Meeting was called to order by Mayor Bull, the roll was called and Commissioners Bull, Banker, Exline, Spangler and Tucker and City Attorney Barta responded. The minutes of the Regular Meeting of August 22nd, 1961 and Zoning Board Meeting of August 22nd, 1961 were zead and approved as read. Pursuant to Notice published in the Salina Journal bids received for improve- ments in balance of Belmont Addition (Job 412 as follows: Brown and Brown, Inc., $429,918.05 0. D. Wilmoth Construction Company $433,512.95 Walters Construction Company $4593195.80 Klover and Wallace, Inc. $448,176.40 Engineer's Estimate $44o.,764.00 Motion by Spangler, seconded by Banker contract awarded to Brown and Brown, Inc., • as per bid submitted in the amount of $429,918.05; and return checks to unsuccessful bidders. Carried. Motion by Spangler, seconded by Banker, contract ordinance for improvements in balance of telmont Addition, ( Job 412) introduced for first reading. Petition Number 2524 For curb -type sidewalk on west side of Lewis Street from Minneapolis Avenue to Ellsworth Avenue. 100% Motion of Spangler, seconded by Exline approve. Carried. Petition for vacating alley from North line of Lot 11, to 135 feet south of Crawford venue, inBlock 4, Southern Heights Addition. Motion by Spangler, seconded by Tucker refer to City Planning Commission. Carried Airport Lease with Skycraft Company. Motion by Exline,seconded by Tucker approve. Carried. Agreement with Uion Pacific Railroad for permission to construct, maintain and operate a six-inch sani£ary sewer pipe line across the Right -of -Way and under the main track of the Railroad Company's McPherson Branch at a point 117 feet distant, southerly of the North line of Section 36, Township 14, South, Range 3, West of the Sixth Prin- cipal Meridian at Salina, Kansas. Resolution introduced and passed relating to Agreement with Union Pacific Rail- road for permission to construct a six-inch sanitary sewer pipe line -across the right- of-way and under the main track of the McPrerson Branch. The City Clerk reported that the assessment rolls for the following improvement to wit: Curb, gutter and paving certain streets, installation of sanitary sewers and sidewalks, in East Half of Shalimar Plaza Addition as authorized by Resolution Number 2321 passed by the Board of Commissioners on March 15, 1960 has been determined and that final costs have been filed by the City Engineer. Motion by Exlire, seconded by Spangler that the City Clerk be directed to pub- lish notice in the official paper at least once not less than ten days prior to the date of September 19th, 1961, the4tte set for the hearing on said assessments, and that at thesame time notice is published, to mail to the owners of property made liable to pay • the assessments , at their last known postoffice address,a notice oftihe hearing and a statement of the cost proposed to be assessed against the land so owned and assessed. Meeting was called to order by Mayor Bull, the roll was called and Commissioners Bull, Banker, Exline, Spangler and Tucker and City Attorney Barta responded. Hearing was held on Notice of Appeal filed by Gregory Paglia for non-compliance with Zoning Ordinance with insufficient Lot Frontage and Lot Area Requirements for: West 45 feet of Lot Number 12, on Kirwin Avenue in Grounds of Kansas Wesleyan University Addition, Salina, Kansas, (Address known as 122 and 124 West Kirwin). No protests. Aresolution was introduced and read entitled: "A Resolution relating to the authorization of non-compliance with the Insufficient Lot Frontage and Lot Area Requirements of Ordinance Number 5549 for the West 45 feet of Lot 12, on Kirwin Avenue in the Grounds of Kansas Wesleyan University Addition to the City of Salina, Saline County, Kansas,.
