05-24-1971 MinutesCity of Salina, Kansas Commissioners' Meeting May 24, 1971 The Regular Meeting of the Board of Commissioners met in the Commissioners' Room, City -County Building, on Monday, May 24, 1971, at four o'clock p.m. The Mayor asked everyone to stand for the Pledge of Allegiance to the Flag and a Moment of Silent Prayer. There were present: Mayor Robert C. Caldwell, Chairman presiding Commissioner Leon L. Ashton Commissioner Norma G. Cooper Commissioner Mike Losik, Jr. Commissioner Jack Weisgerber comprising a quorum of the Board, also: L. 0. Bengtson, City Attorney Norris D. Olson, City Manager D. L. Harrison, City Clerk Absent: None The Minutes of the Regular Meeting of May 17, 1971, were approved as mailed. THE MAYOR PROCLAIMED May 24 - June 2, 1971, "Circle of Safety" days. The j proclamation was read by Sgt. Herb Clark, Salina R THE MAYOR PROCLAIMED the Month of Police June - "J 0 Department. Y MONTH'' (Job Opportunity for Youth) The proclamation was read by Eugene White, Vice Chairman of the Salina Council on Human Relations. THE MAYOR PROCLAIMED The Month of June - "JOBS FOR VETERANS MONTH". The proclamation was read by Mayor Caldwell. THE CITY COMMISSIONERS considered the bid from D. A. Nelson for the purchase of the City Hall and Police Building Site. A motion was made by Commissioner Cooper, seconded by Commissioner Ashton to accept Mr. Nelson's bid of $45,000.00 for the City Hall and s Police Building Site and Improvements. Ayes: (5). Nays: (0). Motion carried. A REPORT was made by the Building Code Advisory Board which submitted two ordinances concerning modular housing which will satisfy trade groups and will permit modular housing in Salina without sacrificing any of the code standards now being enforced. (The four ordinances now on second reading are not workable) AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE exempting persons employed in the construction of prefabricated or modular residential structures from the license requirements of Section 9-130 of The Salina Code. (Tabled at the May 10, 1971 meeting) A motion was made by Commissioner Ashton, seconded by Commissioner Cooper to adopt the ordinance as read and the following vote was had: Ayes: (0). Nays: Ashton, Cooper, Losik, Weisgerber, Caldwell (5). The ordinance was defeated. AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE providing the method for the electrical inspection of structures constructed or assembled other than at their ultimate location and excepting the same from the provisions of Section 9-166 of The Salina Code. (Tabled at the May 10, 1971 meeting) A motion was made by Commissioner Ashton, seconded by Commissioner Cooper to adopt the ordinance as read and the following vote was had: Ayes: (0). Nays: Ashton, Cooper, Losik, Weisgerber, Caldwell (5). The ordinance was defeated. I Ordinance Passed: Number: THE CITY ENGINEER reported on Petition Number 3160 which was filed by John Kipley,'i on May 10, 1971, for a stop sign at the intersection of Lewis and East Minneapolis. (Referred to the City Engineer at the May 10, 1971 meeting) The City Engineer reported that the traffic count was low, and that there were no accidents in 1969 and 1970, and that there have been two accidents in 1971. The Traffic Engineer recommended the petition be denied. A motion was made by Commissioner Ashton, seconded by Commissioner Weisgerber to deny the petition. Ayes: (5). Nays: (0). Motion carried. THE CITY ENGINEER reported on Petition Number 3161 which was filed by Kenneth Nordboe, on May 11, 1971, for water line to service Lots 1 to 12, Block 15, Wallerius Addition. (Referred to the City Engineer at the May 17, 1971 meeting) The City Engineer reported that 57% of the land owners signed the petition and recommended the petition be accepted for construction. A motion was made by Commissioner Ashton, seconded by Commissioner Weisgerber to accept the City Engineer's recommendation to install the water line. Ayes: (5). Nays: (0). Motion carried. APPRAISERS report was filed for Job 531 - Lateral Sanitary Sewer 512 to serve Lot 6 and part of Lot 7, Mount Barbara Park Addition. A motion was made by Commissioner Weisgerber, seconded by Commissioner Ashton to accept the appraisers report and instruct the City Clerk to publish notice of hearing for June 7, 1971. Ayes: (5). Nays: (0). Motion carried. MR. LEE HAWORTH, President of the Board of Salina Realtors, stated there is a nation wide program "Make America Better". He said they had a committee investigate the river clean-up project, and presented the Chairman of the project, Mr. N. C. Grant. Mr. Grant presented to the City Commissioners the report his Committee made on the river clean-up project. He said they met with the Corps of Engineers and others interested in river clean up. As a group, they can do nothing, they need the help of the City. The Salina Realtors offered to help the City Commissioners any way possible. Commissioner Losik thanked the Committee for their efforts. He said it is a start, and we cannot help but go forward. Commissioner Ashton asked Mr. Grant if they had checked with Wichita about the problem of putting sludge back into the ground. He said they did check with them, but it is too early to see if it will be satisfactory. Commissioner Cooper feels there is a need for more water in the old river channel. The City Manager stated the City would probable have to increase the size or number of tubes from the cut-off channel to the river. Mr. Haworth said the Corps of Engineers will allow the City to increase the number of tubes. He said there will be a need to increase the tubes under 2 or 3 bridges within the City. ft was suggested that during the week of June 21, 1971, the City Commissioners and the Realtor Committee for River Clean up get together to discuss the project. A LETTER was received from the Building Official relating to the unsafe structure at 401 East Pacific, establishing a date for a public hearing under K. S. A. 12-1752 1970 Supplement. The City Attorney said that the Health Department had recommended to the Building Official that this is an unsafe structure and is beyond repair and needs to be demolished. A motion was made by Commissioner Weisgerber, seconded by Commissioner Ashton to accept the recommendation of the Building Official and Health Department. Ayes: (5). Nays: (0). Motion carried. A RESOLUTION was introduced and passed entitled: "A RESOLUTION fixing the time and place and providing for notice of a hearing before the Governing Body of the City of Salina, Kansas, at which time the owner, his agent, lienholders of record and occupants of Lots 1, 3, 5, and 7, Block 6, Episcopal Military Institute Addition (401 East Pacific Avenue) in said City may appear and show cause why such structure should not be condemned and ordered repaired or demolished as a dangerous or unsafe structure. (The Resolution establishes July 12, 1971 as the date set for the hearing). A motion was made by Commissioner Weisgerber, seconded by Commissioner Ashton to adopt the Resolution as read and the following vote was had: Ayes: Ashton, Cooper, Losik, Weisgerber, Caldwell (5). Nays: (0). Carried. The Mayor approved the Resolution and it is numbered 3089. PETITION NUMBER 3165 was filed by Lee Haworth for the installation of streets, sewer lines and water lines on all of Bobby Place; all of Mike Drive and part of Bret Avenue north from Neal Avenue to the north line of Bonnie Ridge. A motion was made by Commissioner Ashton, seconded by Commissioner Weisgerber to refer the petition to the City Engineer for a report. Ayes: (5). Nays: (0). Motion carried. PETITION NUMBER 3166 was filed by Raymond Mudd for the vacation of street right- of-way by reducing the radius of the cul-de-sac from 70 feet to 48 feet at the intersection of Yale Avenue and Maple Avenue adjacent to Lots 26, 27, 28, Block 1, and Lot 4, Block 7, Worsley Addition to the City of Salina, Kansas. The City Engineer recommended the vacation of the street right-of-way. A motion was made by Commissioner Ashton, seconded by Commissic Cooper to accept the recommendation of the City Engineer for the vacation of the street right-of-way and introduce an ordinance for first reading. Ayes: (5). Nays: (0). Motion carried. Ordinance Passed: Number: A CEREAL MALT BEVERAGE license application was filed by M. Lucille Dumas, d/b/a The Village Gate, 1329 East Iron Avenue. (New) A motion was made by Commissioner Weisgerbe seconded by Commissioner Ashton to approve the license application. Ayes: (5). Nays: (0). Motion carried. THE MAYOR, with the approval of the City Commissioners, made the following appointment: Salina Airport Authority Ben Vidricksen, appointed to succeed M. J. Kennedy, for a 3 year term to April 26, 1974• A LETTER was received from Mrs. George Johnson, resigning from the Citizens' Advisory Committee for Community Improvement. The Commissioners accepted her resignation and thanked her for her time and effort spent on this committee. AN APPROPRIATION ORDINANCE was introduced and passed entitled: "AN ORDINANCE making an appropriation for the payment of certain claims." (payroll - $92,421.23) A motion was made by Commissioner Losik, seconded by Commissioner Weisgerber to adopt the ordinance as read and the following vote was had: Ayes: Ashton, Cooper, Losik, Weisgerber, Caldwell (5). Nays: (0). Mayor approved the ordinance and it is numbered A-1582. Carried, MR. FRANK LANGSHAW was present and asked where the funds would come from to tear down an old house at 621 West South Street, and when they would do it? The City Engineer explained they have several such houses in the process and when the proper waiting time is up, they will have the City Commissioners set a date to receive bids for the demolition. He also asked in which fund the $45,000.00 the City will receive for the Old City Hall and Police Building, will go? The City Manager explained that State Law requires the money go into the General Operating Fund. A motion was made by Commissioner Ashton, seconded by Commissioner Losik that the Regular Meeting be adjourned. Ayes: (5)• Nays: (0). Motion carried. z p � D. L. Cooper Commissioner Mike Losik, Jr. Commissioner Jack Weisgerber comprising a quorum of the Board, also: Ron Barta, Assistant City Attorney William E. Harris, Director of Administration D. L. Olson, City Manager ENGINEERING JOB 531 The meeting was held for the purpose of acting on the appraisers report for Engineering Job 531, for Lateral Sanitary Sewer Number 512 to serve Lot 6 and part of Lot 7, Mount Barbara Park Addition to the City of Salina, Saline County, Kansas. No protests, written or oral, were filed. A motion was made by Commissioner Losik, seconded by Commissioner Cooper to approve the appraisers report as read, and to introduce the assessment ordinance for first reading. Ayes: (5). Nays: (0).
