06-28-1965 Minutes4 1-812 COMMISSIONERS PROCEEDINGS - REGULAR MEETING COMMISSIONERS ROOM Salina, Kansas June 28, 1965 Regular Meeting of the Board of Commissioners June 28, 1965. Meeting was called to order by Mayor Stark, the roll was called and Commissioners Stark, Casebeer, Exline, Rundquis , Waddell, City Attorney Bengtson, and City Manager Olson responded. i The Minutes of the Regular Meeting of June 21, 1965 were read and approved. An ordinance was introduced for second reading entitled: "An ordinance determining the license fee for bowling alleys within the City of Salina, Kansas; amending 16-205 of the Code of the City of Salina, 1960, and repealing said original section." On motion of Commissioner Waddell, seconded by Commissioner Rundquist the ordinance was adopted by sections and on its final adoption the following vote was had: Ayes: Stark, Casebeer, Exline, Rundquist, Waddell (5). Nays: (0). Mayor approved the ordinance and it is numbered 6861. Carried. Ordinance introduced for first reading June 21, 1965. An ordinance was introduced for second reading entitled: "An ordinance making it unlawf to have, keep or maintain, for hire or profit, any billiard or pool tables without securing a license therefor ; providing the amount of said license; amending 4-401 of The Code of the City of Salina, Kansas, 1960; and repealing the original section." On motion of Commissioner Rundquist, seconded by Commissioner Casebeer the ordinance was adopted by sections and on its final adoption the following vote was had: Ayes: Stark, Casebeet, Exline, Rundquist, Waddell (5). Nays: (0). Mayor approved the ordinance and it is numbered 6862. Carried Ordinance introduced for first reading June 21, 1965. An ordinance was introduced for second reading entitled: "An ordinance providing the license fee for taxi cabs, the manner of revocation of licenses, and setting the minimum age of any licensee; amending 16-1010 of The Code of the City of Salina, Kansas, 1960, and repealing the said original section." On motion of Commissioner Casebeer, seconded by Commissioner Rundquist the ordinance was adopted by sections and on its final adoption the following vote was had: Ayes: Stark, Casebeer, Exline, Rundquist, Waddell (5). Nays: (0). Mayor approved the ordinance and it is numbered 6863. Carried. Ordinance introduced for first reading June 21, 1965. On motion of Commissioner Waddell, seconded by Commissioner Rundquist an ordinance was introduced for second reading entitled: "An ordinance providing the compensation to be paid to the City of Salina by the Grantee of the motor bus franchise within the City of Salina, Kansas; amending Section 11 of Ordinance Number 6803 and repealing said original section ." On motion of Commissioner Waddell, seconded by Commissioner Exline the resolution was adopted as read and the following vote was had: Ayes: Stark, Casebeer, Exline, Rundquist, Waddell. (5). Nays: (0). Mayor approved the resolution and it is numbered 2826. Carried. Resolution was introduced for first reading June 21, 1965. A resolution was introduced for second reading entitled: "A RESOLUTION relating to the paving and grading of Missouri Avenue with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the south line of Gypsum Avenue to the north line of Stack Avenue." On motion of Commissioner Waddell, seconded by Commissioner Exline the resolution was adopted as read and the following vote was had: Ayes: Stark, Casebeer, Exline, Rundquist, Waddell. (5). Nays: (0). Mayor approved the resolution and it is numbered 2827. Carried. Resolution was introduced for first reading June 21, 1965. A resolution was introduced for second reading entitled: " A RESOLUTION relating to the curbing, guttering, paving and grading of Diamond Drive with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the east line of U. S. 81 Highway east to the City Limits." On motion of Commissioner Waddell, sec nded by Commissioner Exline the resolution was adopted as read and the following vote was 3ad: Ayes: Stark, Casebeer, Exline, Rundquist, Waddell (5). Nays: (0). Mayor approved th resolution and it is numbered 2828. Carried. (5). Nays: (0). Mayor approved the resolution and it is numbered 2829. Carried. Resolution was introduced for first reading June 21, 1965. A resolution was introduced for second reading entitled: "A RESOLUTION relating to the curbing, guttering, paving and grading of the East side of Fourth Street with concrete (Twenty-two (22) feet wide from back of curb to back of curb) from the south line of Beloit Avenue to the north line of Minneapolis Avenue, the same being an intervening connecting street." On motion of Commissioner Waddell, seconded by Commissioner Exline the resolution was adopted as read and the following vote was had: Ayes: Stark, Casebeer, Exline, Rundquist, I Waddell (5). A resolution was introduced for second reading entitled: "A RESOLUTION relating to the curbing, guttering, paving and grading of the East side of Fourth Street with concrete I (Twenty-two (22) feet wide from back of curb to back of curb) from the north line of Bond I Street to the south line of Crawford Avenue, the same being an intervening connecting street!" On motion of Commissioner Waddell, seconded by Commissioner Exline the resolution was adopted as read and the following vote was had: Ayes: Stark, Casebeer, Exline, Rundquist, Waddell (5). Nays: (0). Mayor approved the resolution and it is numbered 2831. Carried. Resolution was introduced for first reading June 21, 1965. A resolution was introduced for second reading entitled:"A RESOLUTION relating to the curbing, guttering, paving and grading of the West side of Fourth Street with concrete (Twenty-two (22) feet wide from back of curb to back of curb) from the south line of Bond j Street to the north line of Republic Avenue, the same being an intervening connecting street.;" i On motion of Commissioner Waddell, seconded by Commissioner Exline the resolution was adopted as read and the following vote was had: Ayes: Stark, Casebeer, Exline, Rundquist, Waddell (5). On motion of Commissioner Waddell, seconded by Commissioner Exline the resolution was adopted as read and the following vote was had: Ayes: Stark, Casebeer, Exline, Rundquist, Waddell (5). Nays: (0). Mayor approved the resolution and it is numbered 2833. Carried. I On motion of Commissioner Waddell, seconded by Commissioner Exline the resolution was adopted as read,and the following vote was had: Ayes: Stark, Casebeer, Exline, Rundquist, Waddell (5). Carried. rResolution was introduced for first reading June 21, 1965. j A resolution was introduced for second reading entitled: "A RESOLUTION relating to the curbing, guttering, paving and grading of Eastborough Road with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the south line of Crestview Drive to the north line of Seitz Drive, the same being an intervening connecting street." On motion of Commissioner Waddell, seconded by Commissioner Exline the resolution was adopted as read and the following vote was had: Ayes: Stark, Casebeer, Exline, Rundquist, Waddell (5). Nays: (0). Mayor approved the resolution and it is numbered 2836. Carried. Resolution was introduced for first reading June 21, 1965. 4 1.8-4 Harold Pellegrino was present and presented the City with Special Traffic Law Enforcement Award. A letter was received from City -Wide Mortgage Company regarding the vacation of the North one foot of an easement on Lot 6, Block 5, Faith Addition. On motion of Commissioner Rundquist, seconded by Commissioner Waddell the vacation of the north one foot of the easement was approved. Carried. Petition Number 2839 was filed protesting the rezoning at Prescott and Santa Fe Avenue. On motion of Commissioner Rundquist, seconded by Commissioner Exline the petition was referred to the City Planning Commission. Carried. Petition Number 2840 was filed by Smoky Hill Development Company, Inc. for the rezoning of property west of Ohio Street and south of Greeley Street. On motion of Commissioner Rundquist, seconded by Commissioner Waddell the petition was referred to the City Planning Commission. Carried. Beer application was received from Johnny A. Krause, for 1513 South Ninth Street. On motion of Commissioner Waddell, seconded by Commissioner Exline the application was held over to meeting of July 12 and referred to the City Attorney. A letter was received from the City Planning Commission regarding Petition 2833 for the rezoning Lot 2, and North 40 feet of Lot 4, Santa Fe Avenue, Prescott Addition to Zone "D". The City Planning Commission recommended the denial of the rezoning. On motion of Commissio Rundquist, seconded by Commissioner Casebeer, the recommendation was accepted and the petiti was denied. Carried. A letter was received from the City Planning Commission regarding Petition Number 2834 for the rezoning of the East 672 feet of Lot 1 and the East 672 feet of North 2 of Lot 3, on Highland Avenue, Prescott Addition to Zone "D". The City Planning Commission recommended the denial of the rezoning. On motion of Commissioner Rundquist, seconded by Commissioner Casebeer, the recommendation was accepted and the petition was denied. Carried. A Resolution was introduced and passed entitled: "LICENSE AGREEMENT. KNOW ALL MEN BY THESE PRESENTS: That the City of Salina, Kansas, a municipal corporation, organized, incorporated and existing under and by virtue of the laws of the State of Kansas hereinafter referred to as the "grantor", does hereby grant to Supersweet Feeds, the same being a division of the International Milling Company, Inc., hereinafter referred to as the "grantee" the priviledge of constructing a scale on the following described property, to -wit: The West Twenty-one (21) feet of Fifth Street from the North line of Lot Forty (40) to the South line of Lot Thirty-seven (37), all in Block Ten (10) in Calkins Addition to the City of Salina, Saline County, Kansas, subject, however, to the following conditions, restrictions and limitations, to -wit: " On motion of Commissioner Waddell, seconded by Commissioner Rundquist the resolution was approved as read and the following vote was had: Ayes: Stark, Casebeer, Exline, Rundquist, Waddell (5). Nays: (0). Mayor approved the resolution and it is numbered 2825. Carried. A report was received from the City Manager regarding petitions 2837 and 2838 for street lights. City Manager recommended that the petitions be denied. On motion of Commissioner Rundquist, seconded by Commissioner Exline the recommendation was accepted and the petitions were denied. Carried. Petition Number 2842 was filed to eliminate parking on 300 block of Center Street. On motion of Commissioner Waddell, seconded by Commissioner Exline the petition was referred to the City Manager to be checked. Carried. Communication was received from Kennedy and Berkley Law Offices regarding acquisition of certain public property. On motion of Commissioner Waddell, seconded by Commissioner Rundquist the communication was referred to the City Manager. Carried. Communication was received from Midway U. S. A. Drag Association requesting a portion of the runway facilities at Schilling for drag races. On motion of Commissioner Waddell, seconded by Commissioner Rundquist the communication was referred to Salina Airport Authority A motion was made by Commissioner Exline, seconded by Commissioner Rundquist to approve the construction of a bridge in Kenwood Park with the County on 50-50 basis. Total cost not to exceed $15,000.00. Carried. Mr. Muller, # 15 College Court, appeared regarding chickens at # 14 College Court. Advised that the City had checked it but could find no violation, but that he could file a complaint in Police Court for nuisance.
