11-16-1970 Minutes*),I *, Xk City of Salina, Kansas Commissioners' Meeting November 16, 1970 The Regular Meeting of the Board of Commissioners met in the Commissioners' Room, City -County Building, on Monday, November 16, 1970, at four o'clock p.m. The Mayor asked everyone to stand for the Pledge of Allegiance to the Flag and a Moment of Silent Prayer. There were present: Mayor Robert C. Caldwell, Chairman presiding Commissioner Leon L. Ashton Commissioner Donald D. Millikan Commissioner Carl R. Rundquist Commissioner William W. Yost comprising a quorum of the Board, also: L. 0. Bengtson, City Attorney Norris D. Olson, City Manager D. L. Harrison, City Clerk Absent: None The Minutes of the Regular Meeting of November 9, 1970, were approved as mailed. THE MAYOR proclaimed the Weekend of November 21 and 22, 1970 - "CIRCLE OF SAFETY WEEKEND". The Proclamation was read by Sgt. Herb Clark of the Salina Police Department. THE MAYOR proclaimed the week of November 22 - 29, 1970 - "BIBLE WEEK". The proclamation was read by Rev. Marshall Stanton. BIDS were received for the Gasoline Supply for Central Garage for the period of November 20, 1970 through May 20, 1971. The bids were opened and tabulated, and a motion was made by Commissioner Rundquist, seconded by Commissioner Yost to award the bid to Gulf Oil Company as low bidder for the six month period. (Regular .11400; Ethyl .13151; 3 to 1 average .12710 per gallon) Ayes: (5). Nays:(0) Motion carried. BIDS were received for the Diesel Fuel Supply for the period of November 20, 1970; through May 20, 1971. The bids were opened and tabulated, and a motion was made by Commissioner Rundquist, seconded by Commissioner Yost to award the bid to Walthers Oil Company (Champlin) as low bidder for the six month period. (.10800 per gallon) Ayes: (5). Nays: (0). Motion carried. BIDS were received for the Gasoline Supply for the Fire Department for the period. of November 20, 1970 through May 20, 1971. The bids were opened and tabulated. An identical bid was submitted by Walthers Oil Company (Champlin) and Gulf Oil Company. A I coin was tossed, and Walthers Oil Company won the toss. A motion was made by Commissioner Rundquist, seconded by Commissioner Yost to award the bid to Walthers Oil Company (Champlin) for the six month period. (.14000 per gallon for Ethyl) Ayes: (5). Nays: (0). Motion carried. AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE creating and defining a certain Lateral Sanitary Sewer District in the City of Salina, Kansas, designated as Lateral Sanitary Sewer District Number 512, and providing for the constructioh of a Lateral Sanitary Sewer in said Lateral Sanitary Sewer District Number 512, so created and providing for the payment of the cost thereof and for the levying of special assessments against the property in said District for the payment of the cost of such construction and for the issuing of bonds to pay the cost thereof." (Sewer is to serve Lots 6 and 7, Mount Barbara Park Addition, which was requested in Petition Number 3137, filed by James A. Greenwood, Jr. on October 16, 1970). A motion was made by Commissioner Yost, seconded by Commissioner Ashton to adopt the ordinance as read and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Yost, Caldwell (5). Nays: (0). Mayor approved the ordinance and it is numbered 8121. Carried. Ordinance was introduced for first reading November 9, 1970. 1 1 1 AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE providing C for the review of all plans by the City Engineer for proposed construction or excavation within 1000 feet landward of levees and a minimum of 500 feet riverward of levees, prohibiting any proposed construction or excavation that will impair the function of the Flood Protection Works, providing for the issuance of permits and authorizing the withholding of grade sheets and building permits until compliance with this ordinance and prescribing penalties for violation." A motion was made by Commissioner Yost, seconded by Commissioner! Millikan to adopt the ordinance as read and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Yost, Caldwell (5). Nays: (0). Mayor approved the ordinance and it is numbered 8122. Carried. The ordinance was introduced for first reading November 9, 1970• REPORT from the Traffic Engineer concerning parking on East Iron Avenue, near Marymount College (referred at the meeting of November 2, 1970). The City Engineer reported that they could not recommend "No Parking" on East Iron Avenue at this time, as there have been only 5 accidents during the period of June 1968 to the present, and those were not due to parking or slippery pavement. A motion was made by Commissioner Yost, seconded by Commissioner Rundquist to accept the City Engineer's report and leave the parking as it is, but keep an eye on it. Ayes: (5). Nays: (0). Motion carried. REPORT from the Traffic Engineer concerning Petition Number 3138, which was filed by Betty Jesnowski to prohibit parking on the south side of Maple Avenue from Hageman', to Haskett, because the street is only 25 feet wide and there are no sidewalks, (referred at the meeting of November 9, 1970). The City Engineer reported that 37.5% of the owners signed the petition with about an equal number on each side of the street. The City Engine�r feels there are other streets in the area that are just as narrow, and could not recommend "No Parking" on this street only. Mr. McCabe mentioned that he had just heard the church purchased additional property for off street parking and this will probably eliminate the problem. A motion was made by Commissioner Millikan, seconded by Commissioner Rundquist to place no restrictions on parking on Maple Avenue at this time. Ayes: (5). Nays: (0). Motion carried. REPORT from the Traffic Engineer concerning the intersection of South Santa Fe and South Street, where young people have been making excessive noise with their cars by Asbury Hospital. (Referred at the meeting of November 9, 1970) The City Engineer reported' there are four 18 x 18 inch signs with the message "Hospital Zone, Quiet, Drive Slow". The!. City Engineer suggested the signs could be relocated and four 30 x 30 reflector signs could; be installed with the message "Quiet Zone". A motion was made by Commissioner Rundquist, seconded by Commissioner Ashton to have the 4 additional 30 x 30 inch signs installed and have the present signs relocated at the City Engineer's discretion. Ayes: (5). Nays: (0) Motion carried. A MOTION was made by Commissioner Ashton, seconded by Commissioner Rundquist to introduce an ordinance for first reading adopting the 1970 Edition of the Uniform Plumbing Code, as amended by the Building Code Advisory Board. Ayes: (5). Nays: (0). Motion carried. Ordinance Passed: n 23,1910 Number: liz'i CITY COMMISSIONERS considered an agreement between the City of Salina and Saline County concerning a study of the structure and jurisdiction of the Salina City Planning Commission and the Saline County Planning Commission. A motion was made by Commissioner Rundquist, seconded by Commissioner Yost to authorize the Mayor to sign the Contract Agreement with Bucher and Willis, Consulting Engineers, Planners and Architects Ayes: (5). Nays: (0). Motion carried. PETITION NUMBER 3139 was filed by Earl Bane for the rezoning of Lots 10, 11, 12, Bishop Addition from District "C" (Apartment District) to District "D" (Local Business) (315-321 North Ninth Street). A motion was made by Commissioner Rundquist, seconded by Commissioner Millikan to refer the petition to the Salina City Planning Commission. Ayes: (5). Nays: (0). Motion carried. PETITION NUMBER 3140 was filed by Warren H. Garrett for the refusal of the rezoning of 501 West Cloud from District "A" (Second Dwelling House District) to District "D" (Local Business) - which was requested in Petition Number 3134, filed by C. N. Hoffman,; ! Agent, on October 6, 1970. A motion was made by Commissioner Millikan, seconded by Commissioner Ashton to refer the petition to the Salina City Planning Commission. Ayes: (5). Nays: (0). Motion carried. A CEREAL MALT BEVERAGE LICENSE APPLICATION was filed by John Landes, d/b/a Landes Oil Company for the Apco Station at 680 South Phillips, for package sales only (new)I A motion was made by Commissioner Millikan, seconded by Commissioner Yost to approve the license application. Ayes: (5). Nays: (0). Motion carried. A CEREAL MALT BEVERAGE LICENSE APPLICATfON was filed by Benevolent Order of Brotherhood - The Bridge Club, 148 South Santa Fe Avenue, David S. LeBer, Manager. A motion was made by Commissioner Rundquist, seconded by Commissioner Ashton to approve the license application. Ayes: (5). Nays: (0). Motion carried. i A LETTER was received from Parents without Partners, Inc., regarding the use of the Lobby at Memorial Hall on April 3 and 4, 1971. They want to have four eight foot tables for the exhibition of Arts and Crafts. A motion was made by Commissioner Rundquist' seconded by Commissioner Ashton to allow the Parents without Partners to use the Lobby of Memorial Hall without charge, if they get permission from the Midwest Performing Arts, of Wichita, Kansas, which is presenting a show in Memorial Hall on April 3, 1971. The City Manager suggested they get written approval and file a copy with the City Clerk. Ayes: (5). Nays: (0). Motion carried. THE MAYOR, with the approval of the City Commissioners appointed Homer Wells to the Building Code Advisory Board to fill the unexpired term of Duane Chapman, to June 1, 1972. AN ORDINANCE was introduced and passed entitled: ''AN ORDINANCE making an appropriation for the payment of certain claims.'' (bills - $121,240.24) A motion was made by Commissioner Millikan, seconded by Commissioner Yost to adopt the ordinance as read and the following vote was had: Ayes: Ashton, Millikan, Rundquist, Yost, Caldwell (5). Nays: (0). Mayor approved the ordinance and it is numbered A-1557• Carried.
