09-20-1971 MinutesCity of Salina, Kansas Commissioners' Meeting September 20, 1971 The Regular Meeting of the Board of Commissioners met in the Commissioners' Room, City -County Building, on Monday, September 20, 1971, at four o'clock p.m. The Mayor asked everyone to stand for the Pledge of Allegiance to the Flag and a Moment of Silent Prayer. There were present: Mayor Robert C. Caldwell, Chairman presiding Commissioner Norma G. Cooper Commissioner Mike Losik, Jr. Commissioner Jack Weisgerber comprising a quorum of the Board, also: L. 0. Bengtson, City Attorney Norris D. Olson, City Manager D. L. Harrison, City Clerk Absent: Commissioner Leon L. Ashton The Minutes of the Regular Meeting of September 13, 1971, were approved as mailed. THE MAYOR PROCLAIMED The Month of October - ''SALINA UNITED WAY MONTH". The proclamation was read by Dick Brown, Campaign Chairman. THE MAYOR PROCLAIMED September 20 - 26, 1971 - "SQUARE DANCE WEEK". The proclamation was read by Mrs. Preston Grandstaff. THE CITY ENGINEER reported on Petition Number 3191, which was filed by Melvin Crowder, Jr., for the installation of water main and paving on Prospect Avenue, that there are nine property owners, of which five signed the petition, which equals 56%, making it a sufficient petition. A motion was made by Commissioner Weisgerber, seconded by Commissioner Losik to accept the City Engineer's report and approve the petition. Ayes: (4j. Nays: (0). Motion carried. A MOTION was made by Commissioner Losik, seconded by Commissioner Weisgerber to instruct the City Clerk to publish a "Notice of Bond Sale" for bids to be received October 18, 1971 for Series P-214 for $245,861.00 for 10 years, for street and sewer improvements. Ayes: (4). Nays: (0). Motion carried. PETITION NUMBER 3194 was filed by G. C. Etherington for the acceptance of the plat containing 4.2 acres known as Country Hills Addition Number 1. A motion was made by Commissioner Cooper, seconded by Commissioner Losik to refer the petition to the Salina City Planning Commission. Ayes: (4). Nays: (0). Motion carried. PETITION NUMBER 3195 was filed by G. C. Etherington for the annexation and zoning to District "C" (Apartment District) of Country Hills Number 1. A motion was made by Commissioner Weisgerber, seconded by Commissioner Losik to refer the petition to the Salina City Planning Commission. Ayes: (4). Nays: (0). Motion carried. PETITION NUMBER 3196 was filed by Mrs. Cecil Leshley for city water service from U. S. 81 Highway on Stimmel Road for an approximate distance of 700 feet to service as far as 229 Stimmel Road. A motion was made by Commissioner Losik, seconded by Commissioner Weisgerber to refer the petition to the City Engineer. Ayes: (4). Nays: (0).' Motion carried. PETITION NUMBER 3197 was filed by Jerry Pittenger for 4 street lights on East Wayne, from Ohio to the City Limits. A motion was made by Commissioner Cooper, seconded by Commissioner Weisgerber to refer the petition to the City Engineer. Ayes: (4). Nays: (0). Motion carried. Bengtson, City Attorney Norris D. Olson, City Manager D. L. Harrison, City Clerk Absent: Commissioner Leon L. Ashton THE CITY ENGINEER reported on Petition Number 3193 which was filed by Richard J. Neuman, for the installation of a city sanitary sewer to serve the property known as 1739 Glen. The City Engineer reported that there five property owners in the benefit district, and that four of them are connected to an existing sewer on Channel Road and have paid a sewer connection fee of $150.00, but have never been in a sewer district. The City Engineer recommended the petition be accepted for construction. A motion was made by Commissioner Cooper, seconded by Commissioner Weisgerber to accept the City Engineer's recommendation to install the sanitary sewer. Ayes: (4). Nays: (0). Motion carried. Harrison, City Clerk j PETITION NUMBER 3198 was filed by Francis Gorrell for the rezoning of Lots 2, 4, 6, Block 16, and Lots 1, 3, 5, Block 16, Pacific Addition to District "F" (Light Industrial District). A motion was made by Commissioner Losik, seconded by Commissioner Cooper to refer the petition to the Salina City Planning Commission. Ayes: (4). Nays: (0). Motion carried. PETITION NUMBER 3199 was filed by Dr. L. F. Eaton for the vacation of the utility easements on Lots 6, 7, 8, 9, Block 3, Westport Exchange. Dr. Eaton was present and said that he is the only property owner involved, and had overlooked the vacation of these easements, and would appreciate the City Commission giving this their prompt attention, so they could start construction of a motel .before winter sets in. A motion was made by Commissioner Weisgerber, seconded by Commissioner Losik to refer the petition to the City Engineer. The City Attorney suggested that since there will be no meeting next week, the City Commissioners could put an ordinance on first reading to speed up the process, and approve or deny it at the October 4th meeting, when the City Engineer makes his recommendation. Commissioner Losik said he realizes bad weather is approaching, but if they do this they will be establishing a precedent, and will have to do it for others who might have similar problems. A motion was made by Commissioner Weisgerber, seconded by Commissioner Cooper to introduce an ordinance for first reading for the vacation of the utility easements, as requested in Petition Number 3199• Ayes: (4). Nays: (0). Motion carried. Ordinance Passed: Number: THE MAYOR again mentioned that Dr. Paul Renich,of Kansas Wesleyan University, is Chairman of the United Nations Day, which is October 24, 1971. AN APPROPRIATION ORDINANCE was introduced and passed entitled: "AN ORDINANCE making an appropriation for the payment of certain claims." (bills - $245,022.97)• A motion was made by Commissioner Losik, seconded by Commissioner Cooper to adopt the ordinance as read and the following vote was had: Ayes: Cooper, Losik, Weisgerber, Caldwell (4). Nays: (0). Carried. Commissioner Ashton absent. The Mayor approved the ordinance and it is numbered A-1597. AN APPROPRIATION ORDINANCE was introduced and passed entitled: "AN ORDINANCE making an appropriation for the payment of certain claims." (payroll - $92,426.13). A motion was made by Commissioner Losik, seconded by Commissioner Cooper to adopt the ordinance as read and the following vote was had: Ayes: Cooper, Losik, Weisgerber, Caldwell (4). Nays: (0). Carried. Commissioner Ashton absent. The Mayor approved the ordinance and it is numbered -A-1598.
