Saline County, Kansas." On motion of Commissioner Lake the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Wenger, Cunningham and Lake (3) Nays: (0) Commissioners Barcafer and Cobb absent. Mayor approved the ordinance and it is Numbered 5881. An ordinance was introduced for second reading entitled: "An ordinance amend- ing Ordinance Number 5549 of the City of Salina, and creating, regulating and restrict- ing the use of a temporary zone and regulting and restricting the location, repair, alteration of buildings designated for the specified use; and regulating and restrict- ing use of land within said temporary zone;and temporarily excluding certain land from District "A", First Dwelling House District as defined by Ordinance Number 5549; and including said land in mod temporary district; and prescribing a penalty for the violation of its terms and repealing Ordinance Number 5576 only insofar as it confl-icts herewith." On motion of Commissioner Lake the ordinance was read nd adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Wenger, Cunningham and Lake (3) Nays: (0) Commissioners Barcafer and Cobb absent. Mayor approved the ordinance and it is Numbered 5882. An ordinance was introduced for second reading entitled: "An ordinance levying special assessments against certain property to pay the cost of cutting weeds on certain lots and parts of lots, and the parkway abutting thereon in the City of Salina, Kansas:. " On motion of Commissioner Cunningham the ordinance was read and adopted by sections and on its finaladoption the roll was called and the following vote was had; Ayes: Wenger, Cunningham and Lake (3) Nays: (0) Commissioners Barcafer and Cobb absent. Mayor approved the ordinance and it is Numbered 5883. An ordinance was introduced for second reading entitled: "An ordinance • levying special assessments against certain property to pay the cost of constructi_ig water service pipes and connections in certain streets in the City of Salina, Kansas." i On motion of Commissioner Cunningham the ordinance was read and adopted by sections and on its finaladoption the roll was called and the following vote was had; Ayes: Wenger, Cunningham and Lake (3) Nays: (0) Commissioners Barcafer and Cobb absent. Mayor approved the ordinance and it is Numbered 5881. An ordinance was. introduced for second reading entitled: "An ordinance creating and defining a certain Main Sewer District in the City of Salina, Kansas, designated as Bain Sewer "Z", providing for the construction of a main Sewer in said district; providing for the payment of the cost thereof and forthe levying of special assessments against the property in such district forthe payment of such cost, and for the issuing of bonds therefor." On motion of Commissioner Cunningham the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Wenger, Cunningham and Lake (3) Nays: (0) Commissioners Barcafer and Cobb absent. Mayor approved the ordinance and it is Numbered 5885. An ordinance was introduced for second reading entitled: "An ordinance making a levy of taxes for general revenue and other purposes by the City of Salina, Kansas, forthe year 1955." On motion of Commissioner Cunningham the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; • Ayes: Wenger, Cunningham and Lake (3) Nays: (0) Commissioners Barcafer and Cobb absent. Mayor approved the ordinance and it is Numbered 5886. i An ordinance was introduced and passed entitled: "An ordinance making an appropriationfor the payment of certain claims." On motion of Commissioner Cunningham the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Wenger, Cunningham and Lake (3) Nays: (0) Commissioners Barcafer and Cobb absent. Mayor approved the resolution and it is Numbered A-711. City Engineer filed Estimate Number 1 in the amount of $10,608.911 to Brown & Brown, Inc., for paving certain streets as provided for in Engineer Job Number 316. Approved by Commissioner Lake. Carried. Petition filed protesting against the unsanitary condition of property located at 131 East Claflin A`renue. Referred tot he City Manager. The following petitions were presented and referred tothe City Manager: Curb and gutter south side of Haven from Whittinghill to Viemont. Curb and gutter Whittinghill from Crawford to Haven. Curb and gutter V�emont from Crawford to Haven. Paving Illinois S reet from Merrill to Sheridan. Plat filed for Replat of Block 3, Banker's Addition. Referred to City Planning Commission. Commissioner Lake moved that Water Main Extensions not be made, and that matter be referred to City Attorney and City Manager to write a Resolution or Ordinance regarding regulations. Carried. Application for Cereal Malt Beverage License presented from: Lloyd W. Snook, d/b/a "The Buffet" 217 North Santa Fe Avenue. Commissioner Cunningham moved that application be approved and license granted. Carried. Appraisers reports filed for curbing, guttering and/or paving improvements `provided for in Engineer Job Number 316 and 320. Commissioner Lake moved V that City Clerk be instructed to advertise for hearing on said reports for Monday, August 16th 1954 at 7:30 o'clock P. M. On motion of Commissioner Lake the Board of Commissioners adjourned. City Clerk
