JULY 30, 1957 Regular Meeting of the Board of Commissioners July 30th, 1957• Meeting was called to order by Mayor Exline, the roll was called and Commissioners Exline, Jaeger, McCune and Ramsey and City Attorney Barta responded. Commissioner Wenger absent. The minut es of the Regular Meeting of July 23, 1957 were read and approved as read. An ordinance was introduced for second reading entitled: "An ordinance rati- fying and confirming a contract with Brown and Brown, Inc., for the construction of certain paving and grading improvements on certain streets in the City of Salina, Kansas- and providing for the issuance of temporary notes to pay the cost thereof pending the issuance and sale of bonds." On motion of Commissioner Ramsey the ordinance was read and adopted by sections • and on its final adoption the roll was called and the following vote was had; Ayes: .Exline, Jaeger, McCune and Ramsey (4) Nays: (0) Commissioner Wenger absent. Mayor approved the ordinance and it is Numbered 6167. An ordinance was introduced for second reading entitled : "An ordinance cre- ating and defining a certain lateral sanitary sewer district in the City of Salina, Kansas, designated as Lateral Sanitary Sewer District Number 364, and providing for the construction of a lateral sanitary sewer in said Lateral Sanitary Sewer District Number 364, so created and providing for the payment o the cost thereof and for the levying of special assessments against the property in said district for the payment of the cost of such construction and for the issuing of bonds to pay the cost thereof." On motion of Commissioner Ramsey the ordinance was read and adopted by sec- tions and on its final adoption the roll was called and the following vote was had; Ayes: Exline, Jaeger, McCune and Ramsey (4) Nays: (0) Commissioner Wenger absent. Mayor approved the ordinance and it is Numbered 6168. An ordinance was introduced for second reading entitled: "An ordinance de- scribing the place of installation of certain sidewalks in the City of Salina, Kansas." On motion of Commissioner Ramsey the ordinance was read and adopted by sectio and on its final adoption the roll was called and the following vote was had; Ayes: Exline, Jaeger, McCune and Ramsey (4) Nays: (0) Commissioner Wenger absent. Mayor approved the ordinance and it is Numbered 6169. An ordinance was introduced for second reading entitled: "An ordinance amend- ing Ordinance Number 5549 of the City of Salina, Kansas, and creating, regulating and restricting the use of a temporary zone and regulating and restricting the location, repair, alteration or buildings designed for the specified use; and regulating and re- stricting use of land within said temporary zone; and temporarily excluding certain • land from District "A", First Dwelling House District as defined by Ordinance Number 5549; and including said land in said temporary district; and prescribing a penalty for the violation of its terms and repealing Ordinance Numbers 5576 and 5882 only insof as they conflict herewith." Onrmtion of Commissioner Jaeger the ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Exline, Jaeger, McCune and Ramsey (4) Nays: (0) Commissioner Wenger absent. Mayor approved the ordinance and it is Numbered 6170. City Engineer filed Plans and Specifications for the construction of Lateral Sanitary Sewer Number 363• Approved. by Commissioner Ramsey. Carried. The following letters were received from the City Planning and Zoning Commission: Recommending that Petition Number 1904 submitted by the Larson Lumber Company, Inc., for the rezoning of Lots 147, 145, 149 and 151 on Fourth Street in the Original Town of Salina, Kansas from Zone "C" to Zone "F" be approved. Accept by Commissioner Jaeger and City Clerk publish thirty -day Notice. Carried. Recommending approval of Petition Number 1907, submitted by Country Club Height Company, Inc., for the approval of the Plat of Country Club Heights Addition Number 3, as an addition to the City of Salina., 'Kansas. Approved by Commissioner McCune. Carried. Recommending that Petition Number 1910 submitted by the Board of Trustees of the University Methodist Church, for the vacating of the alley between Lots 66 and 68 • on Santa Fe Avenue in the Grounds of Kansas Wesleyan University, Salina, Kansaa, be ap- proved. Commissioner McCune moved to accept recommendation and that ordinance be introduced for first reading. Car ied. Ordinance passed: Number: Recommending that Petition Number 1909 submitted by M. L. I'Ii.chaelsen, July 16th, 1957, for the rezoning of certain property bounded on the east by the National R.eseive Armory, on the west by the Missouri Pacific Railroad Tracks and on the south by Cloud Street from Zone "A" to Zone "G" be denied. Commissioner Ramsey moved to hold up for one week, August 6, 1957. Carried. Letter presented from City Planning and Zoning Commission recommending that no further plats be approved by the City Commission unless and until provision has been made in the plat and the certificate to plat for public sidewalks which are to be constructed at the same time as the curb and gutter; also that no future street surfac- ing be permitted by anyone except in strict accordance with City Building Code minimum specifications for permanent streets as the same now exist and might hereafter be amended. Approved. by Commissioner McCune as recommended. Carried. Petition presented from M. L. Michaelsen for the rezoning of a tract of land to Zone "G", heavy ind ustry. Tract described as follows: Beginning at a point on the west Right -of -Way line of U. S. Highway No. 81, 745.55 feet north of the south line of Southwest 1/4 Section 14, Township 14, South Range 3 West of the 6th Principal Meridian in Saline County, Kansas, to North along Right-of-way line 466.15 feet to the south side of Beverly Street; thence west along south line of Beverly Street 519-78 feet to the east side of Duvall Street; thence South 466.15 feet along the east line of Duvall Street, thence 519.78 feet East to the point of beginning. Referred to City Planning Commission by Commissioner Ramsey. Application for permit to construct driveways on the South-east corner of Santa Fe Avenue and Jewell Avenue received from Kent Oil Company. Commissioner McCune moved to approve one 30 -foot driveway on Santa Fe Avenue and one 40 -foot driveway on Jewell Avenue. Carried. Wilson and Company, Engineers, submitted Estimate Number 4 in the amount of 43549.55 to Wilson Constructors, for Water Supply Wells No. 15 and 16. Approved by Commissioner McCune. Carried. Data for ordinance on Fences and Walls. Referred to City Attorney for ordinance. Commissioner Ramsey moved that Weed /Tax Ordinance be introduced for first reading. Ordinance passed: (p Number 6.1- l City Engineer submitted Estimate Number 1 in the amount of $2141.30 to Brown & Brown, Inc., for Job 355. Approved by Commissioner Ramsey. Carried. City Engineer submitted Estimate Number 4 in the amount of $44,305.29 to Brown & Brown, Inc., for Job 357. Approved by Commissioner McCune. Carried. JULY 30, 1957 _- Meeting of Board of Zoning Appeals July 30, 1957. Meeting was called to order by Mayor Exline the roll was called and Commissioners Exline, Jaeger, McCune and Ramsey and City Attorney Barta responded. Commissioner Wenger absent. Application for Building Permit for the erection of a building on Lot10, North Eighth Street, Original Town o Salina, Kansas, (318 North Eighth Street), was pre- sented from Ed French. Commissioner Ramsey moved application be denied because of no parking area. Carrie - On motion of Commissioner Ramsey the Board of Zoning peals adjourned. CITY CLERK
