Room,
City -County Building, on Monday, December 21, 1970, at four o'clock p.m.
The Mayor asked everyone to stand for

A motion was made by Commissioner Rundquist, seconded
by Commissioner Ashton to
refer all
bids to the City Manager for checking of the specifications,
and a report back next week.
Ayes: (4). Nays: (0). Motion carried.
A LETTER was received from the Veterans of Foreign Wars requesting permission to
install a flag pole on the sidewalk in line with the parking meters at 212-214 North Santa
Fe Avenue. A motion was made by Commissioner Rundquist, seconded by Commissioner Ashton
to approve the installation of the flag pole, at no cost to the City. Ayes: (4). Nays: (0;
Motion carried.
THE CITY COMMISSIONERS considered an agreement between the City of Salina and
the State Highway Commission, whereas the State will request the Federal Highway Administra
for approval of Project Number 70-85 1-70-4 (-) highway lighting on Interstate Route # 70,
for that portion within the City Limits of Salina. A motion was made by Commissioner
Millikan, seconded by Commissioner Rundquist to approve the agreement. Ayes: (4). Nays:
Motion carried.
A MOTION was made by Commissioner Millikan, seconded by Commissioner Rundquist to
introduce an ordinance for first reading relating to benefits obtainable by cities under
the program for Federal and State Aid on Highway Construction and authorizing the Mayor to
sign the agreement. Ayes: (4). Nays: (0). Motion carried.

A MOTION was made by Commissioner Millikan, seconded by Commissioner Rundquist
that the Salina City Planning Commission set a date, as soon as possible, for a public
hearing for an amendment to the Zoning Ordinance for Mobile Home Parks. Ayes: (4).
Nays: (0). Motion carried.
CITY ENGINEER filed Final Estimate on Job 522 - East North Street Water Main -
for Brown & Brown, Inc., in the amount of $1,093.30. A motion was made by Commissioner I
Ashton, seconded by Commissioner Rundquist to approve the estimate. Ayes: (4). Nays: (0).
Motion carried.
AN ORDINANCE was introduced and passed entitled: "AN ORDINANCE making an
appropriation for the payment of certain claims." (Bills - $417,086.19) A motion was
made by Commissioner Rundquist, seconded by Commissioner Ashton to adopt the ordinance
as read and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Caldwell (4).
Nays: (0). Mayor approved the ordinance and it is numbered A-1559. Carried.
AN ORDINANCE was introduced and passed entitled: "AN ORDINANCE making an
appropriation for the payment of certain claims." (Payroll - $93,785.04) A motion was
made by'Commissioner Rundquist, seconded by Commissioner Ashton to adopt the ordinance
as read and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Caldwell (4).
Nays: (0). Mayor approved the ordinance and it is numbered A-1560. Carried.
AN ORDINANCE was introduced and passed entitled: "AN ORDINANCE making an
appropriation for the payment of certain claims." (Bills - $79,510.27) A motion was
made by Commissioner Rundquist, seconded by Commissioner Ashton to adopt the ordinance
as read and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Caldwell (4).
Nays: (0). Mayor approved the ordinance and it is numbered A-1561. Carried.

that the Regular Meeting be adjourned. Ayes: (4). Nays: (0). Motion carried.

AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE levying
assessments on lots, pieces and parcels of ground in the City of Salina, Kansas, for the
9 purpose of paying a portion of the cost of:
Sanitary Sewer Pumping Station and Force Main to serve the
area described as follows:
That part of the Southwest Quarter of the Southeast Quarter

of Section Eighteen, Township 14 South, Range 2 West of the
ESixth Principal Meridian in Saline County, Kansas, lying
{ east and above elevation 1239.0 feet; and that part of the
Northwest Quarter of the Northeast Quarter of Section Nineteen,
Township 14 South, Range 2 West of the Sixth Principal Meridian
in Saline County, Kansas, lying east and above elevation 1239.0
feet."

made by Commissioner Millikan, seconded by Commissioner Ashton to adopt the ordinance as
read and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Caldwell (4).
Nays: (0). Mayor approved the ordinance and it is numbered 8131. Carried. The ordinance
was introduced for first reading December 14, 1970.

AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE prescribing
the corporate limits of the City of Salina, Kansas, including land described in Ordinance
Number 8066, and repealing Section 1 of Ordinance Number 8057." A motion was made by
{ Commissioner Rundquist, seconded by Commissioner Millikan, to adopt the ordinance as read
and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Caldwell (4). Nays: (0)i
Mayor approved the ordinance and it is numbered 8132. Carried. The ordinance was introduce
for first reading December 14, 1970.
AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE relating

Construction." (authorizing the Mayor to sign the agreement) A motion was made by
Commissioner Ashton, seconded by Commissioner Millikan to adopt the ordinance as read and

for first reading December 14, 1970.
THE CITY COMMISSIONERS considered an Addendum to the License Agreement between
the Pagoda Club and the City of Salina for the extension of their agreement for the use
of the Old Municipal Airport for Drag Racing, from January 1, 1971 to December 31, 1971.
A motion was made by Commissioner Millikan, seconded by Commissioner Rundquist to approve
the addendum. Ayes: (4). Nays: (0). Motion carried.
A LETTER was received from the Salina City Planning Commission recommending the
approval of the rezoning of Lots 10, 11, 12, Bishop's Addition to District "D" (Local
Business), which was requested in Petition Number 3139, filed by Earl Bane on November 16,
1970. A motion was made by Commissioner Rundquist, seconded by Commissioner Ashton to
accept the recommendation of the Salina City Planning Commission and approve the rezoning,
and to introduce the rezoning ordinance for first reading. Ayes: (4). Nays: (0). Motion
carried.

Mr. DAVID Le BER was present claiming that he had filed a complaint with the Police',
Department, and that the Department has not taken any action. His complaint was that
gambling is going on in certain fraternal organizations, and he feels there should be
charges made and licenses revoked. He said if the Police Department does not take action,
he will go to the Attorney General.
The City Attorney stated that at 11:30 A.M., December 4, Mr. LeBer and Mr. David
Lord were present in his office and he told them the proper procedure to make a complaint
at the Police Department of gambling activities. Mr. David Lord, Attorney for Mr. LeBer
stated that at 9:40 P.M. on December 4th, they reported to the Police Department and made
j a complaint of gambling at the Labor Building.

They said it took the officer 20 minutes to fill out the report, and that no
detectives would talk to them.

Chief Woody stated that if he has any complaint about his Department, his door
is always open.
Commissioner Rundquist commented that Mr. LeBer has a personal vendetta going.
Commissioner Rundquist requested that Mr. LeBer take the slot machine and dangling dice
down from the front of his building. He said it was in poor taste and looks bad hanging
on a building on Santa Fe.

SIXTEEN CEREAL MALT BEVERAGE LICENSE APPLICATIONS were filed for renewal for 1971.
A motion was made by Commissioner Millikan, seconded by Commissioner Ashton to approve the
applications except # 5 filed by Kenneth C. Wiens, d/b/a Kenny's Market, 520 East Cloud,
and # 24 filed by Leonard J. Dahl, d/b/a Hide -away, 540 Willis, which were not approved
by the Chief of Police. Ayes: (4). Nays: (0). Motion carried.
A MOTION was made by Commissioner Millikan, seconded by Commissioner Ashton to
introduce an ordinance for first reading relating to inoperable vehicles; providing certain
Placement or storage of same on public or private property; prescribing duties for certain
officers and prescribing penalties. Ayes: (4). Nays: (0). Motion carried.

A MOTION was made by Commissioner Rundquist, seconded by Commissioner Millikan
that the entire membership of the Salina City Planning Commission be named to the "Solid
Waste Management Committee" for the City of Salina, and that John Ryberg be appointed the
City Representative to the County Plan for solid waste. Ayes: (4). Nays: (0). Motion
carried.

made by Commissioner Ashton, seconded by Commissioner Millikan that the ordinance be
