03-15-1971 MinutesCity of Salina, Kansas Commissioners' Meeting March 15, 1971 The Regular Meeting of the Board of Commissioners met in the Commissioners' Room, City -County Building, on Monday, March 15, 1971, at four o'clock p.m. The Mayor asked everyone to stand for the Pledge of Allegiance to the Flag and a Moment of Silent Prayer. There were present: Mayor Robert C. Caldwell, Chairman presiding Commissioner Leon L. Ashton Commissioner Donald D. Millikan Commissioner Carl R. Rundquist Commissioner Richard H. Zimmerman (comprising a quorum of the Board, also: i L. 0. Bengtson, City Attorney Norris D. Olson, City Manager i D. L. Harrison, City Clerk Absent: None The Minutes of the Regular Meeting of March 8, 1971, were approved as mailed. THE MAYOR PROCLAIMED March 21 - 27, 1971 - "NATIONAL WILDLIFE WEEK". The ,proclamation was read by Mr. Gordon Gorton, Saline County Rod and Gun Club. I THE MAYOR PROCLAIMED March 21 - 27, 1971 - "KANSAS WEEK OF CONCERN FOR PRISONERS 1OF WAR/MISSING IN ACTION." The proclamation was read by Nathalie Gawthrup, Red Cross Office. THE MAYOR PROCLAIMED March 14 - 21, 1971 - "INTERNATIONAL DEMOLAY WEEK". The ,proclamation was read by a member of Demolay. AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE adopting the Uniform Building Code, Volume V, Signs, 1970 Edition except as modified by Article IV of The Salina Code and repealing the existing Section 9-63 of The Salina Code." A motion ;was made by Commissioner Ashton, seconded by Commissioner Rundquist to adopt the ordinance gas read and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Zimmerman, 'Caldwell (5). Nays: (0). Carried. The Mayor approved the ordinance and it is numbered 78146. The ordinance was introduced for first reading March 8, 1971. AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE repealing ';Section 9-7 of The Salina Code which pertains to signs required on new construction projects." A motion was made by Commissioner Millikan, seconded by Commissioner Zimmerman to adopt the lordinance as read and the following vote was had: Ayes: Ashton, Millikan, Rundquist, !Zimmerman, Caldwell (5). A motion was made by Commissioner Millikan, seconded by Commissioner Zimmerman to adopt the ordinance as read and the following vote was had: Ayes: Ashton Millikan, Rundquist, Zimmerman, Caldwell (5). Nays: (0). Carried. The Mayor approved the ordinance and it is numbered 8150. The ordinance was introduced for first reading March 8, 1971. AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE providing for the amendment of Section 608 of The Uniform Plumbing Code pertaining to appliance connections." A motion was made by Commissioner Ashton, seconded by Commissioner Rundquist to adopt the ordinance as read and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Zimmerman, Caldwell (5). Nays: (0). Carried. The Mayor approved the ordinance and it is numbered 8151. The ordinance was introduced for first reading March 8, 1971. A MOTION was made by Commissioner Millikan, seconded by Commissioner Ashton to introduce an ordinance for first reading defining a non-resident electrician and exempting said person from electric examination prior to issuance of license." Motion carried. j Ordinance Passed: Number: A CEREAL MALT BEVERAGE License Application was filed by Randy Kuhn for Salina Musicians Association Local 207, 2055 South Ohio Street (New). A motion was made by Commissioner Ashton, seconded by Commissioner Millikan to approve the license application. Ayes: (5). Nays: (0). Motion carried. A CEREAL MALT BEVERAGE License Application was filed by Fun Sports of Kansas, Inc.,' I d/b/a New Holiday Bowl, 1125 West South Street, Jess Gilman, General Manager (New). A motion was made by Commissioner Millikan, seconded by Commissioner Ashton to approve the license application. Ayes: (5). Nays: (0). Motion carried. s A CEREAL MALT BEVERAGE License Application was filed by Salina Bowling Company, Inc!., d/b/a All Star Lanes, 624 South Broadway, Richard M. Lindblom, Secretary -Treasurer and ? Manager (New). Commissioner Millikan asked the City Attorney to explain the sale of beer in bowling alleys. The City attorney stated that if the beer application is in order, there is no recourse but to approve the application; however, the problem will be when they start to sell beer, anyone under 18 years of age will not be allowed in the place of business according to The Salina Code. A motion was made by Commissioner Millikan, seconded by Commissioner Ashton to approve the license application. Ayes: (5). Nays: (0). Motion carried. COMMISSIONER MILLIKAN asked what could be done about East Crawford Street. The City Attorney thought there is some way to have the street paved and assess the costs to the property owners, but asked the City Commissioners to give him a week to check the possibilities. The City Manager stated that this street is beyond maintenance. The weather this winter has definitely made this street beyond repair. Commissioner Ashton asked if this winter has been harder on the streets than winters in the past. The City Engineer replied, "Yes". COMMISSIONER MILLIKAN said he has heard and read a lot of comments about the Personnel Manual which was recently given to the City Employees. He said, "There seems to be some misunderstanding about it. This booklet deals with all aspects concerning the rules and regulations under which all city employees must work. For the most part, these policies have been understood and complied with for years, but this is the first time in recent years these policies have been put down in writing. This type of document had been requested by many city employees and I think it is generally quite good and should be very useful. It was explained to each employee, as he received his copy of this manual, that ! these policies would be subject to change. If he felt any changes, corrections, or amendments needed to be made, he should make his ideas known to his supervisor or department head and his suggestions would be reviewed. To my knowledge, no constructive suggestions have been received. Suggestions that this manual be burned or junked are completely irresponsible in my opinion. After all, our City Code Book is constantly being reviewed and changed, but any suggestions to scrap it completely would be viewed as outrageous. "Apparently, one of the controversial sections of the manual, is the one that deals specifically with a city employees conduct during local elections. This section encourages all employees to register, to vote, and to become informed about the candidates. This section precludes the employee from engaging in any political activity involving the election of a city or county candidate for political office. This section also explains the reason for this restriction. "This rule is not new to the City of Salina. It has been in effect for a number of years, but as I said, this is the first time many of these rules have been put in writing. Neither is this rule unique to Salina, since most cities have a similar policy for their employees. I suggest that all city employees read their copy, become familiar with it, and if they like, discuss it with the proper people. It's yours - use it." COMMISSIONER RUNDQUIST concurred with Commissioner Millikan's remarks. He also understood from the Firemen that they wanted a personnel manual with all personnel procedu in writing. This was done, now they say, "junk it!" THE CITY MANAGER stated eleven other cities have employee manuals with sections pertaining to political activities. The section in Salina's personnel manual is worded almost exactly as Wichita's manual. The Salina manual was made up from The Salina Code, State and Federal Laws and policies which have been in effect in the past. THE MAYOR, with the approval of the City Commissioners, made the following appointments: Band Trustees - Glen VanCleef - reappointed for a 3 year term to 1/1/1974 Electrical Code Panel - William B. Stokes, Attorney, to fill the unexpired term of Aubrey Linville, to April 6, 1972. AN ORDINANCE was introduced and passed entitled: "AN ORDINANCE making an appropriation for the payment of certain claims." (bills - $115,791.23) A motion was made by Commissioner Rundquist, seconded by Commissioner Millikan to adopt the ordinance as read and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Zimmerman, Caldwell (5). Nays: (0). Carried. The Mayor approved the ordinance and it is numbered A-1573. A MOTION was made by Commissioner Rundquist, seconded by Commissioner Ashton that the Regular Meeting be adjourned.
