COMMISSIONERS' ROOM

SEPTEMBER 26, 1961
Regular Meeting of the Board of Commissioners September 26, 1961. Meeting
was called to order by Acting Mayor Exline, the roll was called and Commissioners
Exline, Banker, Spangler and Tucker and City Attorney Barta responded. Commission-
er Bull absent.
The minutes of the Regular Meeting of September 12, 196; and Zoning Board
Meeting of September 12, 1961 werezead and approved as read.
Bids received for gasoline at Street Department storage tanks as follows:
Continental Oil Company
Holzhuter Petroleum Company.
Motion of Commissioner Spangler, seconded by Commissioner Tucker award to
Continental Oil Company. Carried.
Hearing on Assessment Amounts on the East Half of Shalimar Plaza Addition,
• (Job 400).
No protests oral or written.
Motion of Spangler, seconded by Tucker approve. Carried.
City Manager reported on the following petitions:
2528 Paving Westchester Drive between 04i.o and Berkshire Drive in
Indian Rock Addition. 100%.
Motion of Spangler, seconded by Tucker approve for resolution.
2529 For water on Smither Street.
Motion of Tucker, seconded by Spangler approve.
An ordinance was introduced for second r eading entitled: "An ordinance provid-
ing for the construction of certain sidewalks, or the payment of the cost thereof,
and how the same shallbe assessed and the manner of the payment therefor."
Motion by Spangler, seconded by Tucker ordinance was read and adopted by sec-
tions and on its final adoption the roll was called and the following vote was had;
Ayes; Exline, Benker,;,Spangler and Tucker. (4) Nays: (0) Commissioner Bull absent.
Acting Mayor approved the ordinance and it is Numbered 6566.
An ordinance was introduced for secondzead ng entitled: "An ordinance providing
for the curbing, guttering, paving and gradin of CountryClub Road with concrete Thirty-
three (33) feet wide from back of curb to ack of curb, from the west line of Overhill
Road to the East line of Eastborough Road; curbing, guttering, paving and grading of
Des Moines Avenue with concrete, Thirty-three (33) feet wide from back of curb to back
of curb from the south line of Lot 16, Block 4, of Riverside Park Addition to the north
line of Lot 18, of said Addition; curbing, guttering, paving and grading of West side
• of Fourth Street with concrete, Twenty (20) feet wide from edge of slab to back of
curb, from the south line of Republic to the north line of Beloit; paving and grading
of Missouri Avenuewith concrete., Twenty-eight (28) feet wide from toe of gutter to
toe of gutter, from the north line of Stack Avenue to the north line of Greeley Avenue;
and providing for the payment of the cost thereof, and how the same shall b e assessed and
the manner of the payment of the cost thereof ."
Motion by Tucker, seconded by Spangler ordinance was read and adopted by sections
and on its final adoption the roll was called and the following vote was had; Ayes:
Exline, Banker, Spangler and Tucker (4) Nays: (0) Commissioner Bull absent. Acting
Mayor approved the ordinance and it is numbered 6567.
An ordinance was introduced for second reading entitled: "An ordinance vacat-
ing certain streets and easements."
Motion by Spangler, second by Banker ordinalcevus read and adopted by sections
and on its final adoption the roll was called and the following vote was had; Ayes:
Exline, Banker, Spangler and Tucker (4) Nays: (0) Commissioner Bull absent. Meting
Mayor approved the ordinance and it is Numbered 6568.
Following letters received from City PLanning Commission:
1. Recommending that Petition Number 2460 filed by M. L. Michaelsen for the
rezoning of Lots 40 and 42, less the west 20 feet thereof, and all of Lot 38; all in
Block 3, VanTrine's Addition to City of Salina, Kansas from District "C" to District
I'D" be denied.
Motion by Spangler, seconded by Tucker accept and petition denied. Carried.
• 2. Recommending that Petition No. 2517 filed by Paul B.Adrian for the rezoning
i of Lots 11 2 and 3 inBlock 29, to District "D" (Local Business) and Lots 4 and 5 to
District "B" (Duplex), all in Key Acres Addition be denied.
Motion by Spangler, seconded by Banker hold for checking. Carried.

use.
Motion by Spangler, seconded by Tucker hold for study. Carried.
5. Recommending that Petition No. 2522 as amended, filed by Leon Ashton for the
Lots
rezoning of 3, 4, 12, 13 and 14, Block 4, Southern Heights Addition to District
"D" , Salina, Kansas be granted.
Motion by Spangler, seconded by Tucker accept and publish Notice. Carried.
6. Recommending that Petition No. 2516 filed by Miles Parks for the rezoning
of the South 75 feet of Lots 2, 4 and 6, on Kirwin Avenue in Grounds of Kansas Wesleyal
University from Class "A" to Class "C" begranted.
Motion by Spangler, seconded by Tucker accept and publish Notice. Carried,

City Engineer. filed Final Estimate in the amount of $29,636.94 to Brown and
Brown, Inc., for Street Improvements provided for in Job 401.
Motion by Spangler, seconded by Tucker approve. Carried.
A resolution was introduced and passed entitled: "A Resolution pertaining to ttr.e
Flood Protection for the City of Salina, Kansas."
On motion of Commissioner Spangler, seconded by Commissioner Tucker resolution
adopted as read by the following vote; Ayes: Byline, Banker, Spangler and Tucker
(4) Nays: (0)
Commissioner Bull absent. Acting Mayor approved thexesolution and
it is Numbered 2551.
An ordinance was introduced and passed entitled: "An ordinance making an appro-
priation for the payment of certain claims."
On motion of Spangler, seconded by Banker, ordinance was read and adopted by
sections and on its final adoption the roll was called and the following vote was had;
Ayes: Exline, Banker, Spangler and Tucker (4) Nays: (0) Commissioner Bull absent.
Acting Mayor approved the ordinance and it is Numbered A-1086.

Meeting of Board of Zoning Appeals, September 26th, 1961. Meeting was called
to order by Acting Mayor Exline, the roll was called and Commissioners Exline, Banker,
Spangler and Tucker and City Attorney Barta responded. Commissioner Bull absent.
Building Application from Wm. J. Robertson to enclose a building on Lot 14,
Block 14, Southern Heights Addition, said building toface on 809 Hancock.
Motion by Spangler, seconded by Tucker approve for Hearing Tuesday, October 3rd,
1961 at four o'clock P. M.
Hearing was held on Appeal Notice filed by Glenn E. Moon for non-compliance
with the Real Yard Requirements of Ogdinance Number 5549 for the West One -Half of Lot
3, on State S reet, Plat "B" in the City of Salina, Kansas, known as 517 State Street.
No protests.
A resolution was introduced and passed entitled: "A Resolution relating to the
authorization of non-compliance with the Rear Yardquirements of Ordinace Number 5549
for the West One-half of Lot 3, on State Street, Plat "B" in the City of Salina, Saline
County, Kansas, known as Address 517 State S reet."
On motion of Tucker, seconded by Spangler resolution adopted as read by the fol-
lowing vote: Ayes: Exline, Banker, Spangler and Tucker (4) Nays: (0) Commis-
sioner Bull absent. Acting Mayor approved the resolution and it is Numbered 2550.
