Meeting was called to order by Mayor Exline, the roll was called and Commissioners Exline, Jaeger, McCune and Wenger and City Attorney Barta responded. Commissioner Kamsey absent. The minutes of the Regular Meeting of September 17, 1957 and Meeting of Board of Zoning Appeals were read and approved as read. Pursuant to Notice published in the Salina Journal bids were received for the curbing, guttering and paving certain streets provided for in Engineer Job 360, as follows: 0. D. Wilmoth Construction Company, Salina, Kansas $79,527.50 Brown and Brown, Inc., Salina, Kansas $85,471.25 L. W. Rexroad and Son, Salina, Kansas $99,862.50 • City Engineer's Estimate $89,7.5.00 Commissioner Wenger moved that contract be awarded to O.D.Wilmoth Construction Company as per bid submitted in the amount of $79,527.50; and checks returned to un- successful bidders. Carried. Mayor appointed J. Earl Wyatt, C. B. Dodge, Jr., and Harley Rose, as appraisers for curbing, guttering and paving certain streets provided for in Engineer Job 360. Carried. An ordinance was introduced for second reading entitled: "An ordinance pro- viding for the condemnation of certain property for the purpose of providing necessary land and easements for the use of the City of Salina, Kansas, in the developing, con- structing, maintaining and operation of a Flood Control System for said City of Salina, Kansas." On motion of Commissioner Wenger the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Exline, Jaeger, McCune and Wenger (4) Nays: (0) Commissioner Ramsey absent. Mayor approved the ordinance and it is Numbered 6185. An ordinance was introduced for second reading entitled: "An ordinance for the vacation of an East and West alley within the City of Salina, Saline County, Kansas." On motion of Commissioner Wenger the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Exline, Jaeger, McCune and Wenger (4) Nays: (0) Commissioner Ramsey absent. Commissioner McCune moved to approve. Carried. 1923 For Extension of Sanitary Sewer to the South side of Block 6, from the South side of Block 5, to the south side of Block 4, and through Block 7 to the south- east corner of Lot 14, Block 3, Ingermanson Heights Addition, Salina, Kansas. Commissioner McCune moved to approve for ordinance. Carried. 1922 For curbing, guttering and paving of Page Avenue from south side of Willis Avenue to south side of Carlton Place; and Carlton Place from west side of Page Avenue to West side of Ingman Road; and Ingman Road from north side of Carlton Place to north side of Lot 2, Block 7, Ingermanson Heights Addition, Salina, Kansas. Commissioner McCune moved to approve for resolutions. Carried. The following letters were received from the City Planning Commission: Recommending that Petition Number 1912 submitted by M. L. Michaelsen for the rezoning to District 'tG" a tract of land from the North line of Beverly Drive and East line of Duvall, on the east side of Highway 81, be approved. Accept by Commissioner McCune. Carried. Recommending that Petition Number 1930 filed by the Salina Board of Trade for the rezoning of 5.18 acres on the Northwest corner of Lot 2, Surveyor's Plat 34, an • addition to the City of Salina, Kansas-, to Zone "D" be approved. Accept by Commissioner McCune. Carried. A letter was received from the City Planning Commission relating to signs on land to be rezoned. Commissioner McCune moved to accept and approve. Carried. City Engineer submitted Final Estimate in the amount of $20, 872.40 to McCollum Construction Company for Sanitary Sewers and Main Sanitary Sewer. (Engineer Job 358) Approved by Commissioner McCune. Carried. A resolution was introduced and passed relating to disclaim, release, relinquish and quit claim unto Charles W. Sheldon, his heirs and assigns forever, the mineral inter- estsin and under 'Fact No. 11451 described in Resolution Number 18782 for use by the City of Salina for its flood control purposes. On motion of Commissioner Wenger the resolution was adopted as read and on its final adoption the roll was called and the following vote was had; Ayes: Exline, Jaeger, McCune and Wenger (4) Nays: (0) Commissioner Ramsey absent. Mayor approved the resolution and it is Numbered 1878. The above resolution is recorded in full on Pages 322 and 323 of resolution Book Number 6. Hearing was held on Appeal Notice filed by M. L. Michaelsen for non-compliance with Rear Yard and side Yard requirements on Ordinance Number 5549, Section 6 for the West 120 feet of Lot 1 and North 25 feet of the West 120 feet of Lot 3, Block 3 in Replat of Beebe's 2nd Addition, in the City of Salina, Kansas. No protests. A resolution was introduced and passed entitled: "A Resolution relating to the authorization of non-compliance with the Rear Yard and Side Yard requirements of Section 6, of Ordinance Number 5549 for west 120 feet of Lot and North 25 feet of the West 120 feet of Lot 2, Block 3, in Replat of Beebe's 2nd Addition in the City of Salina, Kansas. On motion of Commissioner Wenger resolution was adopted as read and on its final adoption the roll was called and the following vote was had; ,Ayes: Exline, Jaeger, McCune and Wenger (4) Nays: (0) Commissioner Ramsey absent.
