JUNE 20, 1961
Regular Meeting of the Board of Commissioners June 20, 1961. Meeting was
called to order by Mayor Bull, the roll was called and Commissioners Bull, Banker,
Exline, Spangler and Tucker and City Attorney Barta responded.
The minutes of the Regular Meeting of June 13th, 1961 were read and approved
as read.
Motion by Commissioner Spangler seconded by Commissioner Tucker, that the Airport
Cafe be referred to the City Manager and the Airport Manager, to see that the terms
of the lease are carried out and that they pay up all bills within reasonable length of
time or be given an evication notice. Carried.
The following letters received from City Planning and Zoning Commission: ,
Recommending that Petition Number 2486 filed by Clinton L. Whelchel for the
rezoning from "B" to "D" for all of Lots 1, 2, 3 and 4, Block 1, Phillips East Salina
Addition be granted. •
Motion by Commissioner Spangler seconded by Commissioner Banker, accept and
City Clerk publish Notice. Carried.
Recommending that Petition Number 2485 filed by W.C. Ziegert, District Manager
of Standard Oil Company, for the rezoning from "B" to "D", South 75 feet of Lots 8 and
9, Block 1, Fruitland Addition be granted.
Motion by Commissioner Exline, seconded by Commissioner Tucker, accept and
City Clerk publish N$tice. Carried.
Recommending that Petition Number 2499 filed by Cloyd E.Dent, for Special Class
Zoning for a Trailer Court on Lot 18, Block 12, Episcopal Military Institute Addition,
to Salina, Kansas, be denied.
Motion by Commissioner Spangler, seconded by Commissioner Banker, accept and
petition denied. Carried.
A resolution was introduced for second r eading entitled: "A hesolution relat-
ing to the curbing, guttering, paving and grading the West side of Fourth Street
with concrete, Twenty (20) feet wide, from edge of slab to back of curb, from the south
line of Republic Avenue tothe north line of Beloit."
Motion by Commissioner Exline, seconded by Commissioner Tucker, resolution
adopted as read and on its final adoption the roll was called and the following vote
was had; Ayes: Bull, Banker, Exline, Spangler and Tucker (5) Nays: (0) Mayor
approved the resolution and it is Numbered 2527.
A resolution was introduced for second reading entitled: "A Resolution relat-
ing to the curbing, guttering, paving and grading of Des Moines Avenue with conerete,
Thirty-three (33) feet wide from back of curb to back of curb, from the south line of
Lot 16, Block 4. of Riverside Park Addition to he north line of Lot 18 of said addition." •
Motion by Commissioner Tucker, seconded by Commissioner Spangler, resolution
adopted as read and on its final adoption the roll was called and the following vote was
had; Ayes: Bull, Banker, Exline, Spangler and Tucker (5) Nays: (0) Mayor
approved the resolution and it is Numbered 2528.
An ordinance was introduced for second reading entitled: "An ordinance for
the vacation of a certain alley within the City of Salina, Saline County, Kansas."
Motion by Commissioner Spangler, seconded by Commissioner Banker, -the ordi-
nance w as read and adopted by sections and on its final adoption the roll -vas called
and the following vote was had; Ayes: Bull, Banker, Exline, Spangler and Tucker
(5) Nays: (0) Mayor approved the ordinance and it is Numbered 6542.
An ordinance was introduced for s econdseading entitled: "An ordinance creat-
ing and defining a certain lateral sanitary sewer district in the City of Salina, Kansas
designated as Lateral Sanitary Sewer District Number 444, and providing for the con-
struction of a Lateral Sanitary Sewer in said Lateral Sanitary Sewer District Number
444,, so created and providing for the payment of the cost thereof and for the levying of
special assessments against the property in said district for the payment of the cost
of such construction and for the issuing of bonds to pay the cost thereof."
Motion byCommissioner Banker, seconded by Commissioner Spangler the ordinance
was read and adopted by sections and on its final adoption the roll was called and the
following vote was had; Ayes: Bull, Banker, Exlim , Spangler and Tucker (5) Nays:
(0) Mayor approved the ordinance and it is Numbered 65.3.
A resolution was introduced and passed entitled: "A Resolution relating to •
the disposition and sale of The Code of the City of Salina, Kansas, 1960."

Motion by Commissioner Spangler, seconded by Commissioner Banker resolution
adopted as read, and on its final adoption the roll was called and the following vote
was had; Ayes: Bull, Banker, Exline, Spangler and Tucker (5) Nays: (0) Mayor ap-
proved the resolution and it is Numbered 2529•
A resolution was introduced and passed directing City Clerk to publish Notice
of the call forthe tedemption and payment of outstanding Waterworks Revenue Bonds,
Series "C", aggregating $4343000.00.
Motion by Commissioner Tucker, seconded by Commissioner Banker, resolution
adopted as read and on its final adoption the roll was called and the following vote
was had; Ayes: Bull, Danker, Exline, Spangler and Tucker (5) Nays: (0) Mayor
approved the resolution and it is Numbered 2530.
A resolution was introduced and passed directing the City Clerk to publish notice
of the call for the redemption and payment of outstanding Waterworks Revenue Bonds,
Series "B", aggregating $748,000.00.
' Motion by Commissioner Tucker, seconded by Commissioner Banker, resolution
adopted assead and on its final adoption the roll was called and the following vote
was had; Ayes: Bull, Banker, Exline, Spangler and Tucker (5) Naysr. (0) Mayor
• approved the resolution and it is Numbered 2531.
Motion by Commissioner Spangler, seconded by Commissioner Banker, ordinance
introduced for first reading entitled: "An ordinance declaring the waterworks System
and the Sewage Disposal System of the City of Salina, Kansas, including all future im-
provements and extensions thereof to be a Water and Sewage System, providing for the
operation and maintenance thereof and creating a Water and Sewage Department for the
operation of said Water and Sewage System."

Motion by Commissioner Spangler, seconded by Commissioner Banker, ordinance
introduced for first reading entitled: "An ordinance prescribing the rates to be
charged for the use of and services rendered by the Water and Sewage System of the City
of Salina, Kansas, and establishing regulations with respect thereto; prescribing
the manner and payment of accounts when due; providing for the disconnection of water
and sewer servioe for non-payment of accounts; providing a penalty for the tampering
with the water and sewage system; and repealing all ordinances or parts thereof in
conflict herewith."

Motion by Commissioner Spangler, seconded by Commissioner Tucker, City Clerk
was instructed to publish Notice in the official State Paper, of the call for the
redemption and payment of Waterworks Revenue Bonds,Series "C", dated October 1, 1955,
becoming due on August 1st in the years 1962 to 1970 inclusive, Numbered 167 to 600,
in the denomination of $1,000.00 each, aggregating $434,000.00. Carried.

• was instructed to publish Notice in the official State paper, of the call for the
redemption and payment of Waterworks Revenue Bonds, Series "B", dated August 1, 1953,
` becoming due on August 1st in the years 1962 to 1973 inclusive, Numbered 253 to 1,000,
each, aggregating $748,000.00. Carried.
Application for Cereal Malt Beverage License received from Darlene Gebhardt,
d/b/a "Gabby's, 136 North Santa Fe Avenue.
Motion by Commissioner Spangler, seconded by Commissioner Banker approve. Carried
Petition for paving 300 and 40OBlocks on Missouri Avenue (from Gypsum to Greeley.
Motion by Commissioner Tucker, seconded by Commissioner Banker referred to
City Manager.
Petition for new storm sewer from the intersection of Walnut and Clark, on Clark
Street, south to existing storm sewer at intersection of South Street and Clark Street.
Motion by Commissioner Spangler, seconded by Commissioner Banker referred to
City Manager.
Motion by Commissioner Spangler, seconded by Commiss oner Tucker, ordinance in-
troduced for first reading levyi special assessments for water and sewer services.

Motion by Commissioner Spangler, seconded by Commissioner Banker, that the City
Clerk be authorized to install on a three months trial basis overparking fine boxes;
fifty cents up to 24 hours; over 24 hours and until warrant issued $1.00; and when
warrant issued it be $5.00 instead of $2.00. Carried.
• Motion by Commissioner Exline) seconded by Commissioner Banker, that the City
Clerk be instructed to advertise for bids to be received July Ift, 1961 at 10:00 A. M.
on the &33600,000.00 Water and Sewer Revenue Bonds. Carried. Al
Motion by Commissioner Exline, seconded by Commissioner Tucker, that Keith
Williams file a new petition and pay the $25.00 fee if he wishes to bring up the
matter of his rezoning again. Carried.
Mayor appointed the following:
L. 0. Bengtson re -appointed a member of City Planning and Zoning Commission,
for a term ending May 1, 1961.
John Ritter re -appointed a member of Blue Jay Baseball Park Committee for
a term ending April 3, 1961.
.Dean Groves appointed in place of Fred Kelly, a member of Blue Jay Baseball
Park Committee for a term ending April 3, 1964.
Motion by Commissioner Spangler, seconded by Commissioner Tucker above
appointments approved. Carried.
An ordinance was introduced and passed entitled: "An ordinance making an appro-
priation for the payment of certain claims."
Motion by Commissioner Spangler, seconded by Commissioner Banker ordinance was
read and adopted by sections and on its final adoption the roll was called and the fol-
lowing vote was had; Ayes: Bull, Banker, Exline, Spangler and Tucker (5) Nays: (0)
Mayor approved the ordinance and it is Numbered A-1075.
On motion of Commissioner Spangler Board of Commissioners adjourned.

Meeting of Board of Zoning Appeals, June 30th, 1961. Meeting was called to
order by Mayor Bull, the roll was called and Commissioners Bull, Banker, Exline,
Spangler and Tucker and City Attorney Barta responded.
Building Application received from John T. Ringle, 541 Willis Avenue.
Motion by Commissioner Spangler, seconded by Commissioner Banker, approve for
publication of Hearing, subject to lettersfrom neighbors. Carried.
On motion of Commissioner Exline, Board of Zoning Appeals adjourned.
