08-13-1957 MinutesCOMMISSIONRS PROCEEDINGS, REGULAR MEETING COMMISSIONERS ROOM, SALINA, KANSAS AUGUST 13, 1957 Regular Meeting of the Board of Commissioners August 13, 1957. Meeting was called to order by Mayor Exline, the roll was called and Commissioners Exline, Jaeger, McCune, Ramsey and Wenger and City Attorney Barta responded. The minutes of the Regular Meeting of August 6th, 1957; Regular Meeting of August 9th, 1957; and Meeting of Board of Zoning Appeals of August 6th, 1957 were read and approved as read. Letter from City Planning Commissi_n recommending that Petition No. 1909 submitted by M. L. Michaelsen for the rezoning of certain property bounded on the East by the National Reserve Armory; on the west by Missouri Pacific Railroad Tracks; and on the south by Cloud Street, from Zone "A" to Zone "G" be denied, was again taken up by the Board of Commissioners. Commissioner Ramsey moved to accept recommendation and petition denied. Carried An ordinance was introduced for second reading entitled: "An ordinance making a levy of taxes for general revenue and other purposes by the City of Salina, Kansas for the year 1958• On motion of Commissioner Wenger the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Exline, Jaeger, McCune, Ramsey and Wenger (5) Nays: (0) Mayor approved the ordi- nance and it is Numbered 6173. An ordinance was introduced t'or second reading entitled: "An ordinance regu- lating garbage and household trash receptacles in the City o Salina, Kansas, provid- ing a penalty for the violation thereof and amending Secti n 20-104, 1948 Revised Ordinance of said City." On motion of Commissioner Ramsey the ordinance was read and adopted by sec- tions and on its final adoption the roll was called and the following vote was had; Ayes: Exline, Jaeger, McCune, Ramsey and Wenger (5) Nays: (0) Mayor approved the ordinance and it is Numbered 6174. An ordinance was introduced for second reading entitled: "An ordinance defining., classifying and regulating walls and fences, requiring a permit from the Building Inspector and providing penalties for the violation of its provisions. Amending Chapter 6 of Revised Ordinances of the City of Salina, Kansas, 1948." On motion of Commissioner McCune tine ordinance was read and adopted by sec- tions and on its final adoption the roll was called and the following vote was had; Ayes: Exline, Jaeger, McCune, Ramsey and Wenger (5) Nays: (0) Mayor approved the ordinance and it is Numbered 6175. An ordinance was introduced for second reading entitled: "An ordinance pro- viding for the inclusion of certain land within the corporate limits of the City of Salina, Kansan." On motion of Commissioner Ramsey the ordinance was read and adopted by sec- tions and on its final adoption the roll was called and the following vote was had; Ayes: Exline, Jaeger, McCune, Ramsey and Wenger (5) Nays: (0) Mayor approved the ordinance and it is Numbered 6176. City Manager reported on the following petitions: No. 1914 Curb and gutter on South Clark Street from Spruce Street to the soutr line of Lot -8 Block 6, and the south line of Lot 8, Block 5, Walnut Grove Addition. 88% Commissioner Ramsey moved to approve for Resolution. Carried. No -1913 Paving Franklin Street from Hancock to Merrill. 100% Commissioner Ramsey moved to approve for Resolution. Carried. Resolution was introduced and passed relating to the leasing to Orville Boyle, d/b/a Royal Tire Company, the west 40 feet of certain boundary wall located on the south boundary wall located on the south boundary of the municipal parking lot located at 133-135 South lifth Street, Salina, Kansas, for a term of one year beginning August 1, 1957 and terminating on the 31st day of July 1958, at a yearly rental of X50.00 payable in advance. On motion of Commissioner Ramsey the resolution was adopted as read and on its final adoption the roll was called and the following vote was had; Ayes: Exline, Jaeger, McCune, Ramsey and Wenger (5) Nays: (0) mayor approved the resolution and it is Numbered 1867. • 1 1 • 0 • 1 1 • 'S 8 The above resolution is recorded in full on Pages 304 and 305 Resolution Book 6. Retha Wise asked permission to transfer Beer License Number 2954 from 107 North Seventh Street to 156 North Santa Fe Avenue. Approved by Commissioner McCune. Carried. Application for Cereal Malt Beverage License was presented from Retha Wise, d/b/a Retha's Tavern, 11.7 North Seventh Street. Commissioner McCune moved to approve subject to sanitation 0. K. Carried. City Engineer submitted Final Estimate in the amount of $17,159.88 to O.D. Wil - moth Construction Company for construction of Country Club Intercepting Sewer and for Lateral Sanitary Sewers Numbered 361 and 362. (Job 359) Approved by Commissioner Ramsey. Carried. Concrete Construction Maintenance Bond presented from Edward Blaske. Approved by Commissioner McCune. Carried. Petition presented for the extension of Zone "D" to include Lots 25, 27 and 29, Santa Fe Avenue, Grounds of Kansas Wesleyan University. (Known as 1200 and 1204 South • Santa Fe Avenue. Commissioner Ramsey moved to refer to City Planning Commission. Carried. Resolution was introduced and passed relating to agreement with Union Pacific Railroad Company co erring lease of portion of the Right -of -Way of the Union Pacific Rail- road for detour public street or highway purposes in Salina, Kansas. On motion of Co mmissioner McCune the resolution was adopted as read and on its final adoption the roll was called and the following vote was had; Ayes: Exline, Jaeger, McCune, Ramsey and Wenger (5) Nays: (0) Mayor approved the resolution and it is Numbered 1868. A resolution was introduced and passed certifying that all right-of-way, borrow pits, dike, channel change, construction easements and Union Pacific Agreements required for Project 40-85-K (2160) (2) have been acquired in accordance with the plans." On motion of Commissioner Ramsey the resolution was adopted as read and on its final adoption the roll was called and the following vote was had; Ayes: Exline, Jaeger, McCune, Ramsey and Wenger (5) Nays: (0) Mayor approved the resolution and it is Numbered 1869. Application presented from Champlin Refining Company for the construction of two 40 -foot driveways at 201 South Broadway, Salina, Kansas. Approved by Commissioner Wenger. Carried. AUGUST 13, 1957 Meeting of Board of Zoning Appeals, August 13, 1957. Meeting was called to order by i�layor Exline, the roll was called and Commissioners Exline , Jaeger, McCune, Ramsey and Wenger and City Attorney Barta responded. Hearing was held on Appeal Notice filed by Ed French for non-compliance with Side Yard Requirements for Lot 10, North 8th Street, Original Town of Jalina, Kansas. No protests. A resolution was introduced and passed entitled: "A Resolution relating to the authorization of non-compliance with the Side Yard Requirements of Section 5, Paragraph 2 and Section 6 of Ordinance Number 5549 for Lot 10 on North 8th Street in Original Townsite , City of Salina, Saline County, Kansas." On motion of Commissioner Wenger resolution was adopted as read and on its • final adoption the roll was called and the following vote was had; Ayes: Exline, Jaeger, McCune, Ramsey and Wenger (5) Nays: (0) Mayor approved the resolution and it is Numbered 1870.
