06-03-1958 Minutes• 1 COMMISSIONERS PROCEEDINGS, REGULAR MEET ING COMMISSIONERS ROOM, SALINA, KANSAS. JUNE 3, 1958 Regularr Meeting of the Board of Commissioners June 3, 1958. Meeting was called to order by Mayor Jaeger, the roll was called and Commissioners Jaeger, Exline, McCune and Ramsey and City Attorney Barta responded. Commissioner Wenger absent. The minutes of the Regular.Meeting of May 27, 1958 were read and approved as read. Pursuant to Notice published in the Salina Journal bids were received on Paving Repair Job 370, (South Str eet ) as follows: 0. D. Wilmoth $5135.00 Brown and Brown $8086.00 Saum Brothers $5200.00 • Engineers Estimate $8515.00 Commissioner Ramsey moved to award contract to 0. D.Wilmoth as per bid sub- mitted in the amount of $5135.00 and return checks to unsuccessful bidders. Carried. No persons appeared to protest the rezoning of Lots 5,7,9,11,13,15,17, Block 6, Bond's Addition from zone "Atl to Zone "B". Commissioner Exline moved that Zoning Ordinance be introduced for first reading. Ordinance passed: ` Number -77 A resolution was introduced for second reading entitled "A Resolution de- termining necessity of and direction V a.t the owner of owners of certain lots construct in compliance with plans and specifications of the City Engineer, a sidewalk abutting said lots within 30 days of the adoption and publication hereof and providing that in tr event the owner or owners fail to doso, that the City of Salina shall proceed to con- struct or cause to be constructed said sidewalk and that the total cost thereof shall be assessed against such lot or lots on which such sidewalk shall abut as other special assessments." On motion of Commissioner Ramsey the resolution was adopted as read and on its final adoption the roll was called and the following vote was had; Ayes: Jaeger, Exline, McCune and Ramsey (4) Nays: (0) Commissioner Wenger absent. Mayor approved the resolution and it is Numbered 2013. A resolution was introduced for second reading entitled : "A Resolution relat- ing to the condemnation of portions of sidewalks and providing for the construction of new walks in the place thereof and the payment therefor." • On motion of Commissioner Ramsey the resolution was adopted as read and on its final adoption the roll was called and the following vote was had; Ayes: Exline, Jaeger, McCune and Ramsey (4) Nays: (0) Commissioner Wenger absent. Mayor approved the resolution and it is Numbered 2011. An ordinance was introduced for second reading entitled: "An ordinance ratifying and confirming a contract with C. N. McCollum doing business as McCollum Construction Company for the construction of a Lateral Sanitary Sewer, Main Sanitary Sewer and Pumping Station in the City of Salina, Kansas, heretofore designated as Lateral Sanitary Sewer373; Main Sanitary Sewer "AF" and Pumping Station, and provid- ing for the issuance of Temporary Notes to pay the cost thereof, pending the issuance and sale of bonds." On motion of Commissioner Exline the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Jaeger, Exline, McCune and Ramsey (4) Nays: (0) Commissioner Wenger absent. Mayor approved the ordinance and it is Numbered 6237. An ordinance was introduced for second reading entitled : "An ordinance pro- viding for the amendment of Zoning Ordinance Number 5549 and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof." On motion of Commissioner Exline the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Jaeger, Exline, McCune and Kamsey (4) Nays: (0) Commissioner Wenger absent. Mayor approved the ordinance and it is Numbered 6238. • An ordinance was introduced for second reading entitled: "An ordinance pro- viding for the amendment of Zoning Ordinance Number 5549 and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain proper ty within the City and prescribing the proper uses thereof. On motion of Commissioner Ramsey the ordinance was.read and adopted by sec- tions and on its final adoption the roll was called and the following vote was had; Ayes: Jaeger, Exline, McCune and Ramsey (4) Nays: (0) Commissioner Wenger absent. Mayor approved the ordinance and it is Numbered 6239• An ordinance was introduced for second reading entitled: "An ordinance providing for the amendment of Zoning_Ordinanoe Number 5549 and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof." On motion of Commissioner Exline the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Jaeger, Exline, McCune and Ramsey (4) Nays: (0) Commissioner Wenger absent. Mayor approved the ordinance and it is Numbered 6240• An ordinance was introduced for second reading entitled : "An ordinance relat- ing to and apportioning and levying special assessments on certain lots and pieces of ground in the City of Salina, Kansas, to pay the cost of paving and grading Indiana Street with concrete, twenty-six (26) feet wide from toe to toe of fixitting curb and gutter from the_ north line of Gypsum Avenue to the south line of Stapler Str eet; paving and grading of Norton Street with concrete, twent -eight (28) feet wide from toe of gutter to toe of gutter, from the north line of Jewell Avenue to the south line of Ells- worth Avenue; curbing, guttering, paving and grading of Second Street with concrete from the south lineof Crawford Avenue to the north line of Bond treet; paving and grad- ing of Sherman Street with concrete, twenty-eight (28) feet wide from toe to toe of existing curb, from the south line of Crawford Avenue to the north line of Franklin Avenue; paving and grading of Tenth Street with concrete, twenty-eight (28) feet wide from toe of gutter to toe of gutter from the south line of Jewell Avenue to the north line of Kirwin Avenue, and relating to and providing for the collection and payment of such assessments." On motion of Commissioner Ramsey the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Jaeger, Exline, McCune and Ramsey (4) Nays: (0) Commissioner Wenger absent. Mayor approved the ordinance and it is Numbered 6241. City Engineer filed the following Estimates: Number 4. Street Improvement Job 366 Brown & Brown, Inc. Amount $1032.75 Approved by Commissioner McCune. Number 7. Street Improvement Job 361 Brown &Brown, Inc. Amount $13,932.77 Approved by Commissioner Exline. Wilson and Company, Engineers,filed the following estimate; No. 11 Iron Avenue Bridge Jarvis Construction Company, Amount $29,518.71 Approved by Commissioner McCune. Trust Deed, with a deposit of $40.00 was presented from John DeBusk for per- petual care of Space Number 7, Lot 23_, Block 24, Gypsum Hill Cemetery, Salina, Kansas. Approved by Commissioner McCune. Application for Cereal Malt Beverage License was presented from John Paul Lendway, d/b/a "Pacific Street Tavern" 122. West Pacific. Commissioner McCune moved t at application be approved and license granted. Commissioner McCune moved that resolution be introduced for first reading relating to the paving of Fourth Street from Venter Street to Prescott Avenue. Resolution passed:___ ( Number An ordinance was introduced and passed entitled "An ordinance making an appropriation for the payment of certain claims." On motion of Commissioner Ramsey the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Jaeger, Exline, McCune and Ramsey (4) Nays: (0) Commissioner Wenger absent. Mayor approved the ordinance and it is Numbered A-909. An ordinance was introduced and passed entitlede: "An ordinance making an appropriation for the payment of certain claims." Commissioner Ramsey moved that ordinance be introduced for first reading for salary of Marshal of City Court to $100.00 per month, instead of $75.00, starting June 1, 1958• f Ordinance passed: _ �,� �_ Number lr Letter received from Sa ina Centennial Inc., notifying the City Commissioners they have approximately $.,000.00 in profits earmarked for the development of Indian Rock Park. GCity Clerk City Engineer filed plans. and specifications for the resurfacing of certain streets provided for in Engineer Job 374. Commissioner Exline moved to approve and City Clerk be instructed to advertise for bids to be received up to and including Tuesday, June 10th, 1958 at four o'clock P. M.
