03-29-1971 MinutesCity of Salina, Kansas Commissioners' Meeting March 29, 1971 The Regular Meeting of the Board of Commissioners met in the Commissioners' Room, City -County Building, on Monday, March 29, 1971, at four o'clock p.m. The Mayor asked everyone to stand for the Pledge of Allegiance to the Flag and a Moment of Silent Prayer. There were present: Mayor Robert C. Caldwell, Chairman presiding Commissioner Leon L. Ashton Commissioner Donald D. Millikan Commissioner Carl R. Rundquist Commissioner Richard H. Zimmerman comprising a quorum of the Board, also: L. 0. Bengtson, City Attorney Norris D. Olson, City Manager D. L. Harrison, City Clerk Absent: None The Minutes of the Regular Meeting of March 22, 1971, were approved as mailed. THE MAYOR PROCLAIMED March 29 - April 2, 1971 - "NATIONAL F. H. A. WEEK IN SALINA" (Future Homemakers of America) The proclamation was read by Marlene Odler. Building. BIDS were received for the Demolition of the Old City Hall and Old Police Ark Wrecking Company, Inc. 4141 MacArthur Road, Wichita, Kansas (75 days) $6,820.00 J. S. Frank Construction Company, Inc. 225 South Fifth, Salina, Kansas (90 days) $9,666.00 George W. Champney P. 0. Box 82, Topeka, Kansas (90 days) $10,391.31 Bob Smith Salvage Company P. 0. Box 223, Solomon, Kansas (90 days) $11,551.00 Dore Wrecking Company 2300 N. Huron Road, Kawkawlin, Michigan(60 days) $14,757.00 C. S. Ehinger 4802 East 12th Street, Kansas City, Mo.(90 days) $16,800.00 A PETITION was presented by Mrs. Norb Skelley with the signatures of 2912 people who want to delay the demolition of the Old City Hall one year. (The petition was later numbered 3149.) Mr. Harold Chase was the spokesman for the citizens present who want to save the Old City Hall. He said all the individuals want is time to come up with plans and financing for the Old City Hall, and a possible use. They want the City Commission to grant a reasonable time of 120 days so they can organize. Mrs. Irvin Fuchs said the City needs a new bus station and thinks the building would be good for this purpose and also will save the building for its historical value. She believes the present depots are obsolete and disgraceful. She said the building could be rented to the bus companies and they could remodel it to suit their needs. She claims she did not know the City was in the process of tearing the Old City Hall down because she didn't see anything in the newspaper. D LJ 1 f Mr. Albert Levin said the museum needs more space, and Salina needs a downtown museum. Mr. James Williams wants the City Commissioners to put it on the ballot for the I coming election. He was told it is too late. Mr. Bernard Jilka represents no group, but thought he could get 3000 signatures of persons who want to tear Old City Hall down. It looks bad and is a disgrace to the surrounding area. He questioned its use as a museum, and asked who would feed the parking i meters to go to the museum? Mr. Wendell Wyatt, mentioned that the old City Building in Wichita is attractive because at night they flood it with lights. Mr. William Butschle did not want the building demolished and another hole left like the Lamer Hotel. Commissioner Rundquist guaranteed there would be no hole because there is an ordinance prohibiting it. Commissioner Rundquist feels there is a question of economics. In checking with the Kansas Power and Light Company, the 1969 gas and lights were $3,200.00. The building needs a new boiler at a cost of about $9,300.00, air conditioning, and the wiring is bad. He referred again to the report from the Kansas Historical Society which did not believe the building would make a good museum. i j Commissioner Rundquist mentioned that the Community Theatre is interested in the site, and individuals are interested for commercial purposes. He said the building is a disgrace to the City and should be torn down. Commissioner Ashton asked Mr. Chase if the group could do anything in 30 days. Mr. Chase asked for 90 days. Mr. Chase said he believes the only way to get things done is by pressure, and again asked for a reasonable time. i Mr. Rich Nethaway spoke of economics. If the Community Theatre is built there, the City is obligated to pay the utilities and upkeep of the building. 3 Commissioner Zimmerman commented about the number of non-residents who signed the petition. Commissioner Ashton thinks the people have shown a great interest to save the Old City Hall, and should be given 90 days to investigate a feasible use of it. € A motion was made by Commissioner Ashton to table for 90 days so the group jcould show evidence of financial and feasible use of the building. Mr. Jim Turpen suggested that 30 days is long enough; they won't do anything until the last 2 days anyway, if it's like most committees. Commissioner Zimmerman asked the City Attorney what to do with the bids just Iopened. The City Attorney advised we have 30 days to accept the bid. Commissioner Millikan feels 30 days is long enough for the group to decide what they can do with the building. i Commissioner Ashton amended his motion to read 4 weeks, and was seconded by Commissioner Millikan, Ayes: (5). Nays: (0). Motion carried. i i THE CITY COMMISSIONERS reconsidered Petition Number 3148 for the construction of a sidewalk on the east side of Indiana Avenue from Gypsum Avenue to Greeley Avenue. (The petition was tabled for one week at the March 22, 1971 meeting) I Mrs. Harold Emig, President of the Glennifer Hill PTA presented a lengthy report j on the why's and where's of sidewalks in the Indian Rock Addition. The report was very j well presented stating the possibilities and reasons the sidewalk should be put on the east side of Indiana Avenue. The people on the west side of the street do not want a sidewalk in their back yards, even if the City pays 80% of the cost, as it did on Marymount Road. i She said a sidewalk on Delaware would cause children to cross 6 or 7 intersections to get to school, and she did not think this would be a good place. Commissioner Rundquist asked if the plans that were prepared by Ralph Ricklefs for the development of Indian Rock Park included sidewalk on the east side of Indiana. They were not included. solution? Mrs. Emig asked if the petition is voted down, would the City offer an alternate Commissioner Zimmerman asked the Safety Director about checking into the possibility of a stop sign at Greeley and Delaware. A motion was made by Commissioner Millikan, seconded by Commissioner Zimmerman to direct the City Engineering Department to prepare a feasibility study of sidewalks in the area, and report back in three weeks. Ayes: (5). Nays: (0). Motion carried. AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE prohibiting loitering by persons under 18 years of age in places selling cereal malt beverages and providing exceptions thereto, amending Section 6-55 of The Salina Code and repealing the existing section." (Amending the code to include"... or a premise for which a bowling alley license has been issued by the City of Salina, Kansas, for the current year A motion was made by Commissioner Ashton, seconded by Commissioner Rundquist to adopt the ordinance as read and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Zimmerman, Caldwell (5). Nays: (0). Carried. The Mayor approved the ordinance and it is numbered 8153. The ordinance was introduced for first reading March 22, 1971. AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE pertaining to the regulation, control, and licensing of dogs within the City of Salina, Kansas, and providing the procedures therefor; providing for the issuance of special permits for operation of kennels within specified areas and setting the fee therefor; amending Article II of Chapter 8 of The Salina Code and repealing said original section." Dr. C. L. Olson gave a lengthy report on what a good dog ordinance should do, sucr as control dogs, disease, kennels, etc. The Dog Ordinance Committee wants a summons issued to dog owners when they have numerous violations. The big question that concerns the Committee is the definition of a kennel. They don't believe this will help the dog situation in the City. There would still be people with three dogs, not providing for proper sanitation requirements. Commissioner Zimmerman offered an amendment to the ordinance, where the kennel license would be inspected by the Health Officer and issued by the City Clerk. In the original ordinance, final approval was by the City Commissioners. Mrs. Raymond Freeman asked the City Attorney to define a nuisance as written into the dog ordinance. The City Attorney said it must be decided in court, because a nuisance to one person is not a nuisance to someone else. Mr. Spohn complained about 7 dogs surrounding his house. The people don't keep the yards clean in the summer and they stink. Karen Tinkler asked if she purchased a kennel license, would she have to buy a dog license and show proof of vaccination for each dog. She was informed she would have to. Commissioner Rundquist moved to return the dog ordinance to Committee for a report in 4 weeks. The motion was seconded by Commissioner Zimmerman. Ayes: (5). Nays: (C Motion carried. Someone asked about cats. Dr. Olson said they would take care of them later. A CHARTER ORDINANCE was introduced for second reading entitled: "A CHARTER ORDINANCE exempting the City of Salina, Kansas, from the provisions of KSA 13-14a06, which provides for membership fees and contributions by officers and members of the Fire and Police Departments for their retirement systems and providing for refunds upon termination of services with said departments and providing substitute and additional provisions on the same subject." (will allow time spent and contributions paid to the pension funds to be transferable between the Police and Fire Departments.) A motion was made by Commissioner Rundquist, seconded by Commissioner Ashton to adopt the ordinance as read and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Zimmerman, Caldwell (5). Nays: (0). Carried. The Mayor approved the ordinance and it is numbered Charter Ordinance Number 6. The ordinance was introduced for first reading March 22, 1971. M I A CHARTER ORDINANCE was introduced for second reading entitled: "A CHARTER ORDINANCE exempting the City of Salina, Kansas, from the provisions of KSA 13-14x05, which provides for the designation and investment of money derived from taxes and f assessments for the Policemen's and Firemen's Pension Funds, providing for a minimum reserve for each fund, for their retirement systems and providing substitute and additional provisions on the same subject." (will set a $10,000.00 minimum with provision for the $50,000.00 maximum removed) A motion was made by Commissioner Millikan, seconded by Commissioner Rundquist to adopt the ordinance as read and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Zimmerman, Caldwell (5). Nays: (0). Carried. The Mayor approved the ordinance and it is numbered Charter Ordinance Number 7. The ordinance was introduced for first reading March 22, 1971. THE CITY COMMISSIONERS considered a proposal by Wilson and Company to provide a redevelopment plan for a portion of the Central Business District for a cost of $5,000.00. The City Manager explained that a public hearing has been held on the Neighborhoods Development Program for the Central Business District and we have the authority to take the next step. This proposal by Wilson & Company fits into the overall plan of the NDP. A motion was made by Commissioner Rundquist, seconded by Commissioner Millikan to authorize the Mayor to sign the agreement with Wilson and Company to begin immediately. Mr. Elmer Pearse, Wilson & Company, said they want to start immediately because of interest of private investors in the downtown area. i It was suggested the Salina City Planning Commission be made aware of the proposal at their next regularly scheduled meeting. The Mayor called for a vote on the motion to authorize the Mayor to sign the agreement with Wilson and Company. Ayes: (5). Nays: (0). Motion carried. MR. J. L. WILLIS, Concrete Contractor, complained about the depth of concrete footings. He said he would call into the office and get a depth, and when he came in, it would be another depth. It was suggested he talk with the City Engineer, and maybe he could help straighten the matter up.
