Commissioners' Meeting
February 8, 1971
The Regular Meeting of the Board of Commissioners met in the Commissioners' Room,
City -County Building, on Monday, February 8, 1971.
THE MAYOR asked everyone to stand for the Pledge of Allegiance to the Flag and
a Moment of Silent Prayer.
There were present:

The Minutes of the Regular Meeting of February 1, 1971, were approved as mailed.
THE MAYOR PROCLAIMED the Week of February 14 through 20, 1971 - "NATIONAL BEAUTY
SALON WEEK". The proclamation was read by Mrs. Ronald (Margaret) Tanner, of the Salina
Beauty Academy.
i THE MAYOR PROCLAIMED February 16, 1971 - ''SALINA LEGAL SECRETARIES DAY -IN -COURT"
The proclamation was read by Mrs. Patricia Lloyd, President of the Salina Legal Secretaries
Association.
MR. LEWIS BOYD, President of the Kansas Society of Land Surveyors, presented
Robert Hein, of the City Engineering Office, a Plaque for "Surveyor of the Year for Kansas"
and congratulated him for his fine work in the preparation of their weekly newsletter.
A bouquet of flowers was presented to Mrs. Hein.
AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE levying
special assessments on lots, pieces and parcels of ground in the City of Salina, Kansas,
for the purpose of paying a portion of the cost of:
The installation of an 8" cast iron pipe water main
beginning at an existing 8" water main located on the
south side of North Street to the end of Idlewilde Place
thence running east approximately 110 feet to the south
parking of North Street; thence north crossing North Street
to the north parking; thence east in the north parking of
North Street to the east line of Lot 4, Brown & Brown
Addition # 1 to the City of Salina, Saline County, Kansas.
A motion was made by Commissioner Millikan, seconded by Commissioner Zimmerman to adopt
the ordinance as read and the following vote was had: Ayes: Ashton, Millikan, Rundquist,
Zimmerman, Caldwell (5). Nays: (0). Carried. The Mayor approved the ordinance and it
is numbered 8144. The ordinance was introduced for first reading February 1, 1971.
j AN APPLICATION was filed by Shaver and Company for lighting and planters on the
! southeast corner of Walnut and Santa Fe, for aesthetic value, under Section 32-41 of The
Salina Code. The City Engineer explained that putting signs in the lights would be in
violation of the Sign Code, but the planters would be fine with just the lights. Mr. Pratt]
Bradley of. Shaver and Company said the reason for the placement of the signs in the lights )I
is that other type signs cannot be seen under the marquee. A motion was made by
Commissioner Rundquist, seconded by Commissioner Ashton to table the application. Ayes: (5.
Nays: (0). Motion carried.

A CEREAL MALT Beverage License Application was filed by Barbara Rodriquez,
Manager of Acapulco Restaurant, 1035 East Pacific Street. (new) A motion was made by
Commissioner Millikan, seconded by Commissioner Rundquist to approve the license application.
i Ayes: (5). Nays: (0). Motion carried.
A CEREAL MALT Beverage License Application was filed by Paul John Richardson,
d/b/a Village Gate Inn, 1329 East Iron Avenue. (new) A motion was made by Commissioner
Rundquist, seconded by Commissioner Ashton to approve the license application. Ayes: (5).
Nays: (0). Motion carried.
MRS. MIKE (Anita) ALTON, presented a petition, later numbered 3143, with the
signatures of 60 parents who have children crossing Cloud Street in front of Hageman School.
The petition asks that a School Crossing Guard be hired to assist the children crossing
Cloud Street. Mrs. Alton said approximately 250 cars, in a 30 minute time period, go by
the school when children are trying to cross. The Principal of Hageman School, Baten Young,
will not allow Junior Patrol to help children across Cloud Street. The City Manager
suggested a roll out sign at the times children are crossing the street. Chief of Police
Woody stated that voluntary help at the crossings does not work out because they are not
dependable, sometimes they are there and sometimes they are not. A motion was made by
Commissioner Rundquist, seconded by Commissioner Ashton to hire a School Crossing Guard
for this location immediately. Ayes: Ashton, Rundquist, Caldwell (3). Nays: Millikan (1).
Commissioner Zimmerman abstained. Motion carried.
AN ORDINANCE was introduced and passed entitled: "AN ORDINANCE making an
appropriation for the payment of certain claims." (Bills - $239,255.94). A motion was made!
by Commissioner Rundquist, seconded by Commissioner Ashton to adopt the ordinance as read
and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Zimmerman, Caldwell (5).!
Nays: (0). Mayor approved the ordinance and it is numbered A-1567. Carried.
! AN ORDINANCE was introduced and passed entitled: "AN ORDINANCE making an
appropriation for the payment of certain claims." (payroll - $98,213.38) A motion was made'
by Commissioner Ashton, seconded by Commissioner Rundquist to adopt the ordinance as read
and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Zimmerman, Caldwell (5).
Nays: (0). Mayor approved the ordinance and it is numbered A-1568. Carried.
THE MAYOR, with the approval of the other City Commissioners read the following
statement:
"On or about the 25th day of January, 1971, three individuals, purporting
to represent the entire personnel of the Salina Fire Department as a class,
filed four separate lawsuits in the District Court of Saline County against the
City of Salina and various officers thereof, including the entire City Commission.!
These actions are, respectively, for injunction, for mandamus, for conspiracy
damages, and for actual and punitive tort damages.
"The principal underlying basis charged by the plaintiffs in each lawsuit
is that the three named plaintiffs have been discharged from their former position
in the Fire Department because they belong to Local Number 782 of the International!
Association of Fire Fighters, and that all other members of the Fire Department
have been threatened with discharge if they continue to belong to such union.
The simple truth of the matter is that, continuously since 1944, there has been
an organized local of said union to which many members of the Fire Department
have been and continue to be members. Never in the entire history of the local
union has any member of the Salina Fire Department been discharged or threatened
with discharge or other discrimination for belonging to such union. As a matter
of fact, the City of Salina has no interest whatever whether its Fire Department
employees or any other employees do or do not belong to a union. Simply and
plainly, the City of Salina has no legal power or authority to recognize or bargain
with any union concerning working conditions, wages, tenure, or other matters
regarding the jobs of its City employees. As a matter of fact, each of the three
named plaintiffs was given the exact reason in writing for his termination from `
his job which had nothing whatever to do with union membership, or lack of it.
For reasons of their own, such discharged individuals have not seen fit to make
such reasons known to the public.
"The City Commission feels that the lawsuits in question were irresponsibly
filed and are based on completely irresponsible and false charges. Nevertheless,
the City has no choice but to defend itself and its duly elected and constituted
officials in these baseless lawsuits.and shall do so to the limit of its ability.
Unfortunately, such defense will undoubtedly compel the City to spend money for
unforeseen and wholly unbudgeted expense that is badly needed for other
legitimate government functions, such as improved services, salary and wage
increases, etc.
''Until
now the City
government
has purposely refrained from making
public utterances
about
this matter,
endeavoring to protect the names and
reputations
of all of its employees,
including the firemen. Unfortunately, the
City is now
left with no
choice but
to give the matter a full public airing in
the lawsuits
in question
and shall do
so to the extent of its ability.''
A MOTION was made by Commissioner Rundquist, seconded by Commissioner Ashton that
the Regular Meeting be adjourned. Ayes: (5). Nays: (0). Motion carried.

There was no meeting today because a quorum was not present because of a 12 inch
snow.
Bids to be received for Job 530 for the improvement of miscellaneous streets will
be held over to March 1, 1971.
