09-13-1971 Minutes9 City of Salina, Kansas Commissioners' Meeting September 13, 1971 The Regular Meeting of the Board of Commissioners met in the Commissioners' Room, City -County Building, Monday, September 13, 1971, at four o'clock p.m. The Mayor asked everyone to stand for the Pledge of Allegiance to the Flag and a Moment of Silent Prayer. There were present: Mayor Robert C. Caldwell, Chairman presiding Commissioner Norma G. Cooper Commissioner Mike Losik, Jr. Commissioner Jack Weisgerber comprising a quorum of the Board, also: L. 0. Bengtson, City Attorney Norris D. Olson, City Manager D. L. Harrison, City Clerk Absent: Commissioner Leon L. Ashton THE CITY ENGINEER reported on Petition Number 3173, which was filed by Willis Houltberg on June 23, 1971, for a school crossing guard at the intersection of Santa Fe Avenue and Bond Street, and recommended additional signs be installed, and wig wag lines be painted in both lanes, which will help this particular intersection. A motion was made by Commissioner Losik, seconded by Commissioner Cooper that a crossing guard be hired immediately for the intersection of Santa Fe Avenue and Bond Street; and that all school crossing guard locations be reviewed in the near future. Ayes: Cooper, Losik (2). Nays: Weisgerber (1). Commissioner Weisgerber feels all crossing guard locations should be reviewed first, before a crossing guard is hired for this location. Mayor Caldwell abstained. Carried. THE CITY ENGINEER reported on Petition Number 3189, which was filed by Roy Presley on August 24, 1971, for the extension of curbing, guttering, paving of Faith Drive from Meadowbrook Road to the east line of Lot 15, Block 9, Faith Addition, and reported that 600 of the owners signed making it a sufficient petition. A motion was made by Commissioner Losik, seconded by Commissioner Cooper, in view of Resolution Number 3064 adopted June 29, 1970 by the Board of Commissioners, to table this petition until October 4, 1971 so the Commissioners can make a decision pertaining to the context of the Resolution. Ayes: (4). Nays: (0). Motion carried. The Minutes of the Regular Meeting of August 30, 1971 were approved as corrected. Commissioner Losik stated the Public Safety Officer Program was omitted from the items to be reviewed by the City Commission in the near future. THE MAYOR PROCLAIMED the Week of September 12 - 19, 1971 - ''AMERICAN FIELD SERVICE WEEK''. The proclamation was read by Sue McBride. THE MAYOR PROCLAIMED the week of September 17 - 23, 1971 - ''CONSTITUTION WEEK''. The proclamation was read by Mrs. N. T. Stewart, D A R Regent. THE MAYOR PROCLAIMED the week of September 19 - 25, 1971 - ''NATIONAL DOG WEEK IN SALINA''. The proclamation was read by Mr. Baten L. Young. THE CITY ENGINEER reported on Water Pipe Bids, which were received August 30, 1971, that Stevens Contractors, Inc. met the specifications. A motion was made by Commissioner Losik, seconded by Commissioner Weisgerber to award the contract to Stevens Contractors, Inc. for $70,298.50. Ayes: (4). Nays: (0). Motion carried. THE CITY ENGINEER reported on Petition Number 3165, which was filed by Lee Haworth on May 18, 1971, for concrete pavement, water and sewer lines on all of Bobby Place, all of Mike Drive, and part of Bret Avenue north from Neal Avenue to the north line of Bonnie Ridge Addition, that there are 31 lots in the benefit district and 20 owners signed the petition which equals 64% making a sufficient petition. A motion was made by Commissioner Losik, seconded by Commissioner Cooper, in view of Resolution Number 3064 adopted June 29, 1970 by the Board of Commissioners, to table this petition until October 4, 1971 so the Commissioners can make a decision pertaining to the context of the Resolution. Ayes: (4). Nays: (0). Motion carried. Ryberg for the rezoning of a tract of land in Section 7-14-2 (near Lakewood Park) to District "C" (Apartment District). A motion was made by Commissioner Cooper, seconded by Commissioner Weisgerber to accept the Salina City Planning Commission recommendation and approve the rezoning and to introduce an ordinance for first reading. Ayes: (4). Nays: (0). Motion carried. j ORDINANCE PASSED: Number: A LETTER was received from the Salina City Planning Commission recommending the approval of Petition Number 3184, which was filed by John C. Ryberg for the rezoning of all of Block 8, Belmont Addition to District "DD" (Office District). A motion was made by Commissioner Weisgerber, seconded by Commissioner Losik to accept the Salina City Planning Commission recommendation and approve the rezoning and to introduce an ordinance for first reading. Ayes: (4). Nays: (0). Motion carried. ORDINANCE PASSED: Number: A LETTER was received from the Salina City Planning Commission recommending the approval of Petition Number 3186, which was filed by Emerson Hawk for the rezoning of Block 22, less the East 168.8 feet thereof, Surveyor's Plat 8, to District "C" (Apartment District). A motion was made by Commissioner Weisgerber, seconded by Commissioner Losik to accept the Salina City Planning Commission recommendation and approve the rezoning and to introduce an ordinance for first reading. Ayes: (4). Nays: (0). Motion carried. ORDINANCE PASSED: Number: PETITION NUMBER 3190 was filed by Verner C. and Pearl E. Smith for the amendment of Article 3, of Chapter 25 (of The Salina Code) pertaining to private swimming pools to exclude private swimming and bathing facilities in lake areas in planned community developments and recreational areas when such areas are or have been approved by the City of Salina with the provision that such facilities comply with City,County and State Health standards. Mr. Verner Smith was present and stated the City Commission approved the Community Unit Plan which included a lake with a swimming area. The Health Department sent a notice concerning swimming pools, which under the present code would not be allowed. Commissioner Weisgerber said the Health Department probable can come up with a suitable ordinance for a private swimming area in a lake. A motion was made by Commissioner Losik, seconded by Commissioner Cooper to refer the petition to the City -County Board of Health for a recommendation. Ayes: (4). Nays: (0) Motion carried. PETITION NUMBER 3191 was filed by Melvin Crowder, Jr. for the installation of water pipes and paving on Prospect Avenue from Ohio Street to a point 5 feet west of the east line of Lot 10, Cloverdale Annex. A motion was made by Commissioner Cooper, seconded by Commissioner Losik to refer the petition to the City Engineer. Ayes: (4). Nays: (0). Motion carried. PETITION NUMBER 3192 was filed by One Hundred North Santa Fe Company, Inc., for the rezoning of Lots 1 - 7, Block 5, Riker Manor Addition to District "C" (Apartment Distric�) A motion was made by Commissioner Weisgerber, seconded by Commissioner Losik to refer the petition to the Salina City Planning Commission. Ayes: (4). Nays: (0). Motion carried. PETITION NUMBER 3193 was filed by Richard J. Neuman for the installation of a city sanitary sewerage lateral to service the property known as 1739 Glen, in the City of Salina: legal description to -wit: Part of Lot One (1), Plat Forty Nine (49), beginning at the southwest corner of Lot Two (2), West 150 feet, North 275 feet, East 150 feet, South to the beginning, plus fifteen feet west of the retaining wall. A motion was made by Commissioner Losik, seconded by Commissioner Weisgerber to refer the petition to the City Engineer. Ayes: (4). Nays: (0). Motion carried. A CEREAL MALT BEVERAGE License Application was filed by Steve M. Sterling, d/b/a Virg's, 115 West Pacific. (New). A motion was made by Commissioner Losik, seconded by Commissioner Cooper to approve the license application. Ayes: (4). Nays: (0). Motion carried. A MOTION was made by Commissioner Weisgerber, seconded by Commissioner Losik to authorize the Mayor to sign "Notice of Intervention" on behalf of the City in the case of the State of Kansas, el rel v. Rockwell Manufacturing Company, et al. Ayes: (4). Nays: (0). Motion carried. A RESOLUTION was introduced and passed entitled: "WHEREAS, the Corps of Engineers has previously designed and constructed a flood control system on the Smoky Hill River for the City of Salina, Kansas; and ..." (requesting the Corps of Engineers to initiate a study to review the operations of the flood control system and its' effects upon the Smoky Hill River through Salina). A motion was made by Commissioner Losik, seconded by Commissioner Weisgerber to adopt the Resolution as read and the following vote was had: Ayes: Cooper, Losik, Weisgerber, Caldwell (4). Nays: (0). Commissioner Ashton absent. Carried. The Mayor approved the Resolution and it is numbered 3107. A MOTION was made by Commissioner Weisgerber, seconded by Commissioner Cooper to approve a Supplemental Agreement with Bob Smith Salvage Company for the demolition of seven additional unsafe structures within the City. Ayes: (4). Nays: (0). Motion carried. MR. ELMER PEARSE was present on behalf of the Salina Silver Sabres Drum and Bugle Corps, and requested the City Commission designate the Silver Sabres as the official musical group to represent the City of Salina and that some funds be made available to them. He mentioned the number of hours each member puts in, with no pay; also the officers and parent$ give a great deal of time with no pay, and he feels the group is a "good will" ambassador of the City of Salina. Commissioner Losik moved to take it under advisement to see if they can. come up with some help. The motion died for the lack of a second. Commissioner Weisgerber said he feels the City Commission should consider it, but did not feel a motion was necessary. Commissioner Losik stated that the Commission will consider it at a later date. Mr. Frank Langshaw said the City should help the Salina Silver Sabres. MR. ROBERT FROBENIUS was present asking about his hearing by the Board of Zoning Appeals. The City Attorney told him the Board of Zoning Appeals did not report to the City Commission, but he heard the Board took his request under advisement. Commissioner Losik stated they should wait until a decision is made by the Board of Zoning Appeals. THE MAYOR, with the approval of the City Commissioners, made the following appointments: Salina City Planning Commission Ronald R. Richmond, appointed to succeed William Reimold, for a three year term to May 1, 1974. Cecil Beverly, appointed to fill the unexpired term of Pat Bolen to May 1, 1973. Joint Economic Council of the Chamber of Commerce Jack Weisgerber as the City Commission representative. AN APPROPRIATION ORDINANCE was introduced and passed entitled: "AN ORDINANCE making an appropriation for the payment of certain claims." (bills - $336,751.14). A motion was made by Commissioner Losik, seconded by Commissioner Weisgerber to adopt the ordinance as read and the following vote was had: Ayes: Cooper, Losik, Weisgerber, Caldwell (4). Nays: (0). Commissioner Ashton absent. Carried. The Mayor approved the ordinance and it is numbered A-1595. AN APPROPRIATION ORDINANCE was introduced and passed entitled: "AN ORDINANCE making an appropriation for the payment of certain claims." (payroll - $107,815.18). A motion was made by Commissioner Losik, seconded by Commissioner Weisgerber to adopt the ordinance as read and the following vote was had: Ayes: Cooper, Losik, Weisgerber, Caldwell (4). Nays: (0). Commissioner Ashton absent. Carried. The Mayor approved the ordinance and it is numbered A-1596• A MOTION was made by Commissioner Weisgerber, seconded by Commissioner Cooper that the Regular Meeting of the Board of Commissioners adjourn.
