03-26-1963 MinutesC] 1 1 COMMISSIONERS PROCEEDINGS, REGULAR MEETING COMMISSIONERS ROOM Salina, Kansas March 26, 1963 Regular Meeting of the Board of Commissioners March 26, 1963. Meeting was called to order by Mayor Exline, the roll was called and Commissioners Exline, Banker, Bull, Spangler and Tucker and Assistant City Attorney Haggart responded. City Attorney Bengtson absent. The minutes of the Regular Meeting of March 19, 1963 were read and approved. On motion of Commissioner Bull, seconded by Commissioner the letter from Wilson & Company, Engineers asking for one more week to make recommendations on the Water Plant improvement was accepted. Carried. A resolution was introduced for second reading entitled: "A resolution relating to the curbing, guttering, paving and grading of Driftwood Road with concrete (Thirty three (33) feet wide from back of curb to back of curb) from the north line of North- wood Lane to the north line of Greeley Avenue." On motion of Commissioner Tucker, seconded by Commissioner Bull the resolution was approved as read and the following vote was had; Ayes: Exline, Banker, Bull, Spangler and Tucker (5) Nays: (0) Mayor approved the resolution and it is Numbered 2700. Carried. Resolution introduced for first reading March 19, 1963. A resolution was introduced for second reading entitled: "A resolution relating to the curbing, guttering, paving and grading of Northwood Lane with concrete (Thirty three (33) feet wide from back of curb to back of curb) from the east line of Beechwood Road to the west line of Driftwood Road." On motion of Commissioner Spangler, seconded by Commissioner Tucker the resolution was approved as read and the following vote was had; Ayes: Exline, Banker, Bull, Spangler and Tucker (5) Nays: (0) Mayor approved the resolution and it is Numbered 2701. Carried. Resolution introduced for first reading March 19, 1963. An ordinance was introduced for second reading entitled: "An ordinance prescribing hours of closing, standards of conduct, and conditions of operation of businesses selling ceral malt beverages; amending ordinance 5621, Section 1 the same being section 6-207 of the Code of the City of Salina, Kansas, 1960, and relealing said original ordinance and section." On motion of Commissioner Spangler, seconded by Commissioner Banker the ordinance was adopted by sections and on its final adoption the following vote was had; Ayes: Exline, Banker, Bull, Spangler and Tucker (5) Nays: (0) Mayor approved the ordinance and it is Numbered 6694. C An ordinance was introduced for second reading entitled: "An ordinance making it unlawful for a person or persons to telephone another person repeatedly for the purpose of harassment, unless a legitimate business call, or to use a telephone in a vulgar, indecent, obscene, or immoral manner, providing penalties for violation of said ordinance." • On motion of Commissioner Tucker, seconded by Commissioner Bull the ordinance was adopted by sections and on its final adoption the following vote was had; Ayes: Exline, Banker, Bull, Spangler and Tucker (5) Nays: (0) Mayor approved the ordinance and it is Numbered 6695. Carried. Ordinance introduced for first reading Mar. 19, 1963. I An ordinance was introduced for second reading entitled: "An ordinance creating and defining a certain Lateral Sanitary Sewer District in the City of Salina, Kansas, designated as Lateral Sanitary Sewer District Number 483, and providing for the construction of a Lateral Sanitary Sewer in said Lateral Sanitary Sewer District Number 483, so created and providing for the payment of the cost thereof and for the levying of special assessments against the property in said district for the payment of the cost of such construction and for the issuing of bonds to pay the cost thereof." On motion of Commissioner Bull, seconded by Commissioner Spangler the ordinance was adopted by sections and on its final adoption the following vote was had; Ayes: Exline, Banker, Bull, Spangler and Tucker (5) Nays: (0) Mayor approved the ordinance and it is Numbered 6696. Carried. Ordinance introduced for first reading Mar. 19, 1963. i An ordinance was introduced for second reading entitled: "An ordinance providing for the construction of certain sidewalks, for the payment of the cost thereof, and how the same shall be assessed and the manner of the payment therefor." On motion of Commissioner Spangler, seconded by Commissioner Banker the ordinance was adopted by sections and on its final adoption the following vote was had; Ayes: Exline, Banker, Bull, Spangler and Tucker (5) Nays: (0) Mayor approved the ordinance and it is Numbered 6697. Carried. Ordinance introduced for first reading Mar. 19, 1963. C Public Hearing was held on Resolution Number 2695 for improvements on Neal Avenue. No protests written or oral.On motion of Commissioner Spangler, seconded by Commissioner Bull the resolution was accepted and the hearing adjourned. Carried. A resolution was introduced and passed entitled: "A resolution determining the advisability of certain street, sewer, water mains and hydrant improvements, estimating the cost thereof, defining the boundaries of the improvement district, method of assessment and apportioning the cost between the improvement district and the City at Large." On motion of Commissioner Spangler, seconded by Commissioner Bull the resolution was approved as read and the following vote was had; Ayes: Exline, Banker, Bull, Spangler, Tucker (5) Nays: (0) Mayor approved the resolution and it is Numbered 2702. Carried. A resolution was introduced and passed entitled: "A resolution directing and ordering a public hearing on the advisability of street, sewer and water mains and hydrant improve- ments in certain districts and giving notice of such hearing." On motion of Commissioner Spangler, seconded by Commissioner Bull the resolution was approved as read and the following vote was had; Ayes: Exline, Banker, Bull, Spangler, Tucker (5) Nays: (0) Mayor approved the resolution and it is Numbered 2703. Carried. Petition number 2675 was checked for paving Indiana Avenue from Iron to Stapler. On motion of Commissioner Spangler, seconded by Commissioner Banker the petition was approved. Carried. On motion of Commissioner Spangler, seconded by Commissioner Bull an ordinance was introduced for first reading relating the City Limits in Faith Addition. Ordinance passed: Number V�' Petition number 2677 was filed for the vacation of Summer Lane - formerly Dawn Street. On motion of Commissioner Spangler, seconded by Commissioner Bull the petition was referred to the City Attorney. Carried. Concrete Construction Bond was filed by 0. M. Wilbur d/b/a 0. M. Wilbur Construction Company. On motion of Commissioner Tucker, seconded by Commissioner Bull the bond was approved. Carried. Concrete Construction Bond was filed by J. E. Wilbur. On motion of Commissioner Tucker, seconded by Commissioner Bull the bond was approved. Carried. On motion of Commissioner Tucker, seconded by Commissioner Bull an ordinance was introduced for first reading relating to trimming and treating trees. An ordinance was introduced and passed entitled: "An ordinancemaking an approporiatior for the payment of certain claims." On motion of Commissioner Bull, seconded by Commissioner Tucker the ordinance was adopted by sections and on its final adoption the following vote was had; Ayes: Exline, Banker, Bull, Spangler and Tucker (5) Nays: (0) Mayor approved the ordinance and it is Numbered A-1164. Carried. On motion of Commissioner Bull the Board of Commissioners adjourned. City Clerk
