Commissioners' Meeting
January 11, 1971
The Regular Meeting of the Board of Commissioners met in the Commissioners'
Room, City -County Building, on Monday, January 11, 1971, at four o'clock p.m.
THE Mayor asked everyone to stand for the Pledge of Allegiance to the Flag and
a Moment of Silent Prayer.
There were present:
Mayor Robert C. Caldwell, Chairman presiding
Commissioner Donald D. Millikan
Commissioner Carl R. Rundquist
Commissioner Richard H. Zimmerman
comprising a quorum of the Board, also:

Commissioner Leon L. Ashton
The Minutes of the Regular Meeting of January 4, 1971, were approved as mailed.
THE MAYOR PROCLAIMED January 17 through 23, 1971 - "INTERNATIONAL PRINTING WEEK'.
The proclamation was read by Everett Sailsbury.
THE MAYOR PROCLAIMED January 15, 1971 - "MARTIN LUTHER KING day in Salina, Kansas''
The proclamation was read by Rev. J. E. Jones, Salina Branch of NAACP.
A LETTER was received from the Salina City Planning Commission recommending the
denial of the rezoning of 501 West Cloud to District "D" (Local Business). The rezoning
was requested in Petition Number 3134, which was filed by C. N. Hoffman on October 6, 1970.
The Salina City Planning Commission recommended the denial of the property on December 14,
1970, and the City Commissioners referred the petition back to the Salina City Planning
Commission on that date for reconsideration.
THE CITY PLANNER reported that the Salina City Planning Commission had done
some study and layouts of the area. Mr. Hoffman's Attorney was present and said he would
contact Mr. Hoffman and explain the different ideas of the Planning Commission.
Mr. Berkley called the City Planner and asked if the rezoning could be tabled for one
week because he was unable to be present. A motion was made by Commissioner Zimmerman,
seconded by Commissioner Millikan to table the issue for one week. Ayes: (4). Nays: (0).
Motion carried.
PETITION NUMBER 3141 was filed by John C. Ryberg for the construction of curb,
guttering and paving (as needed), water and sewer service for Lot 19, Block 2; Lot 10,
Block 5; and all of Block 1, (Preliminary Plat) Lakewood Addition. A motion was made by
Commissioner Millikan, seconded by Commissioner Rundquist to refer the petition to the
City Engineer for a feasibility report. Ayes: (4). Nays: (0). Motion carried.
PETITION NUMBER 3142 was filed by John C. Ryberg for the Rezoning of Lot 19,
Block 2; Lot 10, Block 5; and all of Block 1, Lakewood Addition to District "C" (Apartment
District). A motion was made by Commissioner Rundquist, seconded by Commissioner
Zimmerman to refer the petition to the Salina City Planning Commission. Ayes: (4).
Nays: (0). Motion carried.
A CEREAL MALT BEVERAGE license application was filed by James Norman Martin,
d/b/a One Spot Cafe, 316 South Broadway. (Renewal) A motion was made by Commissioner
Millikan, seconded by Commissioner Zimmerman to approve the license application. Ayes: (4).
Nays: (0). Motion carried.

A TREE TRIMMING License Application was filed by Marvin Reinert, d/b/a Reinert
Tree Service, 2042 Wesley, for trimming only. A motion was made by Commissioner Rundquist,
seconded by Commissioner Millikan to approve the license application. Ayes: (4). Nays: (0�
Motion carried.

A TREE TRIMMING License Application was filed by Paul Handlin, d/b/a Handlin
Tree Service, Marquette, Kansas, for trimming only. A motion was made by Commissioner
Rundquist, seconded by Commissioner Millikan to approve the license application.

A MOTION was made by Commissioner Rundquist, seconded by Commissioner Millikan
to introduce an ordinance for first reading prohibiting private rooms or closed booths by
businesses licensed to sell cereal malt beverages and providing exceptions thereto;
amending Section 6-50 of The Salina Code and repealing the existing section. Ayes: (4).
Nays: (0). Motion carried.

A MOTION was made by Commissioner Millikan, seconded by Commissioner Zimmerman
to introduce an ordinance for first reading providing that any place of business licensed
to sell cereal malt beverages shall be open to the public and police at all times; providing
exceptions thereto; amending Section 6-51 of The Salina Code and repealing the existing
Section. Ayes: (4). Nays: (0). Motion carried.

A MOTION was made by Commissioner Zimmerman, seconded by Commissioner Millikan
to introduce an ordinance for first reading regulating the location and visibility of
places of business licensed as a general retailer for the sale of cereal malt beverages
and providing exceptions thereto; amending Section 6-61 of The Salina Code and repealing
said existing section. Ayes: (4). Nays: (0). Motion carried.

A MOTION was made by Commissioner Millikan, seconded by Commissioner Rundquist
to introduce an ordinance for first reading prohibiting dancing in any place where cereal
malt beverages are sold and providing exceptions thereto. Ayes: (4). Nays: (0). Motion
carried.

THE MAYOR, with the approval of the City Commissioners made the following
appointments:
Public Welfare Board
Mrs. Richard Shelton for a 5 year term to May 21, 1975 to
succeed Earl C. Woodward.
Electrician's Examining Board
Karl Stutterheim, Electrical Engineer, to fill the unexpired
term of Duane Chapman, who resigned, to July 24, 1971.
Cultural Arts Commission
Mrs. Frank (Charlotte) Stockham for a 3 year term to January 16, 1974,
to succeed Mrs. Joe Mendicina.
Robert H. Levin for a 3 year term to January 16, 1974, to succeed
Dr. L. W. Hatton.
Randy Kuhn, reappointed for a 3 year term to January 16, 1974.
Mrs. Peggy Rodgers, reappointed for a 3 year term to January 16, 1974.
Salina -Saline County Civil Defense Council
Richard H. Zimmerman, City Commissioner, to succeed William W. Yost,
to January 8, 1972.
Norris D. Olson, City Manager, reappointed for a 3 year term to
January 8, 1974.

THE CITY ENGINEER filed Partial Estimate # 1 for Job 525 - Upper Mill Heights
Addition Number 2 Improvements, for Brown & Brown, Inc., in the amount of $5,869.35. A
motion was made by Commissioner Rundquist, seconded by Commissioner Millikan to approve the
estimate. Ayes: (4). Nays: (0). Motion carried.
AN ORDINANCE was introduced and passed entitled: "AN ORDINANCE making an
appropriation for the payment of certain claims." (bills - $81,544.90) A motion was
made by Commissioner Millikan, seconded by Commissioner Zimmerman to adopt the ordinance
as read and the following vote was had: Ayes: Millikan, Rundquist, Zimmerman, Caldwell
(4). Nays: (0). Commissioner Ashton absent. Mayor approved the ordinance and it is
numbered A-1564. Carried.
AN ORDINANCE was introduced and passed entitled: "AN ORDINANCE making an
appropriation for the payment of certain claims." (bills - $243,370.35) A motion was
made by Commissioner Millikan, seconded by Commissioner Zimmerman to adopt the ordinance
as read and the following vote was had: Ayes: Millikan, Rundquist, Zimmerman, Caldwell
(4). Nays: (0). Commissioner Ashton absent. Mayor approved the ordinance and it is
numbered A-1565. Carried.
A MOTION was made by Commissioner Millikan, seconded by Commissioner Zimmerman
that the Regular Meeting be adjourned. Ayes: (4). Nays: (0). Motion carried.
