08-15-1961 MinutesCOMMISSIONERS PROCEEDINGS, REGULAR MEETING • COMMISSIONERS ROOM, SALINA, KANSAS AUGUST 15, 1961 Regular Meeting of the Board of Commissioners August 15th, 1961. Meeting was called to order by Mayor Bull, the roll was called and Commissioners Bull, Banker, Ex - line, Spangler and Tucker and City Attorney Barta responded. The minutes of the Regular Meeting of August 8th, 1961 and Zoning Board Meeting of August 8th, 1961 were read and approved as read. Resolution introduced and passed entitled: BE IT RESOLVED That the Attorney General of the State of Kansas, be and he is hereby called to make a complete investi- gation of the conduct and activities of the Board of Commissioners and of the Police Department of the City o Salina, Kansas, and if on such investigation he shall find that there is a reasonable cause for such complaint, to institute any proceedings which he may deem necessary and proper." Motion by Commissioner Spangler, seconded by Commissioner Banker resolution adopted as read by the following vote: Ayes: Bull. Banker, Exline, Spangler and Tucker (5) Nays: (0) Carried. 1 •Letter from City P1anni.ng Commission held over on Swander Trailer Court on Lot 20, Block 49, Military Addition. Motion by Spangler, seconded by Exline accept and petition denied. Carried. Petition Number 2511 for paving of Riverside Drive from Ohio Streetto Oakdale Avenue, held over. Petition filed August 15th, 1961 against the paving of Riverside Drive from Ohio Street to Oakdale Avenue. Motion by Spangler, seconded by Tucker returned Petition Number 2511; and petition against, for checking to City Mamger. Carried. Petition Number 2514 for concrete paving of the 600 Block on North Seventh, from Lincoln Street, north one black to Decatur, now had 56% for paving. Motion by Spangler, seconded by Tucker, approved for resolution. Carried. Resolution introduced for secondxeading entitled: "A Resolution relating to the paving and grading of Missouri Avenue with concrete, Twenty -Eight (28) feet wide fromtne of gu ter to toe of gutter, from tr;e north line of Stack Avenue to the north line of GreeleyAvenue." Motion of Commissioner Exlire, seconded by Commissioner Tucker, resolution adopted as read by the following vote; byes: Bull, Banker, Exline, Spangler and Tucker (5) Nays: (0) Mayor approved thexesolution and it is Numbered 2543. An ordinance was introduced for second madin entitled: "An ordinance ante mala.ng a levy of taxes for general revenue and other purposes by the City of Salina, Kansas, for th� year 1962." • Motion by Exlire , seconded by Tucker, ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Bull, Banker, Ekli.ne, Spangler and Tucker (5) Nays: (0) Mayor approved the ordi- nance and it is Numbered 6563. An ordinance was introduced for secondxeading entitled; "An ordinance providing for the amendment of Zoning Ordinance Number 5549 and the Zoning District Map therein and thereby adopted and providing for the rezoning of oertai.n property within the City and prescribing the proper uses thereof." Motion by Tucker, seconded by Spangler ordinance was read and adopted by sec- tions and on its final adoption the roll was called and the following vote was had; Ayes: Bull, Banker, Exline, Spangler and Tucker (5) Nays: (0) Mayor approved the ordinance and it is Numbered 6564. Resolution introduced and passed finding it necessary to condemn easements for Sanitary Trunk Line Sewers. Motion by Exjine, seconded by Spangler, resolution adopted asread by the following vote: Ayes: Bull, Banker, Exlin', Spangler and Tucker. (5) Nays: (0) Mayor approved the Resolution and it is Numbered 2544• Resolution for payment of claim of John E. Carlin, et al., in the amount of :,x2900.00 for crop damage under Flood Control Agreement was introduced and passed. Motion by Exline, seconded by Spangler, resolution adopted aszead by the fol- • lowing vote; Ayes: Bull, Banker, Exline, Spangler and Tucker (5) Nays: (0) Mayor approved the resolution and it is Numbered 2545. • • • 1 1 0 Petition for rezoning of Lots 1,20 Block 29, to Local Business and Lots 4 and 5, to "B" Duplex dwelling, all in KeyAcres Addition. Motion by Exline, seconded by Tucker, referred to City Planning Commission. Petition for curb, gutter, street, water, sewer, storm sewer and sidewalks at the end of blocks,in all of KeyAcres Addition to the City of Salina, Saline County, Kan- sas, which is currently unimproved. 20 -year plan. Motion by Exline, seconded by Tucker refer to City Manager. Proclamation by Mayorfbr Fire Prevention Week, October 8th through 11th, 1961.Filec�. City Clerk instructed to advertise for bids tote received September 1961, at four o'clock P. M. on balance of Belmont Addition improvements. Motion by Exlins,seconded by Tucker approved. Airport Restaurant Lease Agreement entered into by the City of Salina, Kansas, and Angeline Butler for the purpose of operating an eating establishment to serve the patrons of said Salina Municipal Airport and the general public. Motion by Spangler, seconded by Tucker approved. Carried. An ordinance was introduced and passed entitled: "An ordinance making an appro- priation for the payment of certain claims." Motion by Exlire , seconded by Tucker ordinance was read and adopted by sections and on its final adoption the roll was called and the following vote was had; Ayes: Bull, Banker, Exline, Spangler and Tucker (5) Nays: (0) Mayor approved the ordi- nance and it is Numbered A-1082. Meeting was called to order by Mayor Bull, the roll was called and Commissioners Bull, Banker, Exline, Spangler and Tucker and City Attorney Barta responded. Hearing was held on Appeal Notioe filed by Ralph Swearingen for non-compliance with the 25 -foot setback requirement for Lot 5, Block 2, Wilbre Addition to the City of Salina, Saline County, Kansas, address 654 Sylvan Place. No protests. Resolution introduced and passed entitled: "A resolution relating to the authorization of non-compliance with the twenty-five foot setback requirements of Ordinance Number 5519 for Lot 5, Block 2, Wilbre Addition to the City ofSalina, Saline County, Kansas, address known as 654 Sylvan Place." Motion by Exliie, seconded by Tucker resolution adopted as read by the following vote; Ayes: Bull, Banker, Exline, Spangler and Tucker (5) Nays: (0) Mayor approved the resolution and it is Numbered 2516.
